My last one filed on April 2. In "Process". Whether filed onlined or mailed, PERM is processed by DOL federal centers in Atlanta and Chicago, as far as I remember (mine went to Atlanta -the number starts with "A). Why is the guy talking about particular state? Only PWD is acquired from the "state workforce agency"( the actual names differ between states).

I have to let you know that not only will I not support this bill, but I am vehemently against the legal immigration of workers that are originally brought here to usurp positions that would have otherwise been held by skilled Americans. I agree that this is a racist and exclusionary position, but I also know many people who can no longer get work at the level they deserve due to the displacement they have experienced as a result of this foreign worker influx.

i will not dignify your self avowed racism with the erudition of economics, capitalism, innovation, globalization, human rights or the rich history of the united states as a melting pot of cultures ... all of which are underpinning factors that are in the long term US economic interests in high skilled LEGAL immigration. of course, these tend to be conveniently ignored on the altar of superficial sentiment, myopic protectionism and deep-rooted xenophobia.

You can say it is a future job. But USCIS has to listen. They may refuse depending upon your employer's credibility. In either case, however, you have to move back to the state where LC was filed and stay permanantly there for a condiserable period of time upon approval of your GC. If they find you have not maintained residency in that state, they may revoke your GC. Who knows how the immigration law is going to get toughter in futre. Therfore just obey whatever your lawyer says. Do not rely on this immigration boards advise..

There is no point in educating a mass of angry, frustrated EB3-I folks.

My AP was approved today. My PD is current. I am not sure whether AP approval according to USCIS means, I would not be getting my GC.

From what I understand, a conference committee is generally only formed once major difference have been ironed out in the back rooms. In fact the conference committee will only be formed to make the process formal. Again Senate majority leader Bill Frist had talked about the formation of the committee immediately after they came back from recess. That time is far gone. Given this situation it seems that there are some very serious differences that have cropped up. Taking the risk of sounding pessimistic it appears that momentum gained by all the headlines seems to be losing steam and the issue seems to be slowly disappearing from national attention. This can have both a positive and negative impact. The positive impact is that legislators will find it easy to do their work. The negative impact is that legislators will maintain status quo as that is what they like doing. For those opposed to the bill it is better that CIR bill is not taken up now as it still serves their purpose. For us it is always better that something happens to the CIR bill.

yes, thats what my lawyer says as well ... under section 245 k which applies to employment based GC applications, we can file follow-to-join within 180 days. In the mean time h4 status gets nulled and we should not travel out of the country.
I believe that as soon as you file under section 245k, your spouse will be eligible for EAD, AP.
Also, I have heard that 245k is straightforward and will be granted quickly- meaning your spouse will be granted gc in a couple months.

You need to write to USCIS and Ombudsman. Labor department does not approve such petitions.
Could you please post the link to complaint form or address where you send in complaint to USCIS?

Well, may be they are not inferior. But, the people who are getting treated as multinational execs for GC purpose are no way close to being one. I have seen two of my colleagues working with me got their GC's through EB1... and seriously these guys don't even do typical day to day project management job. Documents are cooked up for them as managers... like they do yearly appraisals for others (which I definately know they don't), like they do recruitment (again the guys I know don't), like they are PMP certified... and seriously, both the guys I know are certified :-) But, you know how the certifications work... come no way closer to doing some research :-). I am giving you a first hand experience...anything else?

There may be some EB2 Indians with PD in 2002 and 2003 (with traditional non-RIR LC) got out of BEC recently. If 1,500 Indian non-RIR LCs (with EB2 PD 2003)certified recently from BEC, that is sufficent to move the date back to 2003 for India again. Having said that, it is all prediction. No one knows, except USCIS. My prediction is just based on the magnitude of 485s (800K) filed recently, as is has all kind of composition in huge manitude, apart from so many 485s already pending due to name check.

I totally agree with you.Couple of days back my lawyer informed us saying she might be able to file our case only in 2nd week of July & definetely not before that..Today she replies back saying that shez going to file our case by this weekend.:D :D :D

For e.g me and my spouse are being represented separately by Fragomen but at two different locations. The one at Santa Clara has confirmed that they will send the AOS appls TODAY, June 29th 2007. No news from the other location in San Francisco but I know they are working with a high priority on AOS applications.

If we want to be all inclusive and get more support for this movement then we should try to include more and more people. Having said that we can expand that by adding provision for,
1) Time spent as Students in F1 or similar category.
2) Time spent by Research Scholar for e.g PHD holder who may have spent 5-7 years working on PHD's, and they would love to capture those times.
What you guys think?

1. If they are legally here for 10 years (With approved I-140 and waiting for Adjustment of Status without current date).
2. If they have earned full 40 points in Social Security (http://immigrationvoice.org/forum/#)
3. If they have paid the tax continuously for 10 years
4. If they own a house and paying Mortgage (adding weightage to the Economy (http://immigrationvoice.org/forum/#) boost)
and
5. If they do not have any criminal records in these 10 years.
