I am not sure how far it is true, but this is the content of the email I got from my attorney when I pressed him to file at the earlierst.
"As soon as we have these forms back, all of the evidence for filing remaining from you, and I review the completed filing, we will file it. We appreciate your interest in filing on the first day the filing allows. We will endeavor to do that. I should point out that the current bulletin allows for filings throughout July. It is possible that the filings could be discontinued later in July. We are in touch with officials in Washington about this issue and will file your application in a timely fashion for obtaining the benefit when the filing is properly prepared."
Please don't put any sensational heading on your post if you don't know what you are saying.
This has been discussed a lot here and is nothing new. There is always a possibility that USCIS can issue a mid-month VB and discontinue taking 485. It has not happened before, but is certainly possible.

I have a full time offer from a well know company here in the bay area. I have an EAD.
The new company wants a copy of the following
1) Labor certification
2) I-140
The thing is I don't want the new employer to file AC-21 as it may back fire on my pending I-485 as we have seen in the cases in the past. with I-485 being denied etc.
Any one in same boat who was asked for labor as well as I-140 copy? How do I convince new employer that, AC-21 is not necessary to be filed?

I am jumping ahead of the situation here, but I just wanted to see what other members think/know. Assuming that the 90K visa recapture happens, It doesnt take too long for them to be used up in the current situation where there are a lot of people with labors and approved 140's (w/PERM). Not every one will have an oppurtunity to file for a new labor and file for 485. If DOS makes the PD's current / post Mar 2005, wouldn't it be unfair to people who labors are pending for 3 yrs. How does this work out in the previous recapture? HLG doesnt say about numbers being forwarded to the next year though.
To be fair, maybe we should ask the lawmakers not to allow the recapture of the 90k visas to make sure that people with later PD will get GC later. Besides, we should ask DOL to retrogress again, maybe to sometime in 2000, to guarantee that everyone before that time gets his/her GC. We should also ask USCIS to stop processing 485s and resume until BEC finishs all the LCs.

1. You stopped worrying because you got your EAD at least.
2. USCIS is not asking to prove relationship with your great grandparents every time you go for H1B extension
3. You don’t need to worry about the VO at POE or consulate and not postponing your India trip for 3-4 years now.
4. Even though you are on project and pay roll is running, paying the tax...don’t lose your sleep over what memo comes next before the next H1B extension.
Our people are not worrying until it strikes them. Till then they will ask all sorts of questions and have attitude of why should I donate. You can see now and then a thread on IV - Help urgent, I-485 denied, H4- denied.

Just see the old threads of EAD delays. All these people with EADs were sobbing on those threads pleading to IV to help them. Most did not have a donor status or had contributed a dime. They were on the verge of losing their jobs when IV helped them get their EADs on time. Now where are all those hundreds of people. Are they contributing a dime for the lobby day? I bet after 2 years, they will come again to IV and sob about EADs delays and ask IV to help them.

"Over the past 12 years, our government has spent $25 billion on enforcement of our border. During the same period, the number of undocumented in the nation has nearly doubled," said Bishop Gerald Barnes of San Bernardino, who heads the U.S. Catholic Bishops committee on immigration.
"We urge congressional leaders and the President to seize this historic moment and enact a just and humane immigration measure," Barnes told a news conference.
"Either fix it, or five years from now there will be 20 million illegal immigrants here," said Los Angeles Cardinal Roger Mahony, whose vow to disobey any laws that would criminalize illegal immigrants and those who help them has made him a leading voice in the national debate.
Lawmakers are struggling to reconcile a bill in the House of Representatives that focuses strictly on border enforcement with a Senate bill that would also create a temporary work program denounced by many conservatives as equivalent to an amnesty for illegal immigrants.
The bishops said all undocumented workers currently in the United States should be given a "viable and workable earned path to citizenship," not just those who have been here longest.

