I am little confused. As your wife is already in legal status (h4) till 09/2007, why do you want another extension when you switch job? As far as I know (I had similar situation in 2003), you can transfer your H1 to new employer and before her H4 expires, apply for extension with your new H1B (it may not be required even as she has already applied for H1).

Hi,
My priority date is Dec 05 (EB2 India) and my case is with TSC. I got approval emails for myself and my son (we both are derivative of the I-485 application filed by my wife) two days back but my wife's I-485 application is still pending.
Is it normal that derivative applications are approved while that of the primary applicant is pending? Should I follow-up or wait for couple of more days? Anyone in the same situation?
Any input will be appreciated.

I agree too. Visa Re-capture is the only solution which is available at this time. Now we have actual data in hand. We need to build a strong case, for ex person with priority date of 2004 have x number of people ahead of him, based on the numbers available per year for EB3 (I) It will easily take more than 5 years, That means total time for GC process from start to finish is >10 years.
One has to work in similar position for 10 years.
We can brain storm points like this an d build a strong case for admin fix/ Visa re-capture...
Thoughts/ Concerns..

So spill over helps a small section either Eb3 I with PD between 2001 - 2003 or EB2 with PD 2005 - CURRENT. For all others only real chance is recapture

Do you have any count of how many LC's have been approved with PD between March 28, 2005 to Dec 31, 2005 in the category of EB-3 ROW?

The first column showed the priority date. The second column showed the approved LC with the PD range but approved in FY 2006 and the third coulmn showed the number of LC with the same PD range but their Labor approved in FY 2007(as different application can approved in different times).
If we assume that all the applicants with PD before July 1, 2005 have been approved then remaining numbers are total of 11979 with PD before July 31, 2006 and after Jun 30, 2005. If we assume that all the applications with PD before March 1, 2006 will be approved within this FY i.e before 9/30/2008 then only 4707 numbers of applications with PD between March 1, 2006 to July 31, 2006 will be left.
Based on above data how could you assume that Cut-off Date will be back to 2004 and it will take 2/3 years to even cross the year 2005.
I guess it is not going to move any further.
There are more than enough applications waiting to be approved than the visa number available for ROW this year. It will move backwards to 2004 date in October when visa number for 2009 will be available.
Remember, PERM started in March of 2005, and there are floods of LCs with PD > March' 2005. It will take 2/3 years before it can move beyond 2005.

I live in LA and sent my renewal application to NSC on April 1st and reached on April 2nd, but they forwarded my application to PHX. Arizona, then check cashed and recieved reciept in mail on April 21st. it took 21 days for me.

Throw in a few thousand illegals(amnesty) into the mix and now you have the royal screw-up as is happening now. The law allows visa numbers from unused countries to be transferred to the oversubscribed countries but with nearly every category retrogressed this law won't apply for a while.
The future looks toooo dark even to mention.

That is called as misusing the System. We have labor misuse. Now this one will not come out until someone complains. You are lucky we do not have lot of people from EB1 category people here.
I dont care if anyone gives me reds for it. There are a lot of people misusing the GC as well as the H1B system.
Life is not always fair. We all have to just suck it up and take it on the chin if you are a man and in the rear if you are Karan Johar. LOL!!! :D

Is there any thing we can do to save IV forums, from all these so called smart people.
Simly these guys want to derail the whole discussion either it is EB3 push or visa capture or any kind of fruitful discussion.
I know it is difficult to stop creating and screening ids, atleast can you delete some unrelated postings and make sure that there is some healthy discussion continues and people like me wont stop visiting IV.

We had our fp done on June 11th and there was a soft LUD on 07/22.
efiled on 05/21
EAD expires on 09/11
Hope we get our EAD approval soon.
I think they had a system glitch for some time. All the people who got an LUD on 7/22 essentially means that TSC had received the FP on that date.
I have an infopass on 14th I will see what information they will provide.

How about flexibility in changing jobs after I-485 filing
Three year EAD+AP
Counting the qualifying year for Citizenship from I-485 filing date.
Granting in-state status for students where their parents have I-485 pending for five years or more
Visa validation or stamping within US

Life has lots of other issues,so while the GC is important it cannot and should not come before all other problems in life. Talk to the people who have been diagnosed with cancer or something else and have been told that they will live 6 months at the most, you'll understand what priorities in life are.
I do wish it was Friday today then could have downed a few pegs tonight :rolleyes:
