more participation if we woke up inactive members. Please send the advocacy news letter to all members to get more participation.
Members from the mid western states - your participation is crucial in the advocacy efforts.

It is very difficult to get appointments from legislative offices if no one from their constituency will be attending the meeting.
The DC Advocacy effort is for YOUR green card. Please take the time to talk to your employers now and get the required 2 days off to participate in the event.

Let me guess. You have a friend or a relative in the H1 que. And this H1 applicant is either getting education in US or is not going to be an employee of a consulting firm.
No. You got me wrong. I have friends filing through consulting firms. You got me wrong completly. Outsourcing/offshoring firms are completely different from Consulting firms. Consulting firms files new h1s and get the people here to work for their clients. This is good to new prople who wants to come here legally, to US busincsses and to everybody (except for anti-immigrants). But Outsourcing/offshoring firms file lot of H1s and do not use them. Thats the problem. If they use, it is not going to be a problem.
Second guess: You have a US degree or you are not working for a conslting firm.
This is also wrong. I don't have any US degree. Also, I am working as Consultant from past 3 years. I worked with different big clients as a conultant. This is how it works in US. Again, Consultancy is different from Outsourcing/offshoring.
Why do you think the spouses on H4 do no deserve H1? If they want to work, why do you think that they should not compete in the job market?
I said they deserve to apply for H1. You got it wrong.
BTW, the companies you are cursing, TCS, Wipro, Satyam etc., it is possible that soon the H1s applied by these companies will be exempt from numercial limit. Yes, you heard me right. Here is a bill that would make companies providing scholarships to undergrad and grad programs to be exempt from H1 numerical count. This is not a joke, read for yourself: :p
I am not agaist the consulting or competition or anybody who wants to work here legally. I am againt the wastage of H1s. Applying them and not using them is a problem. By the way, where was the law to excempt those so called outsourcing firms from numerical H1 cap? Can you please provide the link? If there is one, then there is no chance of reaching cap so fast. No firm is going to waste the money by filing H1 and not allowing them to work is US after getting it except for Outsourcing firms. It is a fact, agree it or not.
H1 cap problem is there in 1990s also before Congress increased the cap to 195K. But it was solved when increased the cap to 195k and we saw so many H1 visas on 2001, 2002, 2003 are un-used. Samethng might happen even now if Congress increases it to 200K. Since we have less visas, everybody tries to grab a slot, But if we have enough visas (200K cap), then nobody is in a hurry to apply like the one happened this year.

You should ONLY use AP to re-enter. Do not re-enter on H1. In the secondary inspection, the IO will know that your GC has been approved. Congratulations !!!

Can you please suggest what we need to do next.
1) We can collect additional funds for lobbying this issue (we do contribute monthly)
2) We can write letters or meet senators

It was great to attach faces to the IV handles...
I walked into situation room on Sunday night at 9 and was thrilled to find almost 30 - 40 ppl working hard on the preparations for the lobby day on monday. It was great to meet aman, paskal, pappu, logiclife, gsc999, nixstor, arun,..... (list is too long:D)
Soon I and mark teamed up to do the preps for the lobby day meetings. Monday was fun, with all the meetings with lawmakers with barely any time in between meetings - we were literally on the run, hopped on to taxi to save time and walk!! It was a chilling feeling when couple of times ppl on the hallway of Rayburn/Cannon stopped us and asked "R U lobbyist?":D
Dinner was a great. Hats of to Anu and Meenal for the menu... It was nice that we got the food all the way to situation room, so that we can have another go at it!!! Speeches by fellow IV-ers, lawyers and lawmakers at the dinner really primed us with lots of energy for rally on Tuesday. Ofcoz the wine helped too:D:D
The rally was just great. Even though I didn't have my breakfast, the energy of the people around me kept me going or was it the wine...
I had an opportunity to meet a great bunch of folks focussed on a common goal. After meeting 6 lawmakers and seeing the enthusiastic members who drive this organization. I am confident success is around the corner:D

To whoever left the comment in my profile "why all this love for US Passport?"
It all depends on what country you are a citizen of. If you are a passport holder of a country like Canada,Autralia or most european countries, then you may not see much benefit in holding a US passport when travelling. But people from certain other countries, have to go through the hassle of obtaining visas prior to international travel, vacations etc. Sometimes we even have to get transit visas for countries that we pass through on our way to the final destinations. And these visas cost money. But if you hold a US passport/citizen of the US, then they do not make you jump through all those hoops. You board the plane and you get a visitors visa once you land in almost all countries (there are exceptions, India and Australia for example). But there it is. That is one of the priviledges of having a US passport.

Hi, I did that today. A personalized letter along with copies of the Interim Bulletin and te USCIS press release on July 2.
Next, I want to write to other senators who are friendly to skilled immigrants (Cantwell, Cornyn etc). Has someone compiled a list of them?
That is awesome, thanks. That is going to work.

