    This is very important organization working for your and mine benefit. This is group of people like you and me who are leading fight for immigration reform for highly skilled immigrants who have high skill jobs or have U.S. master or higher degree.

    As you might be knowing currently there is backlog for green cards. Unless some rules are modified you and me will not get green card in next five years. Specifically it is much serious condition for people from India, China, Philippines and Several such other countries. As they send lot of highly skilled immigrants and each country have fixed quota for employment based green card.


    I know some of you have not yet started working on your green cards. But when you will start, you will realize that it is like doing another master or Ph.D. !!


    Above group is formed by people who came here on student or H-1B visa. They are trying to fight for immigration reform for highly skilled immigrants. When you read or listen any thing about immigration you listen only about undocumented or illegal immigrants. No one talks about improving immigration situation for employment based highly skilled immigrants. Those very few from the business group who talks about highly skilled, are only interested in increasing H-1B, so that they can get more educated employees. But if you work on H-1 you will know H-1B has several limitation like inability to change employer, spouse can not work etc. So it is very important to get Green Card as early as you can, if you are on student or H-1b visa.
    In current situation even if you are wise and quick enough to decide to act quickly for green card, you can not do any thing except sending papers to USCIS ( INS) and paying their fee and wait endless till you get frustrated and depressed. If you are waiting for your green card you already know it. If you have not you will know it soon. Green card is almost invisible for Highly skilled immigrants from India, China, Philippines and several other countries residents, because of backlogs, country quotas, FBI name check delays, Labor Certification delays and backlogs etc. (Some of these words may be new to you. )

    Employment based green card for highly skilled immigrant fall in EB-1, EB-2 and Eb-3 categories. Even if you have PhD and university job , you do not qualify for EB-1.
    and that is only open category. For Eb-1 you need tenure track appointment at University with several years of experience, around 20 research papers and several international awards etc. Those who apply for Eb-2 or EB-3 or NIW ( national interest Wavier) should not hope for green card in next five years under current situation

    This excellent group of people comprising of many bright people from India, China and many other countries around world, is very active in Washington D.C to change the above situation in our favor. Though it was formed in 2006 only it has around 10,000 members. All of them are fighting for our green card.

    I urge you to take look at their website. I am sure you will be impressed by the work they have done in last one year for highly skilled immigrants. They have already established strong political contacts and are using lobbyist to pursuer changes in laws in our favor. This is right time for you to get involved with your future green card process by supporting this organization so that they become successful in their mission.

    Before you go through their entire website, I want all of you to register just as a member. So that they can increase the strength of organization. You all might be knowing that In Washington D.C every thing works based on two numbers, votes and economical. That is why when you listen any thing about immigration you always listen about illegal immigrants, because they are in large numbers and are related to several others who are potential voters. Business group also favors them because of economical reasons.

    So this organization of Highly skilled immigrants also need your support as member, to show law makers that it represent several thousand highly skilled immigrants.
    (we don�t need to be in millions !!) So before you go through their entire website just register as member. It will not take more than a minute.


    I also want you to visit this web site regularly, so that you are aware of what is going on in Washington DC in your favor or against, in reference to your future green card or US citizenship. I visit this web site ten times a day. They give minute by minute picture of the show in Washington DC when it is Hot. Also you need to be part of their email, meet the law maker and other activities as per your time convenience.

    Let me add they are doing all the LEGAL activity which is fully permitted under US immigration Laws. Still if you have any doubt you can call them to clear your doubt.


    Also they need what ever financial support you can do to them. I am also the financial supporter for them. I have contributed few hundred dollars and registered as monthly contributor. I want them to succeed for my, your and future highly skilled immigrants benefit. Remember they are fighting for our green card, which will give us several more rights compare to our current immigration status. It is better to contribute to them rather than paying several thousand dollars to the lawyers. Lawyers just fill forms (you need to check that three times before submitting !!!) and never promise to get you anything. This organization, I am sure with your, mine and other members support will get lot of work done in Washigton D C. So that probably you will not need lawyer for your green card application, and it will become very easy for you to file for Green Card. They had done lot more than what they promised. You can dig in to their website for making your self educated about there fascinating work. Let me add the core team which run this volunteer organization has spent several thousand dollars from their pocket to make this attempt successful, They are that much committed to success and final goals of organization.

    I personally urge all my friends like you to register as member for this organization and also contribute financially, if you can, for benefit of your self, me, as well as future green card applicants from highly skilled immigrant community.

    If you have an argument with some members on the forum, I think it should be restricted to just that. Calling every EB2 applicant a bigot is rude and uncalled for.

    My colleague who recommended me to this forum is an EB2 applicant and is supportive of complete EB backlog elimination and is active in the IV state chapter inspite of getting his green card last year. Even the EB2 applicants on this particular thread have largely tried to point to how we should focus on the larger issue instead of fighting among ourselves. If you do not believe in IV, thats your choice - but I think we need this platform to achieve any relief for EB3.
    I look forward to working on IV action items and lawmaker meetings. lets get this issue resolved for every EB applicant

    You know now that is the kind of argument i cannot argue against. I am extreamly sorry for the the bigot name calling against EB2 but only sorry to the folks like your colleague who recommended you to this forum and who are active in the IV state chapter inspite of getting his green card because he/she is a person worth admiration and emulation

    Now coming to the larger issue what i do not understand is the blind faith of everyone that Eb2 will become current. That will never happen so the assumption that EB3 will get spillover visa after EB2 gets current will never happen, and with that in mind all these statements that this plan will work for everyone bound for failure

    If you do not believe in IV, thats your choice - but I think we need this platform to achieve any relief for EB3.
    If i did not believe that IV was one a platform to achieve relief for EB i would not be sitting at 10:45 pm typing this message. But please notice that i said EB not EB3 because i feel the current approach of IV will be determinable to EB3 on the whole

    SFO is taking 3 weeks for in person renewal. I gave mine and got date of April 2 (which was 3 weeks away). Probably mail would take few extra days.

