I agree with all your options, but have to add one one more option.
Option 4: Get DOS to do the spill over allocation on a quarterly basis.
Lets not get sidetracked by Mr Skillz with a Z.
Options for EB3I relief:
Option 1: CIR - This is not in the picture right now. Nobody knows when this is going to happen and I think we should not even bother to look upon this as a short term measure.
Option 2:Recapture of visas - Again this has to go through the legislative process. With the current political climate, it is going to take a tough task to get this one in as well.
Option 3:Re-intepreting and changing the spill over rule: This can be done without any legislative changes and USCIS can be asked to look on this if we can really force them to.
Steps to execute Option 3:
* Collect and consolidate all the data in a spreadsheet from the latest 485 inventory to the yearly reports of adjudicated cases
* Create a what if analysis for the next 3-5 years for EB2 I and EB3 I
* Create analysis to show what will happen with the old rule and changed interpretation of spill over
* Create a nice presentation
* Contact Senators, congressmen, USCIS and walk them through our presentation
Hopefully that can change their mind or atleast we gave our best shot.
Add your thoughts and inputs and let us create a plan on executing this, if folks want to do it.

Grass-roots advocacy means advocacy at ground level
Glad you finally realized it.
case in point PAPPU the admin who is the only admin i see on the forum since he is eb3
Yes, and pappu actually works actively for IV provisions and guides us, instead of complaining and making senseless NOISE like you are.
i would classify you as a idT iot if you have NOT realised that from my first post that all i have talking about is "more should be done for EB3" and not "no one is doing anything for EB3". If you have not realised that you are an a person who is blinded by your own Stupidness.
I thought you did not believe in name-calling. Looks like you change your opinions and stance as per your convenience and frustrations.
EB2 consider themselves superior to EB3
This is an empty claim created by you alone due to your paranoia. Its all inside your head. Again.. empty vessels make lot of noise.
You dont have to wish EB3 folks good luck because we make our own luck (God when i see your bigoted ass get a gc we will well rid of you
Very mature, my friend. Hope you get the good sense to stop abusing folks here and actually doing some good for the overall EB cause. Stop spreading these conspiracy theories and fears..we all have enough on our hands already. You DO NOT represent EB3 here. You are just a frustrated and embarassed person trying to hide behind your username and venting out against some hypothetical problem you have created in your head. Please get some help.
And spare us another 1000 word essay. I think we have heard enough. Find another place to get some therapy.
Grass-roots advocacy means advocacy at ground level.
Ground level in political terms means opinion of actual worker who is doing the work and in this case it would be all the people who are actually doing the work of meeting meeting law makers and to explain retrogresssion to them. That would be the donors and people like you who have our respect. For a grass root level advocacy to work an organization has to be made up of grass root worker. Grass root workers are the people at the bottom of totem pole. In our case that would be EB3 workers now we all know that EB2 workers when they get their green card dissapear from the forum and leaves the EB3 guys to carry the burden (case in point PAPPU the admin who is the only admin i see on the forum since he is eb3) . So finally we are left to handle the IV Movement movind forward. Now if i was an organizer of a movement i would make sure that all the points made by the organisation is directed towards allaying the concern of people who have been impacted most by retrogration (BTW that would be Eb3 guys and not EB23 who by their god given right have first preference over everything and wil get residency soon because they are a preffered catefgory).
i would classify you as a idT iot if you have NOT realised that from my first post that all i have talking about is "more should be done for EB3" and not "no one is doing anything for EB3". If you have not realised that you are an a person who is blinded by your own Stupidness.

EB3 workers understand advocacy (Please do NOT think we are people who have to be lead by someone who thinks they are intellectually superior(yes i am talking about EBS persons). You are the same as us so this EB2 and EBS classification is redumbent and moot)
yes this discussion has been entertaining because it has lead to a revelation that EB2 consider themselves superior to EB3 and you do not get to say when this discussison ends because you are short time oppurtunist and your word has not value
Even a coolie knows that after working harde whole day he will be paid at the end of the day but EB3 folks will not
get that satisfaction till all EB2 get their green cards
You dont have to wish EB3 folks good luck because we make our own luck (God when i see your bigoted ass get a gc we will well rid of you)

Naa.. Lots of people including me never received CPO email. For such instances, CPO email will take a while (may be an issue with expired Biometrics..etc). The wait continues for some more time to see the actual cards in the mail. There is a dedicated thread on this issue on .
There is no consistency with USCIS' process (or at least none that we can infer). For me and my wife, we only received the CPO emails. We haven't received any emails or updates that they have sent us a notice about registering us an Perm Residents...