I had been talking to Sivakanth and he told me how yourself, Arun and all your DC gang worked tirelessly
YOU GUYS were EXCELLENT and WONDERFUL
All this shows how much has gone into this rally and planning. This will give a sense of what it takes to achieve something that is phenomenal in nature.
Yes, we can achieve GROUND BREAKING results with folks like you
Thanks. I missed you. I think I should have seen you but can't remember. Since morning at least 10 people who i have talked to from Tri-State area asked me if I know where is chanduv23? they just wanted to see the great motivator like you. Please point me to the picture where I can find you. Your posts on the IV forum have been an inspiration for lot of folks. It takes people like you to form a group of wonderful hardworking folks.

This is not fair to the person who blew the wistle and alarmed people about the situation. I think we should know and analyze these facts. Most importantly, with all the policy change and lobbying we are trying to do, why can't we make sure that USCIS does its job in a fair, transparent, orderly way!
The reason there is a lot of "rumor" is simply due to those government agencies' imcompentencies, which resulted in lack of confidence and trust from the public.
They CANNOT do whatever they want any more SO LONG AS we stand up to our rights. Don't wait till the problems show up again! Act now to prevent them from happening... at least to get our voice heard so that the whole green card thing will no longer be like a lottery!

Thanks much for your help. Especially now that you are out of the rut; but your willingness to help others is higly appreciated. Hope all this effort will bring some positive outcome.
I had discussion with Mr.Gotcher about this issue. He said, AILA is collecting information on this matter and they are pursuing with Altanta center. But he does not believe or expect any positive outcome. As said earlier he insist to send a formal complaint with OIG and offered his time/help. As its affecting large group of people he refused to accept any fee. I offered we are ready to cover any expense which he might incurr, but seems like it would be very less and he offered free service. Mr.Gotcher will draft a letter in a week time. What we need now - lot support and signature. We do not need to provide any case number. so I dont believe there would be any consequence. So guys please come forward. Spread this news as much as possible and get enough support. Help yourself and get out of this mess.
Thanks.

It's extremely difficult, if not impossible to maintain PR status in both US and Canada due to the residency requirements. Once you get your US GC the best thing to do is to abandon your Canadian PR if you intend to live in the US and make your home here. Frankly I don't see any benefit of mainatining your Canadaian PR. If you try to do that it might even jeopardize your GC. Google and you will find lots of advice on this issue. I plan to live and work here in the US.
Thanks Lasantha. Yes, I have been reading a lot on google about it. Some readers also suggested landing and come back using AVR as I have a valid HIB approval but still I am not feeling comfortable doing it. I guess I will not land there. My whole process until 485 went very smooth, I am in ROW category, and hope all goes well till approval. I am also planning to stay in US.
Damn, this whole thing is giving me headache now

My labor certification (Traditional EB-3) is stuck in BEC since last 5 years. It is completely beyond my understanding why it took so long for BEC to process my case. Now everyone is rejoicing USCIS's decision to accept all green card applications, but I am paralyzed with the fear of facing another huge backlog on I-485 applications. One government agency sits on our applications for years and another government agency throws us further back in the line to cover up its blunders and guess what who pays the price: WE RULE-ABIDING, LINE-WAITING FOLKS.
Even if I get my labor approval before September, I will be among the last persons to get labor certification in spite of being the one with the earliest priority date. Nothing would give me greater pleasure than suing DOL BEC at this time. We may not sue DOL on their inability to clear the backlogs, but we can definitely sue them in their utter disregard to FIFO procedures (mind that some people with priority dates in 2004, 2005 have already got their labor certifications, but some with priority dates in 2001, 2002 are still stuck). When I read on their web site that they have tried to maintain FIFO, it makes me feel like puking.
I am also disappointed with IV's attitude towards the backlog victims. I do not remember anything concrete done by IV to address the grievances of backlog victims. Now that they have won the battle with USCIS, will they have time to look at us?

I would like to extend thanks to all of those who shared their thoughts on this labor certification backlog ordeal. I was touched with nice words some of you bestowed on my situation.
The point I was trying to make was that we high skilled immigrants continuously have suffered from the misdeeds of Congress and government agencies. It started in 2001 when Congress passed an amnesty when people in illegal immigration status were given chances for EB Green Cards. If government wanted to legalize them, shouldnt Congress have created separate processing channel and also separate green card quotas for them? Why were we forced to share our share of green card quotas? Why did we have to undergo several years of grueling labor certification experience to make room for people who violated the immigration law?
Then there was a birth of so called Backlog Elimination Center (BEC). This agency should have been rightfully named as Backlog Creation Center. BEC spent several years not in adjudicating the labor certification cases, but in transferring paperwork and performing a circus called 45 Day Letter. When it finally started addressing the cases, it did with utter disregard to FIFO procedure. As of today, there are still thousands of cases stuck in BEC with priority dates of 2001 and 2002 (including mine). Though they have set the backlog elimination date to be September 2007, there are very strong chances that they wont. I think life would have better for all of us if no BEC was created in the first place and the labor certification process was left the old way.
The purpose of my earlier post was to draw attention to the severe injustices BEC has thrust on us. The passion and energy IV showed in dealing with the recent USCIS fiasco was commendable. If IV can channel some of that passion and energy in dealing with the BEC problems, we may get some breathing space outside this black hole called BEC.
