    Definitely agree with herd mentality and haste, but can't blame them also. What if the dates go back again next month. So its a catch-22.

    If dates went back and someone did not get Green card it is because they called every day and spammed the system. Or someone else called every day and now everyone else has to wait because of someone's foolishness. Now they all need to wait for next year. Nothing wrong in it. At least people will learn a lesson of collective responsibility instead of acting selfishly.

    American system works in such a way that, if one does not remain in home loan, he/she is a big looser. On 30 years loan, one should take equity out of home between 12-15 years, so that again home is 70-80% financed. The equity money taken can be invested in stock for maximizing gains.

    Usually a home is put to remains in 70-80 % loan for maximum tax benefit - most of the homes are like that. So when stock goes down and home prices go down by 20%, most of the houses come underwater.

    The moment a home comes underwater or nearing it, refinancing is not possible.

    Further, you buy a home or a car, it is owned by bank. In fact, when I bought a new car on paying 100% to big Toyata Dealer, still the car was put on loan with banker.     Things are different here. I was under tremendous pressure from friends to buy instead of renting. In last posting I provided info. that I did buying this month. My home buying In the buying process, I got: some money from builder towards closing cost, some money from agent. I'll get tax credit from fed. Also banker provided one year free borrower protection, which I can terminate before payment starts. So effectively system (business process) in US provided a total $17,000 while buying. People form India must be knowing - it is reverse over there. Here due to borrower protection i have protection of $25,000. So while buying, things are not that bad. if I add $17,000 with borrower protection of $25,000 (in case of problem), it turns out to be $40,000 odd. This is what I mean by system or business process providing support for buying. After putting all money in home, this $40,000 is still there.

    Not having GC/Citizenship is a real hinderance, because one is fully part of US system as long as he/she is working. The moment job or status is gone, he/she is not part of system is US (becomes illegal). Buying is in this context a very high risk activity specially because trends are downward - there is no time to react.

    Yes, the dream shall never die. We all know that we will get our GCs eventually. But sooner will be so different from later. There will be no point if we get our GCs 10 year later. How many 10 years do we still have? Can we imagine our lives without this GCs for another 10 years? Not even 5 years!

    Thanks dilbert_cal. I too am not sure if this is needed. I will definitely consult a lawyer and seek his opinion. Yeah, I agree, any other day would have given me lot more answers, but again, I am happy that today brought smiles to many of those fortunate souls.

    Why is Atlanta processing PERM applications so slowly versus Chicago? Is this always the case? Do they always process at such a slow pace? It is really frustrating when people filing their labor from Chicago are getting approvals in not more than a month people from Atlanta are waiting for 3-4-5 months and even longer. What is wrong?

    Alright guys, I cannot tell you how excited I am to report that i got a call this morning from my attorney and my online case status also states that Card Production was ordered for my case!!!

    After 8 long years.....i finally have been approved for permanent residency. After 7 years, i will finally, with peace of mind, go back to India to visit my family. Thanks to IV, everyone's help on these forums for helping me keep my sanity over the past 2 years....

    After 15 years in the US, I will finally have my green card in hand soon.

    Today I have contacted Ron Gotcher and here is his response.

    1. Begin by contacting the office of the Inspector General of the Department of Labor. That office is supposed to ferret out mismanagement and misconduct within the agency. With cases pending as long as they have been pending, something is clearly wrong.

    2. If you get no response from the IG's office, next prepare a formal letter to the Secretary of Labor, asking for assistance.

    3. If that doesn't work (though it should), next contact the chairs of the House and Senate immigration sub-committees and file formal complaints, requesting their help. If you include a large number of victims, this should impress them enough to contact the agency to find out what's going on and get it resolved.

    And also Ron Gotcher ready to help us.


    So please guys post your inputs and what can be done futher. Its a collective effort and have to help outselves. Here is the action plan.

    1. Rather than every one sending separate letter, let us send only one letter and every one signed that.

    2. Let us create one yahoo group, send all your infomation, Name and adress.

    3. Draft a letter to OIG, attach all our information.

    4. Based on the response let us decide our next move.

    Your comments and inputs are more than welcome..

    This is a good idea.

