I tend to agree.... nowhere in the past discussions IV seem to have cared about EB3s. It is more frustrating to see this situation sincce Eb3's have been suffering for longer with no hopes what so ever.
And anyone trying to implicate that EB3s are less skilled are plain wrong - we got in EB3 limbo due to large corporations doing things by book (or for plain long term commitment out of workers).
Either way, IV leadership needs to re-iterate and re-emphasize at least once that this is not EB2 fight only but EB fight in general. IV discussions simply have gone EB2 biased only for too long.

I think you should consider accepting stories of those you have yet to start their GC process. This gives another perspective, to tell people that even those who are highly qualified and experienced are in two minds whether to file for GC or not. Why this thought? this is because the delays and long wait acts as a deterent. End of the day, if these people are already frustrated at the onset, then they may decide to leave US and seek opportunities elsewhere, leading to loss of such valuable talent to the US. This was explicitly highlighted in yesterday's Judiciary Committee presentations by the four Economists.
While accepting stories from those waiting for GC, please also accept stories from those who are apprehensive of filing due to the delays, hence conveying a reason that US risks losing highly skilled workers should these circumstances continue.

We might have a reporter tomorrow who wants to cover IV but only those folks who are not even starting their process and wary of the wait.
So please do not misconstrue me. Send in your stories. It does not matter if you are just a student looking forward to immigrate, someone like Waitnwatch who is collecting documents to start the process, someone retrogressed, in the back logs or even just on the verge of getting approval. We need all the stories.
When we go to Senators, if we present a spectrum of stories like this, it will have the most impact.

This thread brings up a good point - of labor reuse & misuse in yester-years.
Incidentally there are many who have never seen a glimpse of what is inside their labor certification as the employer & their lawyer still refuses to share it with the candidate. And i am not talking of the oft-bashed consulting companies.
For the candidate - who continues to pursue the American dream, it is:
1) Not Transparent
2) Subjugation to the whim of Employer / Lawyer
3) Non compliant to a common code implying a non level field of play
Thereby Unfair.
In my humble opinion - should be part of the core argument we have against the system.

I was just thinking and then this came up on me . How about sending a poster along with the letter campaign. I can contribute atleast three posters. They do not have to be full size posters ..can be just A4 size pamphlets kinds. We can just print them in color printer and send them along with the letters. These posters may make it to the press also as they will be funny and spicy for news. Actually, we can send copy of our letters to press as well along with our posters. If we make about 10 such posters, we can send one random poster along with the letter.

F1 is not a scam. its legal visa. once u enter into usa on F1, u can stay here to study. while doing MS, u can also work on CPT legally. after completion of the MS degree, it is legal to stay on OPT and work. recently the US govt has increased the OPT period from 12 to 29 months. again its legal. its legal to apply for H1B while maintaining a proper F1 status or OPT.
People who dont like this.... dont either because they dont understand F1 very well, or just plainly speaking jealous or out of their mind.
i guess we should be happy if someone is making progress legally even if we are not in the same boat.:)

Why does it have to be only STEM graduates which will not need employer sponsership. If giving GC based on completion of MS in us is bypassing the employee sponserhsip then that has to be extended to all EB categories of immigrants (EB1/EB2/EB3) and the benefit o those visas have to be passed to the badly retrogressed category first.
It si not teh question of liek or unliking or having jealousy. It is the question of law. According to the US law employee sponsership is EB category so any new bill which has to be introduced will have to follow the EB category employee sponsership rule, othwer wise it wil not see the light of the day

Yes...I am aware of the facts that you mention...but now that data entry is made since long, the ND has no value.
Last year when the EB2 PD's were current for 28 days in August, only those RD's whose data was entered in TSC had chance of getting GC's. In other words, receipts are now generated for all '07 fiasco filers and hence the ND has no value!
That said if a Service Center rep says about the ND replacing the RD in their system, then it is time for corrective action. With these small windows of PD being current, why take chances!

It was only in July/Aug 07 when due to high volumes many cases (including mine) waited for data entry for months, as no center wanted to accept that additional responsbility. Those whose cases were entered in July/Aug 07, became ahead of those whose cases were entered in Sept and Oct 07, no matter when they filed or what their RD (as on the receipt). People with PD in 2005 and 2006 who got GC last year were those lucky ones who cases were entered in the system in July, Aug (and may be some in Sept) 07.

As many are aware, there was a huge rush to buy and sell pre-approved labors during July-August 2007, when all the priority dates were suddenly made current. Tens of thousands of labors were sold by fraudulent consulting companies to many questionable GC seekers, who hadn�t even started the process till then.
It is those substituted labors which are clogging the pipelines now. Just think, last month EB3-I stood at November 2001. Now it is completely unavailable. It can�t possibly be because so many pending labors with such old priority dates suddenly got cleared this month, and beneficiary of these labors filed 140+485 together. I seriously doubt that a candidate whose labor is pending since such a long time is even keeping that GC process alive. In all likelihood he/she must have moved on in life.
There is only one explanation. These labors were already pre-approved. It is the attached I-140 on these labors that are getting approved rapidly. And the subsequent I-485 petitions on these applications are depleting the visa numbers.
The reason of this post is not to start an argument about the ethics of labor substitution. It is just a FYI post to explain the seemingly inexplicable. The chickens are coming home to roost.

For some reason this does not sound right. If there was spillover of 20000+ visas (of course, this was an assumption), have we seen that many approvals? To me the approvals seemed normal, not much.

DOS allocates visa numbers for each month, for consulates across the world and USCIS here to adjudicate 485s. They provide these agencies with the priority dates for approval + a limit. This could have been used up for the month of AUGUST.
The spill over from FAMILY CATEGORY can only be used starting from SEPTEMBER 01 2008. Otherwise it won't go with the interpretation of the law.
Also the spillover from EB1 (for august 2008 and anything remaining for the current year) will be applied on September 01.
So, what this means is: The numbers available as per the visa bulletin for AUGUST is over. Does not mean, it's over altogether.
