This has become a ranting thread of EB3 folks. One simple question:
How many of you EB3 India folks who are complaining actually went to Washingtno DC last month for IV Advocacy event?
I hear it was not even 250 people. If you take out all EB2 people, so few EB3 people. This means EB3 people do not really want to do anything but after every visa bulletin come to the site and rant.
We in EB2 do not have much to worry. Our dates will move fast. But you EB3 had a chance last month and you blew it by not doing anything. So stop complaining.
Were you there at DC ? I didn't see you there.
How many EB3 guys were there ? To name a few Aman, Logiclife, pappu. Is that an impressive enough list ?

What people are doing here is basically discounting the value of education. They are questioning the point of going to college at all (or to get a graduate degree), when you can just go to a trade school and learn a programming language that gets you a job. By that logic, why study history, biology, philosophy, languages, etc., if you eventually want to be in the software industry.
What people need to understand is that education gives you perspective. I don't directly use 95% of the education that I gained in many years of school, college and graduate studies. Does that mean it's worthless? I beg to differ, and so do my employers and people who work with me.

It is anticipated that INS demand for numbers will require the establishment of visa cut-off dates for April in some or all of the CHINA-mainland born and INDIA Employment categories�.
In May 2000. EB2 was retrogressed to 01JUL97 for China and 01APR99 for India
In December 2000 VB the big announcement came:
Greater availability of EB immigrant visas: On October 17th, the President signed P.L. 106-313. Title I of this law is known as the "American Competitiveness in the Twenty-first Century Act of 2000" and contains amendments to the INA regarding EB immigrant visas.
In fiscal years 1999 and 2000, due in part to the per-country limits, the annual limit for EB immigrant visas was not reached. P.L. 106-313 makes the following changes in an attempt to rectify the situation with regard to per-country limits:
Section 106 recaptures those EB visa numbers that were available but not used in fiscal years 1999 and 2000, creating a "pool" of approximately 130,000 numbers. These numbers could be made available to applicants in the EB1, EB2 and EB3 preference categories beginning in fiscal year 2001.
Section 104 removes the per-country limit in instances where the overall applicant demand for EB visas is less than the numbers available without regard to those limits. In addition, it is anticipated that heavy demand will require the establishment of a EB3 cut-off date on a Worldwide basis by December.
The amount of Employment demand for applicants from China and India is also likely to result in the oversubcription of the EB1 and B2 categories for those chargeability areas. The establishment of such cut-off dates is expected to occur no later than December.

My skills contributed this company to stay in competition with billion dollar companies ( xxx,xxx,xxx). My wife in similar field is serving xxx ( xxx ), Fort worth.
We are highly skilled professionals from India, and have plans to contribute even more by establishing our own company and generate more income.
Since last 10 years I have been paying my taxes,ssn,medicare without fail.
Mine and my wife's Permanent residency process ( Green Card process ),EB3-India, is stuck since last 7.5years and with current pace it may take another 4years, a total of 11-12 years.
I am not sure about the relief through CIR.
During now thru CIR interim, I request you to instruct USCIS to apply the spill over of unused employment visas in the order of oldest priority date and not by the by category.
Right now, the spill over benefit is helping the applicants who applied 3years after me.
If 1) spill over order would have not changed 2years back and
2) 245(i) applicants would have not clubbed into existing quota,
my life would have been in order, and I would have not bothered you.
Please help,

I understand your hard work. It is a big task as this is not your regular job.
Please continue your efforts. If you want to collect more money, then you need to send more emails. More and more members are needed as well.
Information are available in your website about the problems in GC process and the efforts taken by IV in fixing them. You have presented it very well.
I appreciate and congratulate the core team for all the efforts you take. I am not worried about the results. Our effort is important and definitely the core team is doing that.

My suggestions:
1. Combine labor certification and I-140 into a single process. It doesn't make sense to have two stages for employment based petition.
Advantages:
Candidate will know the result in a single stage. Once that stage is cleared he will know he is good to go from an employer perspective. Right now even after clearing Labor stage one is not sure what happens at I-140 stage. This leads to more uncertainty, worst case he will have to restart the GC process again if 140 stage fails after waiting for couple of years.
2. Ability to Pay requirement should be only for a few years ( 2- 3 years) from the priority date.
Right now if DOL/USCIS takes its own sweet time in processing perm/140 cases ( as happened for July fiasco cases), employer has to prove ability to Pay for all the years from the priority date. A company can close down, can go bankrupt in a recession during these long years. We have seen big wallstreet firms go belly up in this recession.
3. Pre-adjudicate all 485 cases within 18 months from the day it is filed. Once pre-adjudicated, the case should be accorded a FINAL status which means all processing requirement for the case has been met and no further RFEs can be issued on the case. Online status of the case should reflect the FINAL status.
Right now backlogged country candidates has to wait for a long time in uncertainty due to the current process. Once this change is implemented, candidates can have a peace of mind and guarantee that they will get a GC once visa number are available.

No one is saying that IV is ditching Eb3.Everyone(at least EB3 guys) is saying that EB3 needs special attention because it's movement is dead now.
While IV has not lobbied for any particular EB category but I think that is what they should be doing. Isn't one of IV's goals is to end retrogression ... so shouldn't EB3 be at least lobbied for since they are in such a mess ... I don't believe it sometimes that we are still in 2001.. that is 10 years back.
In a couple of years EB2 will be more or less current. So that means a guy who came two years back will file in EB2 and get his GC and I who has been working here for 12 years would still be waiting in line.
Some people say EB1 are brighter than EB2 and EB2 are brighter than EB3 . I find that funny because no one Eb1 or EB2 or EB3 is brighter than anyone unless someone has an extraordinary PHd or is a scientist . Its the lawyers who are brighter and how co-operative your company is.
Besides when we filed in EB3 categories there was no retrogression and hence no one cared or else we also would have filed in Eb2 and got our GC.

Got the PERM labor by 13 months. Applied on Dec 2005 got it now. Mine is EB2

Both Addresses will be printed on the passport. One for current address in USA and other for Indian Permanent address.
Application form is asking for address to be printed and other address. I am planning to keep my India address (my place) on my passport. I use my passport as a address proof in Inida. It means i need to fill it in address to be printed coulum.
What is the other address. Are they going to print this in passport as well. If they are going to print this in passport, can i give my India address here as well? Is it mandatory to give one US address (other address)? Please help me. I am trying to renew the passport and would like to keep my existing India address.
Application form is asking for address to be printed and other address. I am planning to keep my India address (my place) on my passport. I use my passport as a address proof in Inida. It means i need to fill it in address to be printed coulum.
What is the other address. Are they going to print this in passport as well. If they are going to print this in passport, can i give my India address here as well? Is it mandatory to give one US address (other address)? Please help me. I am trying to renew the passport and would like to keep my existing India address.
