Is it against the law to apply for F-1 visa while I-130 is pending? May it in some way affect the I-130 application?
Since DS-160 form doesn't ask that question regarding petition on my behalf anymore do I have to tell them the truth myself or not unless they ask? Please comment. Thank you.

I Hope that after this trip to DC ends, we will know a lot more about the upcoming legislation and our own strategy.

meridiani.planum, thanks for giving me red. I dont think EB2- India will go back to 2002/2003 for the October 2008 visa bulletin. Even if it goes back to that old dates it comes back to 2006/2007 very quickly.

All our members in the state chapters are verified and by posting information on state chapters we are ensuring that sensitive information is being passed only to trusted and verified members. There are lot of members in several state chapters that are very active but they are not as active on the IV boards. it is only fair to pass info. first to people who work hard on every action item on a consistent basis. State Chapters have Gate Keepers and we do not add anyone without verifying but remember the Gate Keepers work full time, travel for business and have families so it takes anywhere between 1 to 5 days before a member gets his request accepted. We do not have the luxury of having a dedicated Gate Keepers to our state chapters 24 x 7. I add members to so.cal chapter only after verfying them. I have the time currently to send an email and ask people for info. if they did not provide info. that is mandatory but I might not have the time to do that in the future. I might not be responding to people who do not provide mandatory info. I only have 24 hours in my day just like everyone else. Hope this helps

I am in a similar situation. My current H1B and my wife's H4 expire on June 20th, 2007. I have filed for my 7th year extension as well as my wife's H4 extension in Dec 2006. I got receipt notices for both the application with a notice date of Dec 21st, 2006.
I am planning to apply for my wife's H4-H1 in April this year under premium processing and I was wondering what would happen to her H4 application if her H1 petition gets approved first. Will she be out-of-status between June 21 and Sept 30, as her H1 would start on Oct 1st. Also, what happens to her H1 if her H4 is approved after H1.
Any thoughts.

I think what is being conveyed is NOT that he is superior .... but that he has been in the US atleast 2 yrs more than when he actually started the journey towards GC by formally putting in an application

Why do you need a new lawyer? You don't need any lawyer now for that matter, but the lawyer who filed your I-485 should not have any problem in continuing to represent you even if your last employer paid your GC processing fees. If you signed G-28, which most likely you did, your lawyer established relationship with you to represent you.
Infact today is my 2nd day at my new job. I have decided not to inform USCIS. And I am in process of hiring a new lawyer , since my previous company paid for my GC , the company lawyer asked me to go with different lawyer for all my future needs.
I will hire a lawyer and plan to file G28 form in this month.

I am not opposing webfax. I am opposing webfax you are sending to promite illegals. These organizations are going to use you to market them self. Secondly nobody is going to read your fax if you even change the words.
Organizations supporting illegals will do nothing for legals.
If you think that by changing the words , you can use their fax to spread your message, then why dont you go to anti-immigrant websites and change their words and send faxes to support legals. You will not do it because you know anti-immigrant is written on top of the fax.
So why do you want to become a puppet of someone else.

On the left upper hand corner of every post you will find 3 icons. Click on middle one and a drop down menu pops out. If you click -- I approve then its a green dot and if you click I disapprove then its a red.

If he is going to start with new PERM. new I-140, he can port the old PD based on old I-140.

certification or approval of a Form I-140 employment-based (EB) immigrant petition shall
remain valid when an alien changes jobs, if:
(a) A Form I-485, Application to Adjust Status, on the basis of the EB
immigrant petition has been filed and remained unadjudicated for 180
days or more; and
(b) The new job is in the same or similar occupational classification as the job
for which the certification or approval was initially made.
note the "and" between (a) and (b) and note point (a) which states that a pending 485 is necessary for an alien to change jobs

I wonder on what basis did they advance the dates by whatever margin they did. No doubt, any positive movement (in hours, days ) is good but the consolidated database is not in place as I understand and so this seems pretty much a watershed. The dates might move with out any GC being issued :)

Hi All,
I would really appreciate everyone's honest opinions on this matter.
We filed 140 and 485 concurrently in July 2007, EB3. As of now there is no word on either application. Previously we had also obtained Canadian PR, the 3 year grace period of which will expire this August.
Not only am I faced with a decision of staying in the US or going to Canada, but my future career is on the line too. This year I will be 23. After taking my undergrad degree in electrical engineering, I have been accepted into Boston University Law School in the US as well as the University of British Columbia Faculty of Law in Canada. Canadian lawyers make around half as much as American ones after all factors are considered.
In your opinion, should I stay in the US, going to law school, in hopes that the green card will come through, or should I pursue a new life in Canada, but take the lower future salary / international renown?
This issue is currently causing much discord in my family. I hope to hear your frank opinion so that I won't take my decision lightly.

1. there is now another way to contribute, iv-merchandise is finally here, please visit the site, there are various exciting options. you can buy iv t shirts mugs, stickers, magnets et al also if you use common web merchants through the iv link, some small piece of revenue will flow to iv at no cost to you! this could be a hotwire plane/hotel/car booking, american express card or much more. see the link on the home page and the thread from english august.

Yes its good USCIS have revenue to hire more people to process our applications. Well said.
It makes no difference whether they allow concurrent filing of 140/485 or not IF YOUR EMPLOYER IS WILLING to pay extra premium processing for 140. IF not , it makes minimal difference (2-3 months delay). Earlier this year, people were getting 140 approved on 6-8 weeks average without premium fee.
If your date is not current:
This rule makes 0 difference. File 140 and wait for approval while your date moves forward. Once its current, file 485.
If your date is current: File 140, regular processing 2-3 months and then file 485. If you can get premium processing done then it would be 15 days and then file 485. Either ways, you are delay in filing 485 by 2-3 months. In the grand scheme of things, its negligible. It would take even 2 months for your lawyer to get the paperwork straight for filing 485.
So please relax, this new rule that does not allow concurrent filing of 485 and 140 is not earth-shattering. Its a revenue generation move. And its good as long as revenue stays in USCIS as they do need revenue to hire more people to process files faster, which is in our own benefit. The only problem we have is the rise in fees generates revenue which often times does not stay with USCIS and goes away to other agencies of DHS(I think, this was mentioned in CIS Ombudsman report, if I am not wrong).

RFE is about company asking about the company payrolls, number of employees, Taxes filed for the last 3 years, Company location, my company to client relation etc etc.
