Hi All,
Regarding my I-485 appln. status - I do vaguely remember seeing "Request for Evidence" status before. Currently I see "Request for Evidence Response Review". I see this status change although there are no LUDs.
Throw in your input Gurus !
Thanks

Pappu, thanks for the initiative. I will contribute.
I also have another suggestion. Why don't we also do a targeted campaign at partnering with corporate HRs to push for EB relief. Many corporate HRs are aware of the EB2 and EB3 retro pains. These corps rely on EB2 and EB3 folks for innovation and technology. Corporations have a lot of power in pushing legislation. I am just suggesting to try other channels as well. Corporates being just one.
Here is a list of some major corporations in the Midwest to start with. Others can add to the list from midwest and other geographies.

My labor certification (Traditional EB-3) is stuck in BEC since last 5 years. It is completely beyond my understanding why it took so long for BEC to process my case. Now everyone is rejoicing USCIS's decision to accept all green card applications, but I am paralyzed with the fear of facing another huge backlog on I-485 applications. One government agency sits on our applications for years and another government agency throws us further back in the line to cover up its blunders and guess what who pays the price: WE RULE-ABIDING, LINE-WAITING FOLKS.
Even if I get my labor approval before September, I will be among the last persons to get labor certification in spite of being the one with the earliest priority date. Nothing would give me greater pleasure than suing DOL BEC at this time. We may not sue DOL on their inability to clear the backlogs, but we can definitely sue them in their utter disregard to FIFO procedures (mind that some people with priority dates in 2004, 2005 have already got their labor certifications, but some with priority dates in 2001, 2002 are still stuck). When I read on their web site that they have tried to maintain FIFO, it makes me feel like puking.
I am also disappointed with IV's attitude towards the backlog victims. I do not remember anything concrete done by IV to address the grievances of backlog victims. Now that they have won the battle with USCIS, will they have time to look at us?

I would like to extend thanks to all of those who shared their thoughts on this labor certification backlog ordeal. I was touched with nice words some of you bestowed on my situation.
The point I was trying to make was that we high skilled immigrants continuously have suffered from the misdeeds of Congress and government agencies. It started in 2001 when Congress passed an amnesty when people in illegal immigration status were given chances for EB Green Cards. If government wanted to legalize them, shouldnt Congress have created separate processing channel and also separate green card quotas for them? Why were we forced to share our share of green card quotas? Why did we have to undergo several years of grueling labor certification experience to make room for people who violated the immigration law?
Then there was a birth of so called Backlog Elimination Center (BEC). This agency should have been rightfully named as Backlog Creation Center. BEC spent several years not in adjudicating the labor certification cases, but in transferring paperwork and performing a circus called 45 Day Letter. When it finally started addressing the cases, it did with utter disregard to FIFO procedure. As of today, there are still thousands of cases stuck in BEC with priority dates of 2001 and 2002 (including mine). Though they have set the backlog elimination date to be September 2007, there are very strong chances that they wont. I think life would have better for all of us if no BEC was created in the first place and the labor certification process was left the old way.
The purpose of my earlier post was to draw attention to the severe injustices BEC has thrust on us. The passion and energy IV showed in dealing with the recent USCIS fiasco was commendable. If IV can channel some of that passion and energy in dealing with the BEC problems, we may get some breathing space outside this black hole called BEC.

There are just too many fond memories to share in one post... but I do want to specially thank leo2606 who drove 70 miles to pick up myself, venkygct, vsraja and punjabi at the Dulles airport and then took us out for breakfast, then to the rally venue, then for lunch, finally to a hotel room we had booked for a quick shower, basically... like a shadow he was with us wherever we wanted to go! And... whenever we thanked him (and gdhiren who co-ordinated pickups/dropoffs for many others like the 4 of us) these guys, instead of saying something like "You are welcome", would profusely thank us for flying in!
Its people... like leo2606 and gdhiren.. and many others are the true strength of IV!

So what, people in other lands can learn these laws and still do some work of
lawyers/paralegals:
http://money.cnn.com/2004/10/14/news/economy/lawyer_outsourcing/
a lot of companies are already getting their patent filing work done by attorneys and paralegals abroad. Wont be too long before your I-485 filing is also prepared from outside the US :)
True. They are already preparing tax returns from India. I've heard of some tax preparers (competition to H&R Block) who have a VoIP phone and prepare tax returns by interviewing the tax filer. And they are lot more effective in getting a return. A small correction to AmericanDesi's observation that EB1 is for Ph.d . You don't need a formal Ph.d for EB-1. If you have demonstrable extraordinary ability which will benefit the US government and people, you come under that category. This usually requires 40+ peer reviewed publications in International Journals in your area. It isn't that easy buddy getting in under EB1 if you think that all you have to do is to be in school for 5 years and submit a thesis at the end of it. And it is getting tougher and tougher to get in under EB1 as they are scrutinized more.

Bump...
Bumped. Now what?
People should be motivated to do this. Right now most of them are busy Predicting "EB2 - EB3 rather calculation", "Why huge spill over from EB1 to EB2, didn't bring glory to EB2" and "What kind of movement will EB2 have if they get XXXX number of spill over next month and how to celebrate" :D
No offence to EB2s.

