    Just wanted to let you know that I've booked my ticket and will be attending the advocacy days on both days. This is my first time coming to the advocacy days and am looking forward to it. I'll registering for the event tomorrow, but wanted to pass on the information.

    Also, I'll be staying at a friend's place who lives in Cockeysville, MD, a suburb of Baltimore. If anybody from this area is traveling for the event, I'd love to ride along because I won't have a car and don't know the area.

    AJB to AJE

    In anticipation of America's Job Bank (AJB) ceasing operations as a recruitment tool, the Backlog Elimination Centers (BECs) will be switching to America's Job Exchange (AJE) as an alternative site for posting recruitment advertisements for backlogged Foreign Labor Certification recruitment activity. AJE is one of the alternatives authorized by the Employment and Training Administration (ETA). The BECs have coordinated with AJE staff and we believe this transition will cause little if any disruption. According to the description provided by AJB, "AJE will offer the same national labor exchange services that AJB provided � [using] the same screens and functions as AJB ensuring a seamless transition between sites."

    Because AJB is going to stop operations by June 30, 2007, in order to ensure full recruitment periods, the BECs will switch to AJE as of June 1, 2007. Therefore, employers and job seekers will be able to find the job postings on AJE starting on June 1st. Advertisements posted on AJB prior to June 1st will continue on AJB through their full recruitment periods on AJB.

    I think those who are eligible to change to Eb2 should start immediately. In any case Eb2 was much better in past and it will be in future also as all the other country quota EB1 and Eb2 will automatically come to EB2 India and China every year. All the Eb3 should wait 10 years or hope for some law change.

    I need to go to some place where I can spit out my frustration. This is just not done. Completely unfair.

    My best guess is the USCIS people do not want to work. If the move the PD's, then they have to scan millions of files to find which ones are having the PD current. So, it is in their interest to not move the PDs.
    I think they will again open gates for a month like last year and then approve whatever file comes in their hand and that way not have to work or find the files with the PD current. So, the lucky ones will get approved and unlucky ones will keep sitting until next year (no matter what their PD is ). So, sad what kind of organization is it, no accountability and no performance checks on them.

    I am in the same boat. I wish you are true. Its so frustrating to see 2006 folks getting approved (I am happy for them that at least they are getting approved but it is unfair that we are still waiting) and we are still waiting. Ridiculous....

    Did you apply for your 485? Your profile does not show that it has.
    The date on which your 485 is filed is the order on which the applications are processed.
    your PD is only used to say whether an application is eligible for processing. Once it is eligible, it is the 485 application date that states your position in the queue.

    Dear All,

    While meeting the law makers is certainly the best option, from personal experience I have found it to be difficult. I have however been able to meet our Congressman�s associate handling immigration matters several times.

    Some ideas �

    1.From personal experience I have noted that �signed� one page letters with a specific an clear subject line helps (For example, subject could be : Bill No. S1085: Seek your kind help to recapture lost visas for the Employment based Green card applicants). It may be slow, but personally I have a feeling that it works better than emails.

    2.As it always happens, letters should never be longer than one page, especially when it is going to a government agency. No one even cares to pick up a 4 page letter and read it!

    3. Can we all jointly plan :
    a.To write a one page letter on Bill S1085 and send thousands of letters in a specific pre-planned window to the President, respective senators and congressmen/women? (Let us not make drafting an issue. With a common subject line on Bill S 1085 we can write a simple letter in our own words)
    b.Follow up the letter with the meeting of the Congressman / associate handling immigration?

    4. There is no guarantee that this will work miracles, but we can still try. Our �Flower campaign� helped, after all!

    5. The next stage could be to stage a mass satyagraha in the typical Gandhian, peaceful way before the White House or the Congress. This can be done in summer, when the weather is good. We need to start planning right away and start mobilizing our EB friends.

    I am really not sure how many of our friends would like the ideas!

    Where is famously liberal "lion" Kennedy in all this. He is the counterpart to Lofgren. When you are the chair of the subcommitte on Immigration you are supposed to be a leader on these kind of issues. Really disappointing.
    Are you kidding ? Check out the CIR.
    Did you not call his office during the CIR days & get crestfallen at how little they cared for Legals ?

