    Guys,
Thanks for the quick response, much appreciated. I think I have the answer to my question.
    Essentially:
    1. RD will determine sequence in which AOS are looked at by case officers at USCIS. So July applicants with 2006 PD will geat EAD/AP, etc sooner than October applicants with 2002 PD.
    2. In the event of retrogression (say to 2005), only those applications which have a current PD at the time of visa approval will get the green card. So 2002 PD will get GC before 2006 PD.

    I hope I understood correctly?

Since we now know that SA 187 had nothing to do with immigration and that it WAS indeed passed, the possible typo in this thread (about SA 187) title should be changed to something along the lines "Senate immigration amendment to H.R 2 NOT passed".

Besides we should whoheartedly explore with Kennedy, Kerry et al. if they game for pushing the immigration amendment (w/o the hard 10% country cap) in the house-senate conference.

If they are playing politics with the Sen Session illegal immigrant amendment (which passed!) we might as well use their tete-a-tete to our advantage ;)
BTW sen Sessions amendment also did not pass. It was just introduced, Th estatus of SA143(session's amendment) and SA180 is same.

On a related note, free riders may not be checking this forum. The title says that this is of no interest to them.

I agree, titles like "H4 to H1", "Changing Employers", "Urgent question" etc. etc. will obviously be visited more.
May be a gentle reminder about contributions in other topics would help.
How sad it is that we don't get support from our own.

First, I am not promising to solve anything. I am just saying that I will bring up the issues when I have my meeting. If this thread is a distraction, then feel free to ignore it.

Second, those who have participated in this forum over the past year know about the issues I was working on.

Third, the forum moderators have my contact information and I have corresponded directly with them (Aman Kapoor). If you don't believe I am who I say I am, feel free to contact the mods.

I am not sure what the point is about "innocent Indians." Does it really matter if I am Canadian? Is this forum restricted to South Asians?

    Totoro,
Thanks for responding., we appreciate it.
Good that you took it in the right spirit. All the efforts you are trying for us are inline with what even I wanted to do, but dont have as much access as you do. Search the forums with my id and you will see for yourself. To my knowledge there are very few who can do what you are doing. I wish Moderators and IV Core endorse your efforts in the form of a campaign and you will see much more participation. Look at the other drive they are doing for create a fund of $10000.00 If they endorse you (thats we) will get response in that order. Can you please ask Aman to do that, and that way we will have more voice.

    All,
I am not sure if most of you guys even remember what my group said. We WILL contribute even $3500 and more, if there is a campaign for EB2 and EB3 and for guys waiting 5-10 years . Not sure why most of you, even senior guys(by join date, and not by # of posts) just rememer the $3500 part all the time with my name :) but miss what we said. Go n read it again. And if Core endorses does effort, I will not be surprised if there will be contribution from as much as 5000 members each of $100 on avg= $500,000. No kidding, thats the pain EB3 is facing.. Anyone to disagree??.

    Gangutelli,
Gantuteli is real or fake.. similarly. Did you put all your details EXACTLY.. You know the answer.. Be little practical and have some profile that is like yours atleast.
Where were you before Jan 09..Didnt hear about IV before??.Flower campaign that hit the news.. You appear to be very emotional, with very less maturity.. Nothing personal, anyone here sees it.. check them yourself with a mature friend.I know you will post 1000 posts in the next 1 month. Tell me the secret how you get that much time(I am begging for few extra hrs in last 1 month), but only in case you have a job. Else we know.
And I said I will contribute $50 to FOIA campaign last week but did not send it yet. I will do it today. This is not in response to you Q reg contribution.. If you noticed, no one responds to your posts.
Did you create any new thread with some ideas, good or bad... Please respond to this last line, for sure..and if so, can you give me that link..

I knw how it feels. BTW after how many days of raising an SR did u get this email? I'm thinking of raising an SR as well...

90 days is a lonnng time. I donno how it works if ur case dozn't get picked up in the next 50 odd days and the dates go back in Oct. Good luck anywayz...I'm sure thgs will work out.