    I read that there are 2800 EB3-I visas a year, or about 233 visas per month. Assuming there are about 700 numbers available for the rest of the year 2010, using the data in the latest May-2010 I485 inventory, the calculation is pretty straight n easy with no spillover calculations involved ... here is a possible progress of the PD:

    Sep-2010 : 10-Dec-2001

    Sep-2011 : 31-May-2002

    Sep-2012 : 15-Sep-2002

    Sep-2013 : 01-Jan-2003

    Sep-2014 : 01-Apr-2003

    From there on the numbers are huge per month - about thousand pending 485 per month ... it'll continue at less than snail pace :D

    Total Move in EB3 from Aug 28th 2009 to May 27th 2010.... is just 3,400...out of that

    Total 2,265 from 2003 to 2007 that means those are Eb3->EB2/some other category moves...not the actual Approvals.

    so looklike from Aug 28th 2009 to May 27th 2010...in EB3 we are having only around 1,140 aprovals....which is very very less, compared to 8,200+ approvals in EB2....

    I'm not saying anything for the EB2 people...I'm saying EB3 is not moving compare to EB2.

    Looking at the above table....I'm windering why we are not getting many approvals for EB3 as compared to EB2???

    I can Understand why EB3 is in 2001 and EB2 in 2006... but we should get atleast same number of approvals right????

    In that very less decrease in EB3 numbers, most of them are because of EB3->EB2 move,,,,,,

    If this is the case, then Whencan i expect GC with EB3.... I may stop thinking about GC in near future.

    Everybody, please calm down. I don't know what the intention of this thread was, but if it is to increase the participation to achieve IV's goals, then I am sure you all realize it is having the exact opposite affect. The only thing happening on this thread is donors and non-donors going at each other in a way of unbecoming of us professionals.

    I am sure we can agree to disagree with respect. Think about some of the messages written and you wonder would it be really said if they were facing the person.

    I personally don't think bitzbyte is or was berating IV's efforts. All he/she needs is more convincing. And I don't think he/she is alone. If that was the case then we would be having 49000 members donating and the advocacy effort would be a grand success and we would be having millions for lobbying. The fact is that there are more like bitzbyte than the donors. I am not sure where the problem is but there sure is. Heck, I am donor and I don't find myself talking about IV or hearing about IV from colleagues or friends. Everybody has their priorities set and the daily grind to go through. Getting a GC may not be everyone's ultimate goal. There was a time I used to be so obsessed with GC that my whole life seemed to be revolving around bulletins and the disappointment of backlogs. One day I said enough is enough and stopped worrying about it.
    But I realized that the question is not about whether and when I get GC, but is it fair, to you and your family, to go through years of this agony. It is not fair and we have to do something about it.

    As much as everybody needs IV to address their needs, IV needs them to achieve our collective goals. Lets think about ways to increase participation rather than marginalizing those that don't yet believe.

    1. You have stopped worrying because you got your EAD at least.

    2. USCIS is not asking to prove relationship with your great grandparents every time you go for H1B extension

    3. You don’t need to worry about the VO at POE or consulate and not postponing your India trip for 3-4 years now.

    4. Even though you are on project and pay roll is running, paying the tax...don’t lose your sleep over what memo comes next before the next H1B extension.

    Our people are not worrying until it strikes them. Till then they will ask all sorts of questions and have attitude of why should I donate. You can see now and then a thread on IV - Help urgent, I-485 denied, H4- denied.

    Why its urgent now for them...?

    Is there any thing we can do to save IV forums, from all these so called smart people.

    Simly these guys want to derail the whole discussion either it is EB3 push or visa capture or any kind of fruitful discussion.

    I know it is difficult to stop creating and screening ids, atleast can you delete some unrelated postings and make sure that there is some healthy discussion continues and people like me wont stop visiting IV.

    We need to underscore this point over and over again with a sense of urgency. Having to wait ~5-10 years for permanent residence **just because of country of birth**, a discrimination practiced only against Indians and Chinese (well, I know it's country quotas and each country has one, but it only impacts Indians and Chinese) is nothing but a grave human rights abuse.

    As the President has said many times over, "the time is now". This needs to be fixed.

