I have a couple of questions, pl let know if you have valid info.
Situation: My spouse came to US on H4 and then got converted to H1.Due to delay in pay and not a strong case, she is not willing to go for H1 visa stamping next time when she goes to India. She wasnts to go for H4 visa stamping instead.
1. Is it better to convert to H4 here and then leave for India? We feel that if it would take time to convert to H4, then instead of waiting she can work till the last day here and then quit and leave(because she wants to leave ASAP). Also changing from H1 to H4 here means submitting paystubs and other documents and more scrutiny. I think in Chennai consulate there will be less questions if applying for H4. Any thoughts, pl help?
2. If applying for H4 in Chennai, will they ask for paystubs from her previous H1 status? They shouldnt since she is applying for H4, but I still wanted to know. If they ask why do you want to change back to H4, what is the best answer?
3. Travelling on an expired visa from East coast to Chennai. If there is no time to get transit visa to travel thru Europe, which is the shortest route/best airlines to get to Chennai quickest from say, Atlanta? Pl help

Whatever Lofgren asked to USCIS , IV should pass that information to the media , with whom we got contacts now.

I got mine in 8 weeks after submission. But For my son, it is six weeks and still counting...

I Applied online in mid april, mailed to CGI houston and received in 43 days. Like others said it was difficult to get them over phone. I only got them once, I messed up with my DOB in online application, so called them and they told they'll take care of it, asked me to mention it in covering letter. I did the same and got my new passport with correct DOB.
Anyone, who has renewed their passport at CGI houston very recently, please post response time and dates. Mine was mailed on 16/6/2008 and received at the consulate on 18/6/2008. No response till now. Thanks in advance for your replies.

Anything with the legislative effort aka unused visa recapture will not happen in this political environment.
My only question to the EB3I is,
Do you want to wait until the visa recapture, when ever it happens or will it ever?. More-over this has been taken up by many people in this forum and fizzled. To add more, do you know what will happen when un-used visas are recaptured ? Will it benefit EB3I or will it be given to EB2 just like the spill over. Would you do something right now to atleast get some short term relief to EB3I ?
I am here in this thread to understand what we can do for EB3I immediately. I presented an option when somebody asked in this thread. If you want to take it or leave it, its up to you to decide.

Do not get too excited. If we are still in current in the Sep 2010 bulletin, then some reason for hope.
As of now, I only expect < 5% people to get approved this month.
If we are still current for Sep 2010 bulletin, then expect around 35 % to get through.
If we still stay current until the end of the year, expect ~ 80 % to get through.
How did I get the numbers ? My gut feeling.

Can you give me some reasons why visas are unused and a percentage.
In other words, why would someone go through all the paperwork and then not get the visa?
no idea why visas go waste? The annual limit of 140,000 is use or loose it. Processing delays is main reason visas are wasted every year.....

My son was born physically disabled (cerebral palsy). He his wheel-chaired bound and is totally dependent on us. He speaks and understands everything. He went to High School here,and got his Diploma and Certificates. That's why when me and my wife came here in 1992, from Bombay, India for my son's operation and came with B-2 visas medical visa. By the doctor letters our visa had continued for three and half years, and temporary work permit for two years only. Then we tried to change our status, but that didn't work out We also went to the INS local office, they advised us at that time it was better for us not to change our status. We did not get a deportation letter. We got a letter from INS saying that had they had CLOSE our case. We all three have SSN.
My employer filed for LC in 01 and approved in 06. Also my brother filed for I130 in 01. In Feb 06 filed for I140 and approved in July 06. Due to backlog with the Labor Dept, my son is now 23. So my son can not file for I485 with me. He also can not file for PERM because he is disabled. Though he is very good at computers but who would hire a disabled person.

I signed up for monthly contribution rather late, sorry about that. Was just busy the last few days. I agree with GotGC. I did the same thing last couple of months, persuaded my friends like crazy and sat at their homes and got them registered and also got them to contribute. Looks like now I have to go to their homes again and get them to sign up for Monthly contribution. People just dont get it.

You are right. But many people came here at the middle of their carrier and they are struck here with their children education etc., They are bound to be here and there is no way. Further, in my country, there are still reservation policies in everything, which may prevent the kids in going in for the education line they like. I donot want to explain this more as I may be degrading my own mother country. In a nutshell, everyone who wish to be a citizen of this country will have lot of valid reasons for getting a citizenship in this country.
isn't the effect of reservation the same as the effect of affirmative action?
If your kid gets high scores in SAT but does not get into an ivy league college because your ethnicity is over-represented - but some other kid with much lower scores gets in (and its not a hypothetical scenario - happens every admission season and i sincerely hope does not happen to your loved ones).....where does that leave your logic??
i see your point that people do have their own reasons for desiring US citizenships - but sometimes its also important to take a step back and see what one is giving up!

I have a question regarding an appeal I did a year ago for a rejected LC.
I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help. I am not sure which point u did not like. For me they help every one in the line waiting for gc.
Having a tolerable time ensures that USCIS processes all the applications they receive in reasonable time. Eliminating renewals reduces lot paper work, money, time and energy. If this is considered as unacceptable I do not know what one should expect. I just wrote what I think is meaningful. If have a better idea, please feel free to comment. But stop commenting on other. That will only spoil the good spirit of the members in this thread

IV is already helping. The aim of IV is to eliminate retrogression so that everyone does not have to wait. We also understand that EB3 I is in a much greater mess than anyone else.

Yesterday, it was our turn too to get the approval notice. It was a long wait like many of you. Checking into IV forums has helped me cope up with the delay. It is more than 8 years since entering US, 6 years since signing up with employer for GC, and five years since filing for labor. BEC and 485 were the biggest unpredictables in the journey. There were times when I thought if it was all that worth. Anyway, now we have completed this arduous journey (being an Indian).
As a token of appreciation for IV and good will for my fellow countrymen continuing the journey, I am also making a contribution of $100/-. I saw someone already made such comment here. Needless to say, my contribution is along the way.
Good luck to all in waiting.

I posted my experience of last 9 months on your peace of mind blog, and i agree with you on all accounts (on both blogs). But what resonates from your post is, how people could/will/would/shall/should perceive and think....it is the perception of life that is becoming scarier than the life itself.
What rings my mind is, why is being happy all the time so hard? Or, is it again the perception of what should be done to be happy - anyways, below is what stuck my mind after reading yours...
Ultimately at the end and very basis we are human beings and we are allowed to commit mistakes. Each person/individual will have to decide what "mistake", "risk", "issue", "reality" is. For some its thinking through the heart and for some its thinking through the brain. If its heart then its risky and if its mind, its calculated. There are instances when both heart & mind have been right, and also where both have been wrong.
Folks, keep your head high. You have lived so far and will in the future. Dont let a right fly you away and a mistake drop you. It is hard to live a life as-is, and with aspirations dont make it harder. Dream but dont hope.
At least try to be happy, and pray for all the needy and help as much as you can.

I mailed my passport about 3 weeks back to SFO. Have not yet got it. Anybody done it recently?
SFO is taking 3 weeks for in person renewal. I gave mine and got date of April 2 (which was 3 weeks away). Probably mail would take few extra days.