    I got it in 3.5 weeks. I did it over mail

    The very very first, if not only reason for both party to work on this issue is to gain their vote. What do you gain by giving them goodies but does not offer them a chance to appreciate you back (vote)?

    I don�t know what is so hard about this deadlock. Don�t they know that if:
    1. Illegals are given temporary visas for them to return after a number of years, no-body would come forward. The illegals would see this as shooting themselves in the foot. They would prefer to remain in the dark and live here permanently. Purpose defeated.
    2. A tough enforcement only bill is passed, with the hope that there would be attrition after a while: How long would it take for all 12 million illegals to finally leave? 1 million per year? 500K per year? 24 years? Yeah right! Ok assuming they leave at a rate of 500K per year (which I know wouldn�t happen) what would be the rate of inflow of more illegals?? What would be the balance of illegals after say 10 years? Think about it.
    3. Give them a path to citizenship. Well they are here anyways but this idea might jeopardize the bill.

    So my proposal is: Since �a path to citizenship� is the major road block to this bill, make a law that gives the Illegals an opportunity for GC but include in the law that �Anybody that ever comes into the country illegally CAN NOT become a citizen�. i.e they can get a green card but they can never be eligible for citizenship. I am sure this is a reasonable middle ground�. a path to PR but not citizenship. I am sure those illegals don�t care about citizenship anyways. They just want to be free and be mobile.

    dohko, The point of satishku_2000's post was that all companies follow the similar business practices. It doesn't make any difference if it is TCS or IBM, Anderson or Infosys. They are all same bunch of people, just different names. So your repeated rant about "indian companies" is not valid any more. We have someone who worked for IBM for 8 years and got 2 pay checks on bench. So now, lets not squabble without any reason.

    No body is forcing any one to do any unethical things that applies for consultants as well as consulting companies. If any one does anything illegal they will meet the fate of Enron, Anderson or CA.

    No one is forcing any one to work for a desi consulting company, If anyone does not like them they always have the option of choosing a new employer or leaving the country.

    No company is going to pay for a consultant if consultant does not deliver what client wants.

    Hope economy will be strong no one has to see tbe bad days of 2001 and 2002 which I have seen personally .

    Just recently two american mortgage lendors have laid off people in Southern California without any consideration for immigration status. These companies have people of all kinds which include "US educated" and direct H1s and their green card applicaitons in various stages. All these people have to start all over again. I feel sorry for these guys.

    All the guys thinking about H1b "reform" think twice before what you wish for.

    Hi

    I am planing to go for H-1B stampng in Mumbai some time in June/july.

    I am confused about what to write in question-31 of DS 156 form.

    I came here on student visa in Jan 2001 and currently h-1 approved (not stamped) since March 06.

    When I orginally applied for student visa in Oct 2000 I was given probably 221 G. then I reappeared in Dec 2000 and my Student visa were granted.

    So on my DS 156 what should I write in question-31 - which ask " Have you ever been refused US visa ? Yes or No?

    help from experienced members will solve my confusion.

    gcformeornot posted. please clarify, the instruction states its validity so we have to use that accordingly.

    It is not advised to double file, perhaps you'll get this back sooner than expected and then send it to the lockbox, dunno why they are complicating things as it is there are enough complications :-(

    u bet..there are enough complications already..and the old instructions file shows up in google when I search for 765 istructions!! :(

    I called USCIS and talked to a very friendly IO. He said that either nebraska center will foward my application to the correct office, or they will send it back to me. He said that I could send another application to the correct address, but then its very possible that they will cash both the checks. If I stop payment on the nebraska check, then they will send me an invoice, asking for the processing fee of $340.

    He asked to call back in 30 days if i dont hear from them regarding my application. He also said that they are taking around 90 days to approve EAD renewals.

    This is the only escape route they have.
    Nothing else would calm down all potential lawsuits.

    I would be very surprised if they start working on cases submitted in July even if current and they get extra visa numbers. There are people like me who had submitted thier I-485s (with I-140) under EB2 back in August 2006 and were current back then. I'm still waiting.

    Guys..

    I paper filed EAD renewal two times...took 2-3 months to get card in hand..

    This time I tool chance and did efile...in 1 week (yes one week)..I see card production ordered status online..

    There is no doubt about address etc..u get address on the receipt...

    Hope this help..

    Only catch is that I have seen status online...will post once I receive card in had..

    Congrats on your approval. My EB-2 PD is Mar 30th 2010, still waiting...What were the minimum requirements on your PERM.

    My PD is 31st march...so u will get the good news shortly. Minimum on my PERM were 7 yrs or Masters + 3 yrs

    What is your PD? There is a portion of the memorandum that needs your child's age at the later of the date when PD is current or when petition is approved if PD is current by petition approval date.

    I think you should submit an I-485 for your child as soon as possible or if the child is not in the US then file a I-824 immediately. This will serve as proof that your child "sought LPR status" within one year of your PD becoming current. Even if the 485 or 824 is rejected, you have established the fact that your child "sought LPR status" and leave room for administrative appeal in future.

    This is just my 2 cents and I am not a lawyer. However, whichever way you interprete the new memorandum your child's CSPA age is under 21.