Gurus Pls help
I was with Company A whn I got married which had my visa and I 94 till Nov 08,2006. My wife wnt to consul. and got her visa and I-94 till same date.
I came back to US alone and changed to company B in July 06 and got my I-94 till 2009. Since my wife came to USA after that she didnt get her xtension.
i forgot to file for her xtension.
I had to agn change the company C in Dec 06. Thats whn i realised her I-94 expired in Nov. My lawyer said it shud be Ok since she has not passed 180 days after it has expired. or else she cud be black listed
Today lawyer got an email from USCIS saying they r waiting on security check on my wife. Wht r the options my wife has becos her 180 days will reach in May 08. Can she stay here till a decision on her is finalised by USCIS?

I think generally, whenever you have a pending case with USCIS, you can stay until the adjudication is made. that is common knowledge. If somehow it doesnt apply in your case, I think your lawyer would have told you about that. If you are not sure and want to be 100% sure, get all paperwork in order and call another good lawyer to get a second opinion as to whether your wife (or wives :D :D ) can stay or not.

My employer says that he has lodged my PERM in July 2008. As yet there is no news and neither does he provide any information regarding the status. Is there anything I can do to find out whether the PERM has been lodged at all? What are my options?
Try contacting the attorney who filed for perm (if attorney was used), don't mention that employer is not providing you any information. You don't have much options as you will need your employer's or attorney's login details for DOL website to check status.

I agree with all your options, but have to add one one more option.
Option 4: Get DOS to do the spill over allocation on a quarterly basis.
Lets not get sidetracked by Mr Skillz with a Z.
Options for EB3I relief:
Option 1: CIR - This is not in the picture right now. Nobody knows when this is going to happen and I think we should not even bother to look upon this as a short term measure.
Option 2:Recapture of visas - Again this has to go through the legislative process. With the current political climate, it is going to take a tough task to get this one in as well.
Option 3:Re-intepreting and changing the spill over rule: This can be done without any legislative changes and USCIS can be asked to look on this if we can really force them to.
Steps to execute Option 3:
* Collect and consolidate all the data in a spreadsheet from the latest 485 inventory to the yearly reports of adjudicated cases
* Create a what if analysis for the next 3-5 years for EB2 I and EB3 I
* Create analysis to show what will happen with the old rule and changed interpretation of spill over
* Create a nice presentation
* Contact Senators, congressmen, USCIS and walk them through our presentation
Hopefully that can change their mind or atleast we gave our best shot.
Add your thoughts and inputs and let us create a plan on executing this, if folks want to do it.

I wanted to renew my passport and i went in person to CGI Houston office . CGI Houston will re-issue passport the same day afternoon for additional $150 ( on top of $40 for processing fee ) . I was informed that i can pickup my new passport the next week if i opt for normal processing but I just asked them to mail my passport instead and i received it within 10 days .

Interesting thing I just saw on the CGI Houston website. Here is the link -

It says that effective April 7, 2008 only online applications will be accepted. Ofcourse one has to send the documents by mail. But another interesting thing that I saw on their site was that they say the following -
Processing time for applications received at the Consular counter is between 4 to 7 working days, excluding the date of receipt of application at the Embassy / Consulate.
Processing time for applications received at the Embassy / Consulate is between 4 to 7 working days, excluding the time taken in mail.
This means that irrespective of the method of application(mail or in person) the processing time is the same :)

I thought visa numbers are available equally per quarter and DOS is prevented from releasing numbers early. How can they say that all the visa numbers have been used (or will be used by April end)?

Q4: Jul-Sep
I think July visa bulletin would bring some good news when numbers for the last quarter along with the spill-over (if any), are released. If USICS is not as efficient we may even see some good advancement. Don't loose hope guys!!

The dreaded question! On everyone's mind, but we dare not ask. As you must know, the whole process is in an extremely delicate balance - please don't rock (read jinx) the boat by asking such questions! :)
Anyways, good luck to all eagerly awaiting their GC - and let's continue making our efforts at longer term relief (ala advocacy efforts, etc.).
