gc4me : Pardon me, but how is citizenship not a relevant issue to legal immigrants? If you're not worried about citizenship issues, then why are you even infesting this thread? Many people, including me, might be interested. And I have indeed contributed, although I don't see how that is any of your business and as long as this website isn't being hosted on your home computer, I don't see what gives you the right to ask it of anyone in a patronizing tone. It's simple really, if you're not interested in any issue, just stay away. No one needs your BS sarcasm or disapproval.
This is important thread and shoul not be closed.
IV is a organization of highly skilled immigrant who suffers from long waiting for immigration process. That includes all issues such as Name check, EAD, AP, Backlog, Green Card, I-140, I-485. Citizenship is also a issue that ultimately affects to all who wait for the long time for GC. So this organization should at least discuss implication and possible solutions, that can help to reduce Citizenship wait time for its members.
Because of the other pressing issues, it may not be a priority issue, but it is some thing to keep on the table and discussion when Major Immigration Over haul take place. I personally think it need action from cogress to address it.
I think releief in terms of less years as citizenship wait time for Highly skilled immigrant who has waited for long/ contributed in the taxes to the country and contributing by his Skills and Qualifications, is achivable.
when Some one who just marry to Citizen can get Citizenship in only 3 yrs of wait, If they can give cuban credit for their wait time, If in last bill they can propose TO REDUCE ONE YEAR WAIT TIME for some one who know english, than why one should hesitate in asking similar relief for some one who has Say PhD/ Master in Engineering/ Sciences, has contributed to this nation in the taxes for five or more years and has suffered because of the problems in the system.
Remember orginal wait time for Five Year after, though I am not exactly sure, but looks like designed based on Family based Immigration system, where person comes in the country just based on the family tie ( no other qualification) and comes directly as a Green Card holder it might be wise to wait five years to see his contributions to the country and his other aspects.
Also when many countries are making changes in their rules to attract highly skilled immigrants, when US imigration system is likely to be changed in near future, this might be right favour to ask for Highly Skilled immigrant from any country in terms of citizenship benefits.
Hope IV team and members keep this topic in mind apart from other immidiate pressing issues and needs. some time we come so much involved with our immidiate need that we can not see long distance. Who ever brought this point is thinking in the long distance goal of finishing immigration process, which many of us started as a H-1, F-1, Visitor, J-1, L-1 or among the several other immigration categories. Why we should not be thinking of finish line, where we want to reach some day. There is no harm in thinking and discussing that how to reach that finsih line.

My employer filed my EB3 PERM on 65th day after starting the process with a job bank posting, and after filing with DOL it took 11 days for the lawyer to receive the approval.

Hi,
I am planning to start a new petition in EB2 and use my EB3 2003 PD.
What I gather from here is that the EB2 PERM has almost 100% chance of getting audited due to the current economy.
I am planning the EB2 with a different employer.
I have the following questions:
1) Since I am going with a different employer can I use a different ODot code than what was used when filing my EB3 labor in RIR? ( I am guessing the codes differ slightly from the old labor certification days anyways)
2) What would happen if by bad luck my new PERM gets denied? Will my old EB3 petition continue to be valid?
Any advise is greatly appreciated.

i don't get it you are saying that members don't have to search...and yet someone has to keep it up on the home page...which is it? yes a sticky thread would have saved work and not required someone to keep it up. Why wasn't it done in the first place. When a service is supposed to be offered every week...it should be offered every week...or else there should be an announcement that is will not be offered this particular week and that it will continue next on said week.
No reason to be frustrated when people are asking simple questions...another idea would be to put the answers to the most frequently asked questions on the FAQ page...which does not work right now....so that you don't have to repeat the answers.
Its an easy solution i think.
Giving a long lecture of frustration is not the best way to attract people to an organisation.
Think about it...do u go buy clothes from a store that voices their frustrations about the prices of raw material...of do u go buy it because they were nice to you...had great customer service...nice selection of goods...and fair prices.
I am sorry but working for hours on end alone, voicing frustration at lack of participation, treating members like they are morons for not being able to find supposedly simple things is a really terrible way to attract more people to an organisation. The cause may be noble...but who will wanna join some organisation where people just complain about how miserable things are.
Please pause for a moment and think about what i am saying. This is exactly why you have less participation and less donation. IV needs to transform into a vibrant fun place to be while still upholding the noble cause.

