Sorry to hear about your husband susie. Inspite of your grief, you have the courage to take up this issue which will benefit a lot of people. My son aged out before my labor was approved. I filed for labor in april 2001. It was approved in 2007. My I-140 was approved under PERM and I filed for I/485 in May 2007. My son aged out in August 2006 Thanks

The question is how can we get the legislator to write and introduce such a bill and then how to get it to pass. Who will support such a bill? Your desire is similar to everybody else in this group but until there is a definite strategy which is different from what has already been tried there is no point in just creating discussions foccussed on desires.

If this kind of restriction is not done what will be best way to resolve H1b issue? If H1b increase is done and similar increase is not done on GC then also problem to all IV members(retrogession will continue). If there is cap then certainly it will be reached every year within April.

This really is height of optimism......it seems that readers think that USCIS IOs were desperately waiting for dates to get current and start approving applications...reality is they don't care and never cared..they may start issuing more RFEs if anything...Again stay rooted to ground and don;t start floating in the clouds....especially with USCIS's fantastic track record.....

I would trash the PR, i mean let it expire and you be on your way. Cdn PR doesnt gives much benefits unless you want to settle in Canada/ work there.

Coming to DC will be a memory most of us will cherish... and for a really long time...
Whether it was working late or eating dinner at 3 am or running to meetings, it was an enriching experience for all IV members. And it makes us proud that we stood up & made our presence felt & voices heard...
We all knew each other by IV handles... but meeting in DC put names & faces to those handles...
Meeting each & everyone was amazing and even more satisfying was that people came from different states & with families & kids...
A li'l disappointed with the locals who didn't turn up though.... and more so with those who walked on the other side of the road from all of us....

You should have only one I485 application pending at a given time. If you file a second application your lawyer would advise you to withdraw the first one.
Personally, I prefer an AOS to consular processing since I am in a stable job and of course my spouse would need EAD.
So the answer to your question is that you do what is best given your situation.
Also, since dependants are currently counted in the 140,000 available EB visa, it does not matter if you use one or both of your approved 140.

I got my original passport renewed at Houston. Here are my details.
Original Passport expiring on Feb 05/2011. Sent the completed application form with all the required documentation to Houston on June 17th. Received new passport on Jul 07/2010.
Prompt service in less than 3 weeks. Last week I emailed them requesting the status of my application and never got a reply. Tried to reach them on the phone, but no one answered. Was getting little concerned as I have an upcoming trip by end of this month. Got the fedex this afternoon. Very good service.

I have a question as follows. I was with an old company and transferred the H1 in the 9th year to the new company. I already had my Labor and I-140 approved with the old company (EB3-I Category).
After switching to this new company I had to start my PERM all over again as I missed the July 2007 boat and could not file for I-485. My new company is based in L.A.-California. I am already drawing my salary from new company. They only have office in L.A. I work for them from my home office in NJ. Today the company's attorney called & asked me that I needed to have L.A. residential address as it is required to be stated on the application. I have no intentions to move to L.A. in near future. I am in a fix now as to how to go about this. I will appreciate all you gurus and experts advice and also please advise me repercussions if any.