I may be wrong, but I had different impression. If officer felt that GC can be given in one year they issued 1 year EAD, other wise 2 years EAD. When I got 2 years EAD, I was not happy about it.
But several things go wrong and people might not have got GC despite getting 1 year EAD. I feel that people getting 1 year EAD must have every thing ready, just waiting for their Visa Number.
Dhundhun, You are right..... it was meant to be like that. But, eventually, it's all at the whim of person handling ---OR how else, we can explain: One spouse getting for 2-yr duration n other for 1- yr. This happened to me.... The fact is we can not question their action.

Its great that someone is actively looking into this, but will the whole 'security' issue backfire if USCIS decides it would rather waste the visa numbers than getting into this kind of mess in the future by processing everything swiftly?
Just a thought
I agree, i am afried that this is going to back fire and would let USCIS waste visa numbers and we all can continue our wait ever after. Nice job

So you will be on H1 till conclusion. Best Luck.
Yes, I dont really see that as a problem right away (though I am aware of the risks!). I have completed only 4 years of my H1B and with approved I140, I should be able to extend another 3 years, (if required).
BharatPremi, do you know if one can have both 485 and CP processes simultaneously?
I am just wondering if I could file 485 (if my PD becomes current and stays current only for a short period as it happened in July) and have my CP case also alive.
My CP case is already in Consulate (after processing Form 230) which means I am just awaiting an interview. 485 is to safeguard my GC against any unforeseen odds and risks. Is that possible?
Or, can I file another LC (under EB2) and once I140 is approved (using prior PD), can I interfile (in CP)?
I just wanted to have the safety net that 485 provides or move to EB2 so that interview can be expected in the next year or so -if my new I140 is approved by then!
Any recommendations and is this technically possible?

Hi,
I first applied Green card through the EB3 process and my priority date is March 2003.
Since there is very little progress in EB3 category, i convinced my company to re apply in the EB2 category as i got promoted (Salary increased) so that i can keep my old priority date. They re applied in the EB2 category and i crossed the recruitment stage and waiting for the PERM to get approved. (applied 3 weeks back).
Now i am current in EB3. Now, i am not sure whether i can go forward and file for I-485 under EB3 or wait for my new PERM spproval and apply for i-485 under the new EB2 category.
Please advice.
Thanks
Prasad

Hahahaha... that's my ironic laafter!
Every one got a nice GPL again this month - yet no one really wants to do anything... why?
Because "Chal raha hai to chalne do" ... the usual Desi mentality...
All this sounds crude - but its true. Truth is almost always bitter... like the VB every month!
I just donated to IV ... gimme REDs if you want, I care the least ... all I really care about is the GREEN (card)...
Good luck fellowmen, we are all together in this boat - all we need is a mass awakening for the lawmakers to our state of being!
Thank you. The community needs to wake up. Times are going to be tough not just for H1B but for everyone else in line for GC.
Advocacy is a long term process that requires lot of efforts and resources. We should not be expecting quick results because of one month's contribution. That is peanuts when you compare it with the amount being spent against us.
It is high time people join the state chapters and try to lead them if your state chapter is dormant or inactive. Action items will happen but we need to be ready. Try to get more people in IV. The mantra for success will be mass participation in the coming times. It should not be a couple of hundred phone calls or faxes that happened last year, but hundreds of thousands of calls, faxes and thousands of meetings.
If we can achieve that then we will definitely increase chances of success significantly this year.
This community needs to think how it can increase mass participation on IV and bring everyone waiting in line on IV platform.

Since this topic is already being discussed....
I live in Illinois and have to renew my passport at Chicago consulate. My original passport was issued for 5 years only so as per the website, I need to file for "Renewal of short validity passport".
http://chicago.indianconsulate.com/Passpins.html#Renewal__of_Short_Validity_Passport_
But when I click on the link (under download form) itt actually open the "Misc service" form. http://chicago.indianconsulate.com/pdfforms050703.htm
Does anyone know which form to use?
Thanks

Now, I see this trend - needhelp, tamsen and so many girls giving flowers to logiclife ............. and logiclife not accepting them .......
I think the issue here is, logiclife is flooded with these requests and has retrogressed accepting flowers - he will be announcing priority dates soon - and probably per country limits also. So please keep cjecking the special bulletin logiclife will release every month :)

If you are saying that EB3 would move from 2001 to 2004 this year, then that is what BharatPremi and I were saying. We should be OK with 3 years movement for EB3.
And, guys don't jump on me, if we accept that 3-4 years for GC is acceptable (though I agree that GC in 6 months would be the vision, dream...), then guys who have filed in 2004 should be patient till 2008 and guys who filed in 2006 should wait till 2010.
The only guys who should worry is those with PDs 2001 and 2002. Again, most of them got cleared in Jun, July this year except those who are stuck in name check and LC in BEC.
Well, I was saying "at least". So if goes for 2 years to clear pre-PERM backlogs, I would not be surprised. ;)

My passport is going to expire on 13th Sept, 2011. Any idea if I can renew my passport now, or do I have to wait till september,2010?
Thanks in advance.
Better to renew right away. You can renew up to 6 months before expire date.
