Last year the H1B US MS cap wasn't over until the mid week of April and I think this year it's not going to be the same as there were a lot of missed MS applicants(I am one of them) but I don't think that the MS quota cap has no reached yet.

THIS INFO COULD VERY WELL BE CORRECT FOR THE MONTH OF AUGUST.
DOS allocates visa numbers for each month, for consulates across the world and USCIS here to adjudicate 485s. They provide these agencies with the priority dates for approval + a limit. This could have been used up for the month of AUGUST.
The spill over from FAMILY CATEGORY can only be used starting from SEPTEMBER 01 2008. Otherwise it won't go with the interpretation of the law.
Also the spillover from EB1 (for august 2008 and anything remaining for the current year) will be applied on September 01.
So, what this means is: The numbers available as per the visa bulletin for AUGUST is over. Does not mean, it's over altogether.
The theory does sound right but why will they wait to apply the spillover when the dates are current already abd it just moved 2 months in the August Bulletin for September dates

Here is why I am interested in this discussion.
1.> I am from india and retrogression affects indians, hence I wish my community can fight against this in a democratic civil way as I have always said.
2.> If ppl like you, who has no profile and who claims to have become US Citizen last week, comes here and fuels the fire to divide us - this is not going un-noticed.
3.> I feel that instead of crying over small # of LC subs, we fight for something where everyone gets benefitted. If we are successful in visa recapture or end of retrogression, everyone of us would get gc if eligible. what effect of lc sub would be there in that case?
4.> however if ppl like you come and make us fight among overselves, we reach no where. May be this is what you want. isn't it?

Labor substitution was never illegal unless you have purchased it. Hijacking the priority date is incorrect according INA. If you are not feeling pity about the fellow immigrants who suffered injustice (also from India) you are selfish a individual. FYI more than 60% of the 2007 July fiasco were substitutes

Please do not try to thwart the campaign. We are trying to address a specific issue, which is about blocking approvals when dates are current, and for that, we are using this current fiasco as an example. The USCIS memo specifically talks about EB2 india, china applicants on hold. Since EB3 was listed as U, we cannot do anything about it. If both EB2 and EB3 were current, I would have given a call to both. There is no belittling out here. the Circumstances are like that.
EB2 and EB3 are working together in the visa re-cpature.
This is a separate issue, but will be useful when visa re-capture is successful.

Lets not strictly follow what USCIS did and did not do in memo. We are all seeing the entire drama for the last 3-4 years.
Every EB3 after a little more experience gets qualified into EB2. Cant the department understand this , which we all do. There is no order. Lets together fight for a common cause and not discrimiate between Eb2 or EB3.
Commonsense rule is , if you are allowing 10 H1s to be processed, then why are you processing only 2-3 Greencards. What abot the remaining 7 and why should they wait, even after 8 years???.
Spillover and quotas are all BS.
Lets raise our voice together and see if they follow some discipline.
Anyone more than 8-10 years of being in the US and who followed the rules with merit deserves citizenship. Lets voice together as a campaign and get it straight. Yes, I am in the US for 9 years now..

No green card for you. Just work well for 6 years, enjoy life in US, enjoy sports cars by renting, not by buying, rent a big house, have a lawn and garden in back yard, grow your own vegetables. Have nice vacations like Hawaii, Jamaican islands, Vegas, Porto Rico etc.,Have fun in life. Do not go for green card. Since they had only opened and sorted out a little over 34,000 cases, it may be hard to believe that yesterday they could have completed sorting out of the entire remaining cases in one day.