HLG wants to give these 90 K to the healthcare professionals Schedule A only...So I donot know about you but I donot get anything for sure.....Even if the recapture is for all categories it would not make much difference....May be EB3 ROW would become current...
I know that HLG has been an advocate for Healthcare (Nurses & PT's). How ever, the particular msg on the web site didnt say that the 90K capture is intended for the Schedule A category

I see that you are just before me. I followed threads for number predictions but it seems there aren't many people doing predictions for Eb3.
I have read here or somewhere that there are only 150 to 300 GCs per month for Eb3 india If it is true then it will take more than a couple of years to get to you as there are 8000+ candidates before you.
Have you seen any calculation for Eb3 any where?
You might be greened in SEP 2010.

If a birth certificate was recently issued, then it MUST BE SUBMITTED along with Affidavits of Birth, Executed by two immediate family members who were 5 years of age or older at the time the birth took place(Please see attached sample)
.......
Why would we need a affidavit if the birth certificate was recently issued eg last year.?

I got an appointment with Mr.Gotcher tomorrow and will keep you posted. Please let me know if you have any specific questions. I will respresent the same with Mr.Gotcher.
Thanks.
Thank you much. This is exciting. I for one would like to know his opinions on why so many audits were called for and then why they were shelved without being touched for months. If it's really due to H2 temp labor we may expect some improvements soon. If he doesn't think so then there is no foreseen end to this issue. We really have to take actions.
And needless to say, what can be done and how we should go about doing it.
I appreciate your efforts.

This is not fair to the person who blew the wistle and alarmed people about the situation. I think we should know and analyze these facts. Most importantly, with all the policy change and lobbying we are trying to do, why can't we make sure that USCIS does its job in a fair, transparent, orderly way!
The reason there is a lot of "rumor" is simply due to those government agencies' imcompentencies, which resulted in lack of confidence and trust from the public.
They CANNOT do whatever they want any more SO LONG AS we stand up to our rights. Don't wait till the problems show up again! Act now to prevent them from happening... at least to get our voice heard so that the whole green card thing will no longer be like a lottery!

You made very good points. May I suggest we ask members to call on the phone too if they're busy? This actually worked in delaying the first Bailout in 2009, when they received numerous calls.
Customer service reps do this for hours everyday in some places.
We have had phone and email campaigns in the past. Phone campaigns work the best when a specific bill is being debated and there is the target 2-3 days campaign. The rest of the time, person-to person presentation is the best.

My wife and I went for the medical examination 1.5 years ago, when we thought we'll be eligible to file shortly. We still have those sealed envelopes. However, the time passed and I understand we need to undergo the exam again for our June filing, correct?
The first time around my wife had a positive skin test (immunized in childhood) and negative Xray. Back then she was advised to never do the skin test again, as it'll always be positive. So, she'll need to go for an Xray this time. However, she is pregnant, and they don't Xray pregnant women... Is she an exempt then? There gotta be a provision for something like this, right?
Thanks.
Vlad
My wife and me went for the medical test today. We had a baby boy a few months back. They didnt do the immunization and skin test for my wife but did the HIV test. They said they would mention the same in 693 document that the test were not done because she is nursing a baby. But this doesnt mean that she is exempted from immunizations and TB test. She would need to come back and do the immunization after 3 months and the doctor would keep a record of it and INS would varify it later with doctor about the test results.

You really cannot do anything in a short time except hoping for the best. Two things have to happen for getting a GC (i) Your file should be or should already have been reviewed, and if all good to go, preadjudicated. That depends on your receive date by the Center processing your case (not RD on your receipt). This date is close to ND, and is often seen online as " your case was received on...". If this date is prior to published dates, your file definitely has been reviewed. Farther it is from the published date, lesser the chance, but approvals are indicating that if it is Aug, Sep, Oct 07 there is very good chance, though September has higher chance than October (ii) Your PD should be high enough. As per USCIS SOP preadjudicated files are piled in sequence of PD's.
Note that both conditions should be met before leftover visas exhuast. Third condition, which always plays significant role is, luck. This means, you hope that IO working on your case did not fall sick when he/she was about to look at your case, some document did not slip out of your file, person working on your case head proper eye glasses so as not to misread your PD as 2007, stack of preadjudicated cases did not fall down losing file sorting sequence, etc. etc.
Best wishes to you and all others.
Yes you are absolutely true..... We must have the luck factor also...
As in my case, my PD, RD, ND and BD (BD aka Birth Day also :) ) all are well with in the current processing time frame and still waiting for the mercy of Lord USCIS.
I am praying for those unlucky folks like me, who are still waiting in the queue, to get approvals before the available visas get exhaust.

From last two days I am also getting the Payment Processing error when i use the credit card option and called the Customer service, they informed send an email to E-filing.support@dhs.gov and sent an email yesterday and still didn't receive any response back. Today When i try to goto login page, now i am getting "Server is currently unavailable or down for maintenance".
Same here, I think, it took two days for USCIS E-filing support team that payment server is not working. I interpret the message "Server is currently unavailable or down for maintenance" as now the problem would be fixed.
This is a Good News. Thanks
