Both me and my wife are working on EAD.
Our AOS is pending since the July 2007 surge.
My company lawyer recently renewed my H1 (to have it as a backup) and also suggested that we renew my wife's H4.
I received my H1 approval and wife received her H4 approval.
I also visited India and re-entered USA on a new H1 stamp.
My lawyer himself is worried now whether he got my wife into H4 status since her approval in May and that since she continued working, he is worried that she technically "worked while on H4" which is not allowed, based on the last action rule.
Can you advise if we have created any issue by renewing her h4?
Also what is the remedy for this.
According to me this should be of NO issues, since a person is allowed to maintain his/her H status while AOS is pending, as per the dual intent doctrine. Also I think the last action rule is applicable within a specific category. For example when a person applies for h1/h4 at almost the same time, both are non-immigrant categories, then if USCIS approves h1 first and h4 later, then the last action rule would get applied and technically person would become h4. BUT this should not affect the AOS application since its a totally different category, thats a immigrant category.

I came back last month from India via Frankfurt on Lufthansa. Airline does suck badly, but there is no need for transit visa if you got valid AP/visa stamp.
Folks - Amsterdam, Dubai, Brussels are the best way to go. 4 years back, I had problems with Lufthansa, I did not know I ahd to take transit visa and they never allowed me on flight and I had to travel the next day by going to german consulate in morning get visa and went back in afternoon, and surprisingly they had blocked me for that day. Until then, I always used to travel ONLY by lufthansa, but after that experience, I never wanted to. I always fly emirates and I like it.

I am in the same Boat. My PD is May 26 2004. Mine and my wife's case was transffered to Des Moines Iowa on March 19th 2008 and says its for additional processing. I applied for EAD renewal on June 11th and no approvals yet. I called uscis and they say that my ead would not be approved until the additional processing on my 485 is completed.. I am guessing it would be an interview.
Not necessarily in the same boat, although in the same pond.. :) In your case if the email says 'additional"processing and clearly indicates the DEs Moines office then it might very well be for an interview. In the case of ABH though all it says is that it was transferred to a USCIS office for "standard" processing, which could be as simple as USCIS mailing the packets from CSC to NSC.

Nobody from IV has prevented people from other countries from speaking up. On the contrary, multinationalism is only encouraged to give a global face to this issue. But, I don't see anyone from outside India/China bolstering IV's efforts. Why don't they step up and join the core team?

The USCIS has not taken any official position on whether they would allow the after I-140 3-year extension to be transferred to another employer.
Using this loophole looks like many of us have actually sucessfully tranferred the H1B to a new employer after the 6 year limit..
As long as USCIS does not release any regulations...We can do this ....

While its a good idea to write to the president, Obama himself says he gets 40,000 letters per day, so its a rain drop in the ocean, no offense intended.
We need to do a coordinated strike by all members of the IV
1.Everyone send an email or calls the Congressman's office on a particular date
2.Call or email their senator on a particular date.
3.Write letters to popular TV talk show hosts on a particular week saying legal immigration is ignored in the immigration debate.
4.Send an email to the president on a particular date
5.Organize peaceful rallies in their respective cities on a particular date. This way no one has to pay for traveling in terms of flight tickets or pay for hotels
This has to be organized by PAPPU and TEAM as everyone respects their work and commitment.
PS Don't start of the donate campaign thread now, people will donate once they see action and not just words. Only #5 needs donation for flags, posters etc( even that content can be brought by folks themselves)

From what i know, if you have an Indian Passport and a US Green card, the only countries you can travel to without any visitor/tourist visa requirements are India, USA, Canada, Bahamas, Dominican Republic and Mexico (Thanks to Sunny1000 for confirmation of Mexico and Dominican Republic)
Are there any other countries I can go to which don't require a Visa or will grant a visa on arrival?

It does not charge some of the fees - like the appraisal fees, etc + reasonable, competitive rates. They also guarantee to get all of the closing done within a certain period of time, which they usually beat by at least a couple of days! We have our mortgage with them presently. There is also Sallie Mae Home Loans (http://https://www.smhl.com/index.html)! We had our first home loan with them, but then they sold it to AmTrust Bank (http://https://www.amtrust.com/Personal/Pages/home.aspx) formerly known as Ohio Savings Bank. Our rates or anything else did not change. We live in AZ.
You should window-shop around as much as you can, but remember to initiate all of your inquiries within a 2-week period - so it is counted as a single hit on your credit history!

My Lawyer does whatever my employer tells him. They never give any receipt notice or approval notice to employees.
They did not even let me file my EAD and AP along with I-485.
I can file EAD/AP myself but I'm worried they might not give me the receipt notice of my I-485 filed in july, in a last ditch effort to prevent me from fleeing(I don't yet have any intention btw) or atleast make it difficult for me.
I'm sure there would be many in this situation.
Any thoughts what can be done?

If we place ourselves in the employer position, almost everyone who can file 485 now is dreaming of invoking AC21 6 months from now. Imagine the mayhem if everyone or almost everyone quits. Many companies which are not direct vendors & where the employees are mostly H-1b will probably have to close shop. Naturally, employers would want to be cautious.
In your case, since you do not have the intention, you do not need the EAD anyway. At the least, try to get the case number. Even if your attorney does not give it to you, you can call USCIS and get your case number for 485 as 485 is really your application. You can also change the 485 address to yours during the call and then all communication will come to you.
You can invoke AC21 with your H-1b. That is the preferred method.

Well, my attorney filed interfiling last friday and according to him, my 485 file should be updated with the new I-140 in 3 to 4 weeks from now. He informed that we should not expect any written confirmation from USCIS though. I will keep you guys updated in this regard. In the mean time, if anybody in the forum has gone through this process, please share your experience.

She should have tried through the emergency quota/appoinment to get her stamping.. Death in immediate family is a accepted for this and I know a colleague you had to go for India for the very same reason, death in the family and returned back after getting his stamping. Got his appointment through EQ. If you fear to get stamped in India, then you can blame the appointment to be 4 months away, etc.. etc...
The article posted is touching, but out lives are not that bad .. We are far more better and we do have a good life.
I do not think one would not go to India just because he/she is scared to get a stamp in India. The loss of someone dear to you can overcome any such fears one might have (for me atleast thats applicable).

That is the ONLY bloody way you can assure yourself of a CLEAN organisation..i do not know what it will take for IV 'CORE" to understand this.

We see a lot of these articles every day praising illegal immigration. How about creating a google group with volunteers that will pick up such similar articels and post a rebuttal, either online or through another website?
The one we discussed yesterday was about how illegals contribute to the economy by paying $1.5 Billion in income tax for an estimated 15-20 million illegals.
This was estimated from the 2010 Census data.
We could initially post these rebuttals online on probably a section of the IV website and also send it to other news sites.
People who are good at parsing excel/MDB, csv sheets will be useful.
Most people are not aware of our issues and contributions to society.
Were you part of the call yesterday on the Filing I-485 when PD is not current....we do have plans like these...and take part.
