If you read my any previous posts and to repeat, there will be no issue to contribute from me or most of us here. We need an action item. Anyone with minimum common knowledge here sees there is no change in dates for the last 6 months, or even last few years. You seem to be a strong supporter of contributions, can you list one action item which we planned to take up in the last or in near future that addresses our concerns of backlogs. Now dont come back and tell me or send me a picture of July 07 campaign or your 12th grade or 10th grade marksheet. We need to be doing things of our interest EVERY single day. I do my job very good.. I know.. but I have to keep doing it everyday if I have to keep it. Similarly unless you put continuous efforts, you wont get continuous results.
If you want a reply to your post from me again, come back with an action item that you see as planned.

If we have enough budget, we can hire good lobbying firm who can then guide us. Without any contributions, we can not even approach the lobbying firms for any help. The contributions that we make are not even enough for maintenance of this web site.
Why not you guide us? Hire a lobbying firm and inform every one here that it will cost this much and this is how you want to do?
I am not part of IV core. if all of us contribute big money, we can hire the best lobbying. We saw the last results.

The three days were packed with drama - Like any good drama, this too had it's moments of tension, action, and humor....the funniest one was:
Right before the rally when Aman was EXTREMELY busy, he actually had 30 seconds for each reporter. Our sweet little Jane walks up to him and asks "Aman where are my clothes?"
Aman had the funniest expression on his face :confused:
Here is the background : All of us had stayed in the same hotel and at the check out time we had kept out luggage in the baggage room. Aman had the tags of Jane's bags and Jane thought that Aman would get her luggage @ the rally!

Hi All,
MY LC (PD May 2003) is still stuck in DBEC. So I may or may not be able to file withing Aug17th.
My question is regarding the procedure used by USCIS to process AOS applications. It would be great if someone could explain this to me.
These are my questions:
1. Is the AOS application processed by RD or PD?
2. Once USCIS starts processing the I485, do they check PD at any stage, or is it just used as the initail "gate " for allowing I485 application submission?
3. Suppose Tom with a PD of July 2006 applied in July 2007. Then Harry's case gets approved by BEC in August 2007 and he applies in October 2007. Who will get the GC first?

let me try to answer your question the best I can. Answers in order:
For all purposes: lets assume 2 examples. Person A PD July 2006 and RD of July2, 2007 and Person B PD April 2006 and RD of July 2, 2007.
1. AOS is processed by a "combination" of RD and PD. As per the current Bulletin BOTH A and B can apply. The Service centres are currently processing September 2006 applications. When they reach July 2, 2007 processing dates, both applications will be picked up and then "thoeretically" they should ask for Visa number for A BEFORE asking a visa number for B as A has an earlier PD.
2. Answered in same question 1 above.
3. If Harry's case gets approved in August 2007 by BEC he WILL NOT be able to apply for I-485 as the July Bulleting is valid only for applicants VALID in july. Just beacuse they are accepting till AUg 17, does not mean people whose LC got approved between Aug 1-17 can apply, becuase they were technically NOT eligible to apply in July.

If you indicated in your I - 140 that you want to do CP, NVC watches for PDs and when someones PD is about to be current they sent out (packet 3) which is the application packet to start CP. They send this sometimes 6 months before your PD is current.
That is it, if you turn around the application packet soon they will start processing until they are done, and wait for visa number.
You can swich from AOS to CP, but I am not sure about the procedures. There is good information on Ron Gotcher's forum about the CP process.

I changed job early this yr and my new employer is working on labor for me right now. But from my previous employer I have PD of Aug 2005. If I get my labor cleared in a month, i should be allowed to apply for 140 and 485 since other fellows from 2007 pd were also able to apply recently.
Why should i suffer because of USCIS foolishness in Aug.......after having PD of 2005.............all similar cases lets raise our voice.

Hi All,
After a long wait i have my priority date became current. But my employer is saying to wait for some more time before he can file for I485.What can i do in this scenario? He is saying the dates are going to remian the same for next couple of months.Please suggest.

If you have I-140 approved copy with you, you can file by yourself.

Your wife should be good to stay with your change of employer upto the date mentioned in her current I-94.
I have been in your stage. I changed my employer last year. I asked same question to my attorney from my wife. Attorney said that there is no need to apply for another H4 because of mine change of the employer.
We went this year to india there was no issue to get the new visa stamped on our passport.
Note: I am not an attorney and sharing my experience with you. Please take a legal advice from attorney.

I guess it is not going to move any further.
There are more than enough applications waiting to be approved than the visa number available for ROW this year. It will move backwards to 2004 date in October when visa number for 2009 will be available.
Remember, PERM started in March of 2005, and there are floods of LCs with PD > March' 2005. It will take 2/3 years before it can move beyond 2005.
Does anyone can predict what will be the cut-off date for EB-3 ROW during the months July to September ? Will it proceed, stop moving or even it could be retrogressed ? what will be the OCT 2008 cut-off date ?

It is good to see the combined Immigration community efforts are bringing results. However, it appears that no attention is being paid to raise the issue of children ageing out because of visa retrogression and delay in labor clearance. The Child Status Protection Act(CSPA) passed in the year 2002 hardly provides any relief to I-140 based immigration petitions. While for I-130 (for US Citizens) applicants the date of child is frozen on the date of submission of I-130 form it-self, but for employment based immigrant applicants this Act provides a complicated way to calculate the child�s age and it just provides relief for any processing delays in 1-140 clearance only. It just ignores the fact that we have years of retrogression for employment-based category. At the time when this act was passed there was no retrogression in employment-based category and lawmakers perhaps never thought of hardship, which children and families may face because of the retrogression.
We need to raise our voice on this issue too. My son is going to miss out the chance of getting his green card just because his age works out as per formula given in CSPA Act to be 21 years and 12 days � because of 12 days my family may be penalized to be separated from our child whereas no one is going to consider 3 years delay in labor case in my case and then another 13 months we have to wait for filing 1485 after approval of I-140. Mine case was the most unfortunate in the sense that I got my I-140 approval in just 29 days whereas in all cases the normal time is 3-6 months. Had it taken 2 months, my son would have got the benefit under CSPA.
I hope some one from Immigration Voice leadership team will take a lead to highlight such issues also before the law makers.

I faced this situation a year and a half ago and transferred my son to an F1 student visa. As long as he is registered for 12 credit hours in college he gets to stay in the US. This is NOT a long term solution but there are few options available. We have to hope that somebody somewhere who can change things will finally see this as a problem and act on our behalf. I have contacted dozens of senators, congressmen etc etc and in all but two cases did not even get an acknowledgment.
