I was amazed by the some of the members who supported such inhumane treatment. People are giving all sorts of comparison stories of what would you do if intruder breaks in , etc. This is a simple case of humanity and nothing more. Yes, the person involved is illegal and probably some action should be taken against that. But some of you guys need to remember that you guys are legal now but it does not take much to lose one's status. A erroneous AOS denial, losing a job. A pregnant woman who is in labor pain and about to deliver is not going to run away that you need to restrain her in shackles , especially when she has established a life here and also excited about the new born. You guys need to ask your mother, wife and sister about this story and get their opinion.

You are eligible to apply under masters quota. There is no special form for the masters cap. However, lets hope that your attorney has checked the box of h1b for "US Masters" and send application to USCIS with ATTN: H-1B U.S. Masters Cap

On March 12, 2002, the House passed such an extension. Section
245(i) of the Immigration and Nationality Act was first enacted as a temporary
provision in 1994 and has been extended several times since then. It enables
unauthorized aliens in the United States who are eligible for immigrant visas based on
family relationships or job skills to become legal permanent residents (LPRs) without

to adjust to LPR status, the alien must have an approved immigrant visa petition and

Since your file is at TSC, there is an email address that AILA members have to request that your file be processed once PD is current. Contact your lawyer and ask him to check AILA InfoNet Doc. No. 08103067, that's where the procedure is outlined.
Yes, very good. Sometime late last year, Texas center issued a procedure to let registerred attorneys (not clients) send them a reminder email if and when their clients PD's become current. That should be done so that TSC can pullout the case and get it cleared.

Best thing to do is stay here till your visa extension is due,and apply for extension from here,you will get new 194 with your extension if its approved.
hope they dont notice it,usually they dont..but take attorney advice.

I have filed for H1B under the Masters quota but i will be graduating only in May and gave an official document from my University that i would be graduating. Somebody i know had also done a similar thing but he got a h1B rejection mail from USCIS yesterday. This has made me really upset. Is anyone there who has filed with a similar document and has received H1B? He had filed it witha consultant while mine is a highly reputed company. Will that make a difference?
Can you tell exact wording you used in the letter of completion. I would assume that you need to have following statement in the letter.
"xxxxx has completed all the degree requirements"
instead of just having "would be graduating"

My PD is current now and my wife is leaving to India this October and will be back only next Feb 1st week.
I still haven't got any LUD on my 485.
In case if I get AOS Interview when my wife is not here, is it possible to change the date? or will I have enough time to bring my wife back for the interview. Basically, how many days before u'll get the Interview Letter before your Interview Date?