I had a somewhat similar epiphany little while ago and started a new thread... and got laughed at.... but the more you think about it the more this sequence of events comes across as a plausible and logical explanation of what may have happened.
It would be interesting to watch if and how the agencies respond to Congresswoman Lofgren's letter and if any new and more interesting details about this whole mess reveal themselves.
Where's an investigative reporter when you need one.... is Bob Woodward listening? :)
BTW, loved the Post's coverage - perhaps the best amongst all I've read so far.

So is it possible that the following was USCIS' plan all along in a bid to (1) force applicants to pay the higher fees and (2) reduce the number of applications they would receive. So let's try and see where USCIS or DOS acually broke the law. BTW, the following is pure speculation on my part.
1. DOS makes all categories current in the visa bulletin dated June 12.
2. This screws up USCIS's plans. So they have to force the DOS to issue a revision before July 1st.
3. USCIS frantically starts requesting visa numbers. Even for 485s with pending FBI checks.
4. Come July 2nd, USCIS still hasn't used up all the 60,000 or so numbers, but still informs DOS that all visa numbers have been exhausted.
5. DOS publishes a revised visa bulletin dated July 02 where everthing becomes unavailable.
6. USCIS acts on DOS revised visa bulletin and decides to reject all I-485s filed on July 02 and beyond.
7. July 05 onwards, USCIS starts returning the numbers to DOS. This could be for applications that have pending FBI checks.
8. DOS now decides to use some caution before issuing August bulletin. They will probably not make all categories current, but will probably shift them by a few months based on June bulletin.
9. USCIS now gets all new applications with higher fees and a reduced number of applications.
Please add to this sequence of events if you think I missed anything.
IMHO, USCIS broke the law in #4. And DOS broke the law in #5 if it was aware that visa numbers were still being issued as of July 02.

Which report from DOL are you talking about. Have they published any report before.
Why will DOL move EB3 India back to Apr 2001 if they didnt have any approvable cases for month of Oct and Nov?

I was with Company A whn I got married which had my visa and I 94 till Nov 08,2006. My wife wnt to consul. and got her visa and I-94 till same date.
I came back to US alone and changed to company B in July 06 and got my I-94 till 2009. Since my wife came to USA after that she didnt get her xtension.
i forgot to file for her xtension.
I had to agn change the company C in Dec 06. Thats whn i realised her I-94 expired in Nov. My lawyer said it shud be Ok since she has not passed 180 days after it has expired. or else she cud be black listed
Today lawyer got an email from USCIS saying they r waiting on security check on my wife. Wht r the options my wife has becos her 180 days will reach in May 08. Can she stay here till a decision on her is finalised by USCIS?

I posted my experience of last 9 months on your peace of mind blog, and i agree with you on all accounts (on both blogs). But what resonates from your post is, how people could/will/would/shall/should perceive and think....it is the perception of life that is becoming scarier than the life itself.
What rings my mind is, why is being happy all the time so hard? Or, is it again the perception of what should be done to be happy - anyways, below is what stuck my mind after reading yours...
Ultimately at the end and very basis we are human beings and we are allowed to commit mistakes. Each person/individual will have to decide what "mistake", "risk", "issue", "reality" is. For some its thinking through the heart and for some its thinking through the brain. If its heart then its risky and if its mind, its calculated. There are instances when both heart & mind have been right, and also where both have been wrong.
Folks, keep your head high. You have lived so far and will in the future. Dont let a right fly you away and a mistake drop you. It is hard to live a life as-is, and with aspirations dont make it harder. Dream but dont hope.
At least try to be happy, and pray for all the needy and help as much as you can.