    My suggestions:

    1. Combine labor certification and I-140 into a single process. It doesn't make sense to have two stages for employment based petition.

    Advantages:
    Candidate will know the result in a single stage. Once that stage is cleared he will know he is good to go from an employer perspective. Right now even after clearing Labor stage one is not sure what happens at I-140 stage. This leads to more uncertainty, worst case he will have to restart the GC process again if 140 stage fails after waiting for couple of years.

    2. Ability to Pay requirement should be only for a few years ( 2- 3 years) from the priority date.

    Right now if DOL/USCIS takes its own sweet time in processing perm/140 cases ( as happened for July fiasco cases), employer has to prove ability to Pay for all the years from the priority date. A company can close down, can go bankrupt in a recession during these long years. We have seen big wallstreet firms go belly up in this recession.

    3. Pre-adjudicate all 485 cases within 18 months from the day it is filed. Once pre-adjudicated, the case should be accorded a FINAL status which means all processing requirement for the case has been met and no further RFEs can be issued on the case. Online status of the case should reflect the FINAL status.

    Right now backlogged country candidates has to wait for a long time in uncertainty due to the current process. Once this change is implemented, candidates can have a peace of mind and guarantee that they will get a GC once visa number are available.

    My wife will be on h1b from oct 1 (currently on h4)...we have a planned visit to India in mid october and that when we plan on getting her h1b stamped (around october 20th or so). My question is since we will be travelling when her h1b has already started yet we wont have any pay stubs when we go to the consulate for stamping...will this create any problem? Also what other docs do we carry with us for the same...

    I will elaborate. EB2 was current untill September 30th 2005. So where does the 2003 "screeching blah blah" come into effect?

    Besides ike I have posted countless times...there were only 2000+ approvals for Labor certifications for India between march2005 and october 2005

    and only 7000 labor certifications for India between march 2005 and december 2005.

    These include a number of labor certifications for other worker categories. I myself saw at least 500 pipefitters and welders and joiners whose labor certification had been approved from Louisiana (maybe cos of katrina)

    so if the priority dates have to move for EB2 they will move to jan 2006 (like the chinese have) or remain at 2004

    there are also a TON of filers who filed in first quarter of 2005, mainly to stay in the old system, as people were scated of the new one (PERM). maybe 300-400 of those are from where I work (they also incidentally started processing GCs again from Q4 2004 after layoffs in 2001-2003. So expect a bump before we get into PERM, but as you say after March 2005 things should be smooth till 2006 Jan

    Thanks for making me look like an idiot in front of my lawyer and HR, everyone.

    Based on RUMORs that "USCIS may get allergic reaction to too many 485 files, and stop accepting them in mid-July" I asked my lawyer this question:

    I have a question about July Visa bulletin. If the August bulletin is retrogressed when announced in mid-July, can the USCIS change rules and stop accepting new Adjustment of status petitions in mid-July ? I know that it sounds illogical and that July bulletin's current dates would apply thru July 31st but I am hearing from my professional colleagues that USCIS could change rules and stop accepting new AOS petitions in middle of the month.

    And I got this reply :

    Yes, what you raise is quite illogical. The visa bulletin controls which AOS can be filed during the calendar month for which it is published, there is no way for USCIS to stop receiving an AOS application received say on July 16th. AOS is not like an H1B filing, where there is a finite # that must be received by a date certain and then allocated.

    See, hear that ? "NO WAY FOR USCIS". Now, I dont know why some lawyers are spreading this nonsense that "BEWARE, USCIS will stop accepting new petitions if they receive 'too many petitions'. What is 'too many ??? Who defines 'too many'? Is 'too many' defined as the time when the mail room clerk gets back pain from lifting boxes of petitions ? Or the guy printing 485 receipt notices gets carpel tunnel syndrome ?

    PLEASE PUT THIS IDEA TO REST. USCIS WILL ACCEPT PETITIONS THRU JULY 31, NO MATTER HOW TIRED THEY ARE AND NO MATTER HOW SICK THEY GET OF SEEING 485 FEDEXes COMING IN DAY AFTER DAY AFTER DAY. GOT IT ????