    Hi,

My 485 petition is with NSC. I opened an SR last month and got a rather uninformative response today. It does not tell me if my petition has been pre-approved or has even cleared the background check.

    "
The status of this service request is: Your file is currently with the adjudications department, waiting on the availability of an officer to be assigned your pending case. Please allow at least another 90 days to hear something further on your application.

not a bad idea. Only that those who came here on an F-1 will need to get an F4 (something like a dual-intent work visa) after graduation. those of us who came here on F-1 and worked hard for GREs and through grad school did it only because we wanted to settle down here.

See, if you had immigrant intent, the F1 should have been denied. There should be no dual intent for any work visa whether F4 or H1 or L1, period. If the worker is supposed to be in a permanent job, only option should be to get a green card. The current system has encouraged a bad habit of pretending that permanent workers are really temporary workers who would eventually go back.

    Hi

My wife have H1B approved in 2005.Her stamping was refused on 226(g) section. She came to u.s.a on H4.Now her employer has applied for premium H4 to H1 transfer for her.

We didnot hear anything from them.It is already 2 weeks.

If it goes through.Does she need to go back for stamping to start working.

    How the things will be?

How long the process will take (transfer)

If the attorney can help me in this,it is really great and appreicable
    thanks

Has anyone tried expedite requests .

1)If so , did the expedite requests via fax help?
2)The NCSC do not give us any fax number?
3)What would be the reason we can specify for expedite requests?

MY PD is also July 26 2007.
I live in Texas as well.
My case is filed in Chicago based on my employer state which is MO.
If your employer is in Texas your case would have been filed in Chicago.
It is taking longer than 2 months to get approvals.
Hopefully we will get approved soon and get the hard copy before August 17th to file the I-140 and I-485 together.
    Good Luck

This is what I call "tailoring message to our own needs". Lets take your example and I will do the same for you.
USCIS certainly has a report by RD and lets say they are providing that report to the congress or the Senate. What would you see in the report ? There will be applications backlogged for years especially EB3 I. Just in my case, the 485 has been pending for more than 6 years. Anyone who wants to look in to the performance of an organization would want to know how well they are doing and USCIS has to show that they have applications backlogged for more than 6 years and cannot process them because of the unavailability of the visa numbers. Would that look good on them ?

All big companies use both EB2 and EB3. We cannot justify one over the other with-out understanding the data. Again as far my understanding goes, I believe Bill Gates is a big proponent of H1Bs than getting his employees permanent residency.

This is my take on spill over interpretation and please dont feel bad if you do not like it. Lets take it this way assume we have 40K extra visa # from EB1 and ROW categories that need to be spilled over to ICPM countries. Now you have two options
    1) Spill it by PD. Which helps EB3 (I)
    2) Spill it by category which helps EB2 (I) & EB2(C)

If you look at numbers EB3 I # are huge so inspite of pumping 40K into it the numbers barely inch forward. We have seen this all the way till 2007. Where as in just 2 years of spillover EB2 I has moved into 2005 with prediction of becoming current in 2-3 years.

Now if I was USCIS director and going to Senate hearing. What would I like to tell them that I have used all visa # and EB2 & EB3 are severly backlogged. Or should I say I used up all visa # and now EB1 & Eb2 are current and we have backlogs in only Eb3 category.

Just that I feel USCIS can claim more bang for buck when they spill in EB2. (just my theory not justyfying it). Also I feel Eb2 is used by large US corporations for its H1 employees especially STEM graduates working. Example Intel, Texas Instruments, Microsoft etc also large financial companies especially for employees on business side (not IT employees). There is pressure from these companies since they do not want to lose some one with business knowledge because of immigrations rules. Just look at how many times Bill Gates has shown up on Senate floor to pitch for EB immigration reform. If you make EB2 current you can shut him up since most Micro Soft employees are under Eb2 category. That way you are effectively muting the critisism againt you on senate floor.

This way USCIS can also keep these people happy since they can claim that EB2 which translates as Exceptional Ability and Advanced Degrees are now close to current. The only catch is consulting companies and outsourcing companies have sneaked large number of people into Eb2 and they have become lucky.