    Thank you Totoro. People like you keeps the hope alive in our heart that someday justice will be done.
    So far all the arguments and suggestions were really good. But Totoro seems to be looking for compelling stories. There are very depressing cases where people had to restart their GC process for no fault of their own. And some people have been here for more than 10 years still rotting in the queue hoping to get a GC and move on with their dreams to become a Citizen of this country.
    However the collective compelling story is what Eternal Hope has expressed. This is exactly the situation for people from India/China.
    Sure anchor babies is not a great argument for illegals cause it promotes illegal immigration. (In fact I heard in some countries Citizenship by birth only works if the parents are legals. But thats a different story.).
    Let us say because of the reasons listed by Eternal Hope we are forced to go back to our home countries.
    Firstly, How fair will that be for our children who are Legit Citizens of US.
    These innocent kids know only US as their home. Just as much as any other US Citizen. Most of the kids can only speak english. They can barely understand their mother tongue. Point is they are just as American as any American kid.
    If they are forced to go to a foreign country, far from their friends and familiar surroundings. Had the change been for the better, still they would feel they were wronged. My guess is they will hold a grudge against us, their parents, and their own country.
    This to me is compelling reason, specially since I am a Democrat (sorry can't vote yet).
    BTW, my moral support has always with Obama, and with Zoe Loefgren.
    Many of us cried when Obama read his oath. That was the defining moment for all people who have been subjected to injustice, been told that they were not good enough because of their race or country of origin. Think about it... The Chinese and Indians having to wait so many years just to get a GC is injustice being done to a people of certain origin. Oh well!

    I read it and seems to be complex to understand.

    My I-140 was applied in Mar 2005, when my son was 20. PD became current in Jul 2007 and I-485 was filed. I-140 was approved in Oct 2007.

    I have a question: Earlier, it was not possible for me to file I-485 for my son. Under new provision, is it possible?

    You are right that there is no hope for EB3 India. But only as long as you and others in EB3 do not meet their lawmakers. Take part actively in action items. We have details of every local town hall meeting in your area and you can go there. We can help you set up your meeting with your lawmaker in his office. We can help you meet in their DC office if you want to get really active. We have several more details and ideas and need people to work on them.

    FYI we never use the terms like EB2 or EB3 in our meetings with lawmakers. There is no priority in our agenda based on category or nationality. ImmigrationVoice.org - About Immigration Voice (http://immigrationvoice.org/index.php?option=com_content&task=view&id=5&Itemid=47) You will not find anywhere EB2 or EB3 based agenda here.

    Well Pappu, the fact of the matter is nothing has been done specifically to help EB3-I/C/ROW. IV may be EB agnostic but EB3-I seems to have been stuck forever to the point of despair.

    I and other EB3s have donated to most of the IV causes and campaigns. We have written to our Senators, reps, sponsors and co-sponsors of bills but nothing has helped.

    If IV renews its focus to help EB3-I/C/ROW then you can expect more contributiuons from EB3s.

    I do not want a lesson on EB3/EB2/EB1...there is no end to opinions on this forum. What I and other EB3-I/C/ROW want are results. Contributions, meeting the lawmakers, writing to politicians etc will kick in fourth gear if there is a reasonable advancement of dates for EB3-I/C/ROW.

    BTW, your and other IV leaders' efforts are very much appreciated. All that I am saying is that IV should be focused on EB3-I/C/ROW (through tagging recapture to a bill or something) now that EB2 is getting help from USCIS spillover.

    Did Address Change work for anyone after I-485 is filed and state to state move?

    my lawyer/para-legal said it is bit risky but possible.

    Any feedback and thoughts?

    Great Job, Kudos to you for making such an effort.

    Similar to this, we need as many efforts as we can have.
    To further continue this effort, I would suggest writing letters to your local congress rep & Senator, particularly those who have been waiting for over 5 years.
    More effective approach will be to contact local media.
    Since we have a unique situation, I would recommend start a request to separate legal employment based migrants from other categories.
    BOTTOM LINE: We can not wait for CIR, this is NOT about comprehensive immigration reform, this is a requirement from current employment based immigration system.
