Don't dependents count against usage too - making the options of one main + one dependent/two main applicants a non-factor in visa availability?
I am curious about this process as well - from all that I know, you have to identify all the dependants prior to the 485 filing - is that true? If the couple files two 485s independently, if one gets the GC and say (heaven forbid) the other is stuck in name check or whatever, the GC in hand is not going to be of much use to the spouse stuck in the logjam.
Just use either one's.Someone in line can use the available number.

I think Kerry(i think it is actually Kennedy E who introduced it - SA180 , SA 187 did not have anyhting to do with us it was for Women centers) di dnot have any good intentions for us in troducing this.If you see on Thomas(or congress.gov and search for HR2, see the fourth version, and check out amendments), SA180 was amendment to SA143 (this is by our friend Jeff Sessions). So most probably it was part of politics. Also this status says both these amendments wer eintroduced in Senate but thats it, they did not pass.

I went to my congresswomen's office on may 6th and provided details of my pending 485. Their office called me today that our cases were approved on May 5th and cards have been mailed!! They also told me to contact NSC to get tracking no. I called NSC and and got the USPS tracking no's. No change in status online at USCIS, no email or SMS from USCIS.

A new theory has it that DOL deferred audit processing to H-2 temp labor. Now that they are wrapping up that work they are starting to move the audit cases. According to a post on forum, last week an immigration attorney received notifications on three audit cases. Unfortunately all three (from the same company) were rejected due to some kind of incompliance with the required advertisement format.

This has been the regular way... CPO e-mail first and then an e-mail saying "... we mailed you a notice that we had registered this customer's new permanent resident status."
I got my Card Production ordered email yesterday at 9:00 PM and now at 7:20 AM I get mail saying I have been registered at permenent resident. So looks like the department that registers GC is slower than the guys who print the actual card. Has any one else seen this kind of reverse order of mails?

I wonder how much power these committees have. It is clear from her letter that DOS/DHS chose not to respond to her or send her any info and defy her request to continue accepting AOS applications until she had a chance to review the matter closely. Committee has the subpoena power to force the document release and hold hearing but if DOS/DHS ignore her letter again, I wonder what would she do.
I guess the deadline is tomorrow so we'll see how this unfolds.

Hi,
My company is applying my GC in EB2 Category.My attorney has suggested me to get the experience letters in new format (includes job description,duties etc....).
I have experience letters from Indian employers in different formats.I am finding it difficult to get the letters in new format from them.
Can anybody tell me how can this can be manage by attorney or any suggestion?

If someone is responsible for the current state of affairs in the H1B area , It is Indian firms . The H1B1 was started in 'GOOD FAITH ' by United States to help people from "all over the world" to come in and work in the US , but large Indian IT houses have overexploited these loopholes so much that we are currently in this sorry state of affairs .

It is US INS responsibility to ensure no one (mostly Indian IT companies and small companies in US operated from bedrooms, not basement or garage!! :) those created in garage are HP and GOOGLE) can exploit it. So blaming TCS and WIPRO and INFY and PATNI is not enough!! If we don't protect our house and thief exploits that to rob us that is our fault. This holds true for US INS too. And don't assume INS didn't know this. No exploitation is possible without Govt's active or passive approval. This is one big ecosystem and all have their share. That is how all businesses are operated across the world. Immigration is one of the biggest businesses here. And they want this chaos to exist for their interests.

This has become a ranting thread of EB3 folks. One simple question:
How many of you EB3 India folks who are complaining actually went to Washingtno DC last month for IV Advocacy event?
I hear it was not even 250 people. If you take out all EB2 people, so few EB3 people. This means EB3 people do not really want to do anything but after every visa bulletin come to the site and rant.
We in EB2 do not have much to worry. Our dates will move fast. But you EB3 had a chance last month and you blew it by not doing anything. So stop complaining.
Were you there at DC ? I didn't see you there.

It looks like November 2005, Jan 2006 and Feb 2006 priority dates are somehow lumped together. Of course mine is December and far be it from being even considered :)

Once USCIS completes data entry of all 800K 485s (may be with in next month) they will have clear picture. They may give a report to DOS, how many waiting in each catagory (EB1,2,3) with PD with countrywise break out. Then DOS will easily setup the cutoff dates. This may happen in Jan or Feb.
I feel that EB3 India may stay like this (in 2001). EB2 India may go back to 2003 or 2002 , based on how many guys in EB3 with PD 2002, 2003 converts to EB2. All other countries may see slight forward movement.

Same here, Iam Dec 2005 and still waiting ..........
I have been looking at number and the IV forum and there are very handful number of cases with December 2005 that have been touched.
I think we need to cheer up and be optimistic in addition to creating SR, senator route and infopass. I have a feeling that all the October, Nov and December cases might be in a single lump of files and we will get it in the next week or so.

to put numbers to your guess, I am guessing roughly even at an optimistic approach, 1000 applications from EB3-I from 2002 may have ported to eb2 or left the country and nothing more than. Why not we do these guys. just a IV sampling poll. Lets create a poll for IV members alone, for eb3-I alone. Lets give all the 12 months as option, and people can update. We can atleast know how many cases are waiting in eb3-I from IV alone for the year 2002. What say you guys? any one wants to take up the initiative? We can also Add an option additionally for 2003 cases and so forth as one option. Our goal is to find how many of us here in IV are waiting with 2002 PD for eb3-I.

So if they try to process cases in 2002 they might end up finding lesser cases needing approval than they actually counted, could be bcoz of porting or people who gave up and left the country. USCIS is auto porting the date if you have old labor and i140, I know few friends who got GC like that.
2) At this pace EB2 will be current by mid next year, once it is processing time for 485 is at least 4 months which will fall into 2012, so the same huge number of spill will come to EB3 ROW. If the spill over is too much USCIS may consider spilling it to worst retrogressed countries.
3) The as&***s who decided to change the spill to vertical might get bitten by a mad donkey or a dog and might change it back to the old model. I don't see any &&)) why all the spill has to go vertically from 2007, bcoz we irritated USICS or DOS by kissing their weak spots.
4) As per my Karma or belief model whatever IV does, hurts EB3 more. I don't think any admin fix will fix the vertical spill or recapture.

Same for me too!!! i got second e-mail today also. I got another e-mail on july 14th with same content. My EAD expires in 15 days and i am on EAD. I don't know What the hell is going on. I e-filed on May 8th.

In the long run it will. The issue was that people could not afford to pay their healthcare insurance premiums. Those of us who are lucky to have high paying jobs and good employers can very look down on the folks that don't have healthcare. However, health care is now a human right declared by United Nations in Dec 1948. In the US, the largest developed nation, there are millions who cannot get healthcare (only emergency care). Even if this healthcare doesn't reduce it drastically in the short term, it will stem the rising costs eventually. That is the long term projection at least. Think about how much cheaper prescription drugs are in Canada when compared to the US.
I think that "what we are debating here is "what is better for the US". You and I can contribute to the SS and Medicare system that we are not allowed to draw from until we have greencards or become naturalized citizens. The illegals you mention are in the same boat. The point that I am making is that the anti-immigration lobby sees all immigrants in a single light. If we try to divide ourselves away from the low-skilled we are not going to get anywhere. Immigration in general touches a number issues - civil and human rights, economics, etc.. By trying to distance ourselves from any of these issues, we are in fact make it more difficult for ourselves. For the record, I do want a green card, I want a fair system. I don't believe in treating one person different from another because of their background or the kind of work they perform. (that's just to give some perspective regarding my views on the issue).
