Thank you all for response and suggestions, my company and attorney is already in Process of filling 2nd PERM for EB2 with different postion, I talked with my attoreny yesterday and told him about possibility of AUDIT, he told me :not to worry about it: we have all of the docs and reason to apply 2nd PERM without withdrawing 1st Approved PERM for EB3. So he said nothing to loose from our side, if audited then matter of time.

The slowness in the approval rate has me a little worried. In July many people got approved at within the first few days - that does not seem to have happened for the first 3 days of August so far. I'm hoping that this is just a blip and the trend picks up shortly.

you may be right, there is much speculation on other threads that i have read that EB3 ROW, will be current by this summer, if not it will atleast show significant move. So i've got my fingers crossed

I've also read the other threads where they mention that EB3 ROW is very likely to be current by July. I feel CP is at a disadvantage because you cannot apply for EAD etc. You can only wait until your PD becomes current. That can be slightly frustrating !
But I guess you all know what I'm talking about.....:(

For once, I disagree with you macaca. If someone is not being paid, it is not considered valid employer-employee relationship. Otherwise, what is the need for showing pay stubs during the green card process?
Not being paid when on this so-called desk should be a violation of the intent of the H1B, and if there is a loophole that allows such a thing, it needs to be filled.

Okay for the record from my side (Vijay's side of the story). The GPS girl had a sweet voice and she wouldn't talk to me unless I made a wrong turn. Finally I loved listening to her "Recalculating" and I could go on, until Puneet and Sumita interrupted. :p I was in fact contemplating on giving flowers to the GPS girl if not for logiclife's sweet reminder that only he had the rights to be "flowery" :D
May be that is the reason he did not accept flowers from needhelp! Well the bottom line counts, we all had food after long drive on a supposedly short route.
On a side note, someone told me D.C is was very nice to see at night, so was trying my level best to make Pratik, Jay and Vandana enjoyed sight seeing enroute to the restaurant!:)

I'm in a similar situation and I want to ask you if DOL withdrawn your file from the backlog center if you had a PERM application approved.
Is it Ok to have one application pending in the Backlog center and a PERM Labor certification approved if the applications are for 2 different jobs?

Efiled on May 21st for myself and my wife. July 31st there are LUDs on 765 and 485s. but no approvals yet.
Guys pls let me know about the infopass status. Called the Customer service and they wanted me to go ahead apply for Interim EAD at the Local center by taking the Infopass. I believe they just read the instructions on the 765 application. My EAD expires on 17th

so i am curious why did you wait that long knowing that EB3 train is a goods train w/o engine. You r pretty close now to your GC, however if 3 yrs back or so you had ported it to EB2, you wud had been greened way back.
At that time, I was working for a multi billion dollar company where over a million people are employed. The HR department was not ready to serve any individual cases. Moreover the job prospectus were not great there at that time. It was always on the limbo. In fact, I did process another EB2 case in 2006. I got the I-140 Approval on that after the first one. And my employer's Immigration Department did not agree for a switch even after I pleaded to them. It was really hard luck. I spent over 18000.00 dollars to get that EB2 one which went down the drain. What to do? Its just fate.

No need to thank. Just show up in DC to community your GC problems to lawmakers. That is a big thank you to IV team in itself for all the time, money and energy we are going to spend organizing this event.
You will contribute for yourself. This advoacy day is for you and your own greencard. It is not a charity to IV. IV is you and me and we are only providing another avenue for each one of IV members to come to DC and tell lawmakers about the suffering they undergo during the greencard process.
I also have another suggestion. Why don't we also do a targeted campaign at partnering with corporate HRs to push for EB relief.

And whenever someone has done that and help was offered , we have known. The fact is HR of big companies do not know of any pain. Even if they know of any pain, they will not do anything about it unless their OWN employees tell them about it and ask them to help them by supporting IV. This is not happening and that is the problem. IV is you and me and everyone else on this forum. Not just pappu or core team. Each one of us working for big companies need to gather courage and approach the senior management. It is very easy to comment on the forum and provide big ideas and direction, but I have seen that when it comes to walking the talk very very few have the will or interest to carry out their own suggestion. IV was created precisely for this reason. People were lurking on various forums before IV and hiding behind anonymity. They were scared to do anything and could only hope to GOD , lawyers or whoever could help them. Everyone was throwing ideas at each other and not doing anything. The whole community was screwed and nobody was even willing to even go and talk to the media with their real name, go to DC and talk to lawmakers on their own money and vacation time. People would not even open up to their friends and talk to their friends about green card problems and do something together. This community had to stop living a life of tail between the legs and blaming their fate for their own problems. IV is a platform where you no longer have to complain. Each one of us on this forum has now enough awareness, has seen what we all are capable of doing together in advocacy so there is no reason to not approach our employers.
These corps rely on EB2 and EB3 folks for innovation and technology. Corporations have a lot of power in pushing legislation.

The fact is, each one of us is capable of carrying out our ideas if we have the will to do it. This will happen only if we are sincere about this effort and really want to do something about our own greencard. If we all think that simply coming to a forum and posting some ideas or arguing with others over spillovers or predictions is all they can do, then we are all wasting our time, energy and money. There are many other sites out there where you can track your applications to waste your time. Or post unlimited ideas for nobody to work on or just argue with other. None of the people benefit from such sites, except the owner of such sites that make lot of money from the internet traffic or publicity of their legal business or any other business services. The longer this community stays in this screwed state the more money these sites will continue to make. This ignorance of the community is sad and laughable to some extent. If you come to IV and give suggestion, better be serious about what you think and we will help you will all you need to lead your idea on this platform.

I applied for H1B and Change of Status in April 2007 and got approval for the same in August 2007.
I have to go to India so, I want to know Can I Travel outside US and re-enter on H4 visa (which is valid till 2009) before October 1st?(Before H1 becomes effective)
I am aware of the fact that you can not travel outside US while your application is pending. But in my case I have the approval. So is it possible?

You can come back to US on H4, but you may have to apply for change of status from h4 to h1 again, to be able to work in US.
