just an update from my end. I had sent my EAD renewal application to NSC by mistake when it should have gone to Phoenix lockbox. My check was cashed today from Phoenix center, so looks like NSC forwarded my application to the right place.

Not sure why people who e-filed in May and June are still waiting their approvals while people in July are seeing approvals.
Folks, do you think it has anything to do with the priority date .Can people waiting post their PDs

If the CIR bill passed then we will see huge forward movement else nothing discussing for EB3.
CIR is not going to help EB community unless a miracle happens. It is for illegals only just like last time. Worse comes to worse it is going to put more hurdles for H1b and EB folks.
I think we are better off without CIR.
In any case there is no hope for CIR . A number of senator and congressmen are opposed to it and the wide public also doesn't support it .

Fellows,
We all had a sigh of relief when we saw the new labor certification process (Perm) and were promised that it will be much faster and smooth. Thankfully they have kept their promise, for the most part, except for the cases that get audited.
The cases that are 'randomly audited' have been pending for months and months, some cases () have been pending for over an year and there have been no response from DoL what so ever. I understand that a year does not sound bad especially to those folks who had their labor approved through the old process but these days the labor is getting approved within 50-60 days (average). It appears that the DOL (Atlanta Processing Center at least) does not bother to look at the documents once the audit has been replied to.
Although I understand that not everyone uses and some audit replies may have been replied sooner and were never reported to but you can get the idea just by a sample of the cases that were audited, and see that they have being neglected, ignored or appears that they are no longer considered for further processing. I have seen instances where the lawyers have retreated the application in the audit and filed a new application (a gamble) hoping that it does not get audit this time around. But not sure how that turned out.
If you visit the Atlanta Perm section on you will see the people's misery I mention here. In fact, I am sure that there are number of IV members who are going through this aggravating process but are silent becuase they know that can not do anything. Even lawyers have shown the sign of disappointment to this hopeless condition.
So I ask you, Members of IV, to help us and suggest something that (we) can be done to bring this to the attention of some sort of authority that would help trigger the review of Audit responses.

We have decided to make this thread a place where all the Perm Auditees come and show their support. As of now we are gathering people here to estimate how many people are out there suffering the delays caused by Perm Audit. I have added a poll which is a way for us to estimate the number of people who will support any action that we take to make our voice heard.

I have H1-b petition approval but i dont have h1-I-94 card.
Is it legal to work without h1-I-94 Card?

Read the approval letter. It states that you would need to travel outside the US and apply for H1 visa at US Consulate abroad. If your visa is granted then you can re-enter US with new I-94 card. Stay inside US without a valid I-94 is considered Out-Of-Status.

For EB3 (All countries) to see some light, the changes made recently to the allocation of excess visa, spill over and also to over subscribed countries need to be revisited. Not sure, what triggered USCIS / DOS to revise the interpretation after so many years. Did IV had any role on this, or not .. do not know.. I ask this as based on all forum updates, IV appears to have little success in the Admin Fix area. I have posted this so many times in various threads and did not get an answer, may be there is none. If the interpretation was somewhat like before, EB2 /3 both would have got the spillover... and all would have benefited in the order of PD. Now with the new interpretation. all excess / spillover visa just goes only to 2 countries (EB2 India / China). Looking at the latest numbers based on USCIS website, China has far less cases compared in India based on the cut-off date, which is good for India (EB2), as they now consume a big chunk of the numbers and rest are left out for now. I am not sure, what is opinion on this from folks from ROW (EB3) on this. Does IV has any comment on this... Having said this, I have nothing against Eb2 or EB2 India specific, and not getting into the argument whether or not EB2 need to given much preference.. (Well DOS allocated on 28.6% of total numbers to both this category). This is just my concern on the changes to interpretation for the visa spill over process.

You have put forward a general idea but this has been debated a great deal. What is the purpose of even a poll when it is absolutely clear that everybody in this group would welcome a bill solely for reducing backlogg? The question is how can we get the legislator to write and introduce such a bill and then how to get it to pass. Who will support such a bill? Your desire is similar to everybody else in this group but until there is a definite strategy which is different from what has already been tried there is no point in just creating discussions foccussed on desires.
First think out a strategy and put it out. Others will then coment or join it.
Putting out vague goals like "we need a bill" is of not much use. the question that you need to answer is "how?"

My wife's 485 status changed online as "Card production Ordered".
My GC was approved last year august and waiting for her approval over a year.
I see a pattern of approval for people who got recent soft LUDs. Nola was another person who got SOFT LUD.

I is only based on a law. In the past CIS used the law to implement one set of policy (horizontal spill over). Since the middle of 2008 CIS is using the same exact set of laws to implement a different set of policy (vertical spill over).
Allocation of immigrant visas is not a policy matter. It is based on law. Any change should come thro law change. Congress (&president) has to amend the law (INA) how to modify the allocation. It is not a simple matter. Both DOS and USCIS knows it unfair to keep EB3-IN in 2001; but they can't do any thing. Thats whu EB3-IN folks should try hard to make the congress to change the law. Contacting DOS or USCIS not going to help, as they have no authoity in changing the allocation methods (they only execute the methods).
