A person, leaving behind a car/home and going back to home country is not doing anything criminal. He is playing by the rule. Of course, these acts would shine on his/her credit report for a while.

I am surprised some of us are actually encouraging immigrants to contribute to the current housing crisis.
I don't really care how it works in America or the rest of the world but common sense tells me loan defaulting is criminal.
When I lend $1000 to a friend for a year with 10% interest, I expect $1100 back at the year end. If he cannot pay and runs away to another country, that makes him a criminal (and of course it makes me stupid).
Let's say I decide to be little smart and hold his $1200 laptop, as a security.
Now, if I get only $500 by selling it at the end of the year, he still owes me $600 and he should still face criminal charges, because effectively I have been robbed of that amount!

I must admit I had not read Slumdog's post properly (I had read his older post abt Peace of mind and was going by a past impression that this one would be a stupid post...).
I strongly feel without gc one should not buy a house but I like parts of the current posting. I guess the bigger issue is the screwed up immigration system getting tied down to your H1-B/EAD and the prospect of endless waits and that is driving people bonkers - what the hell, I'm not going to compromise on my standard of living. Whatever it is, I fully understand all the issues faced by all EB-I folks.

When USCIS has so many I-485 applications, they will have to sort them in the order of PD. Your PD is older and you will have your GC first. However, its unpredictable when you will be able to file I-485.
They will be opening up dates slowly in the Visa bulletin going forward. However, they would open up 2003 PD before they reach PD 2007. You will be able to I-485 then and will have GC before someone whose PD is in 2007.

We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

I was wondering if any one in the core or other members think about the next step towards getting citizenship after passing the hurdles of getting the green card. If a person is here for 10 years and then get his green card (average period), then he need to wait for another 5 years to get the citizenship. 15 years for this process in a person's life is too much.
IV Core can push or lobby for a law which can make the person a US citizen, if he is living in US for 10 years legally without any issues and paying taxes for the entire period. It is just my idea.

Here is what my attorney has sent regarding the AILA release, i dont know whether to believe him or other attorneys, i think i have no choice but to go with what my attorney says.He has been really good in these kinds ofnotices for the past 3 plus years, hope he is correct even with this.
1)There is no way that USCIS would get away with shutting down filing of EB-1, EB-2 and EB-3 Adjustment filings without a massive class action lawsuit against the agency;

In the rush to �inform,� they forgot to pause, analyze and really discuss the true possibility that USCIS would be directed by the Department of State to halt receipt of Adjustment of Status petitions. I want my clients to know this: at this point, I am not worried that the visa numbers will not be available throughout July. If I were worried, I would let you know. My responsibility is to guide you through this process and if there is any genuine worry on my part, I will let you know IMMEDIATELY.
If nothing else, this attorney deserves a medal for at least communicating with his clients.

Finally I was greened after 4 years and 3 months from my I-140 approval date.
I opened a SR yesterday and today my CPO e-mail came to my mailbox. However my wife's status says
"On August 2, 2010, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later."
Do you know what does it mean?:confused:

I think it is better for every one to print the format with case numbers and sign it and scan it as a PDF and send it to a single person, may be a admin or to one of us. He or she needs to put all the case numbers on one sheet to address to DOL and provide the signed letters as supporting documents. All signed letters can be put together as one file for an attachment to be sent as a e-mail.
I can do the ground work if needed. I also sent a e-mail to my attorney asking her recommendation for her course of action. Let us see what she comes back with.

If this kind of restriction is not done what will be best way to resolve H1b issue? If H1b increase is done and similar increase is not done on GC then also problem to all IV members(retrogession will continue). If there is cap then certainly it will be reached every year within April.
If they restrict consulting then Most of the H1b persons will get permanent job. Because of less number of H1 most of them will get gc within 2 or 3 years. GC holders and US citizens will do consulting. System will adjust iteself within a few months

H1B program is introduced to fill the labour shortage, it can be either Consulting on a temporary basis or Full-time. H1B is not just for Full-time positions. Do you know who is fulfulling major labour needs? It is consultants. If there are no consultants, there is no way to fulfill the projects on time. So, my friend, do not divide the H1B community into Consultants and Full-time employees. Both are needed. Also, do you know that 70% of H1B are with Consultants who are fulfilling lot of companies needs on a daily basis. So, we can achieve something if we are united, if not nobody is going to get benefitted and all of us have to suffer.
We are not here to discuss on what is going to happen for future H1Bs applicants and divide legal immigrants into differnt groups, first we need to have some solution on what to do for the people already here and facing retrogression. So, we will stay united to show our problems.

I sent my passport with all the documents and $40 FEE + $20 EXPRESS MAIL to houston, TX
but they sent me my passport back to me, after 1 month but it wasnt renewed. They said that I have filled the wrong application but I can't find any other application that relates to my passport on their website.
MY passport was issued in INDIA for 5 yrs validity and I didn't know it was expired a year back so they also asked me notarise my application. they also said that you have not sent correct fee.
Please anyone can help me out here about which application should I send to renew my 5 yrs passport and how much is the FEE and all other necessary documents......

Most of us are getting a one year EAD. Hope IV can act on this at least for EB3, as EB2 don't really care about the duration of the EAD anymore.

What's up with this site. I thought they updated the server yesterday and we shouldn't see the kind of downtime as we have been seeing in the past but I still don't see any difference. Did the server upgrade not make any difference. May be we should do a fund raising for server upgrade only. This is so frustrating that whenever there is some exciting news, you can't rely on IV webpage because it goes down. If core team needs money for server upgrade, I am all for it but someone please fix this.
