How long does it take for a decision under EB2? I know the usual is 90 days but from your experiances is there a chance of an approval earlier?

Knowing that there are very limited H-1B available per year, do you think this situation is FAIR for the second person or his sponsor company?
Does “first-come-first-serve” or “processing based on date application received” ring a bell? And if second person’s application is not processed, that doesn’t mean that he is not the “best and brightest”, it simply means the quota finished. So why blame others who were ahead in the line and whose applications were processed. Acting like a frog will not make any of us any more human.
The problem is the way we are or would be affected due of some them are not so transparent immigration practices which are mainly from India.
Let see this case, a company sponsor a large number of H-1B to individuals that does not have real job offer, but look for real jobs after they get approved, while a second person does have a job offer but cannot get it because the H-1B quota was reached very early.
If more people on H1 come from India/China and not from Timbaktu, that is because India and China has 1/3 of the world population. It means 1 in every 3rd person walking on this planet is from India or China. If people from India and China consume more H1s and if there is only handful of people coming from Timbaktu, then why complain about it. Send in applications ahead of time because as per the rule, which I am sure no one on this forum wrote, the processing is done in the order of priority of when the application is received. And that is what all the companies are doing, beating the opponent in placing application from their company first.
One more thing, if the immigration bill containing green card reform would have passed last year, H1 numbers would have no t exhausted on day 1. Now please don’t blame H1s from India for the immigration bill not passing last year.

I thought those visas were only for schedule A workers and if you are not in that catagory, this doesn't change anything for you. Besides, recapture still hasn't happened yet so this is all with a big "IF".
I am jumping ahead of the situation here, but I just wanted to see what other members think/know. Assuming that the 90K visa recapture happens, It doesnt take too long for them to be used up in the current situation where there are a lot of people with labors and approved 140's (w/PERM). Not every one will have an oppurtunity to file for a new labor and file for 485. If DOS makes the PD's current / post Mar 2005, wouldn't it be unfair to people who labors are pending for 3 yrs. How does this work out in the previous recapture? HLG doesnt say about numbers being forwarded to the next year though.

USCIS website allows only attorney or employer to track PERM cases online. There is a way if your attorney or employer make sub-account and give you access to track your PERM application. Trust your employer and ask them to track your case for you. They did same thing for me because they created employer account for themself to track several peoples PERM Cases.

Finally the much awaited SMS/e-mail came through (from TSC). My guess is USCIS (TSC/NSC/etc) is approving cases at random as long as PD is current. There is no logic to Filing date / Notice date and all that. I came on F-1 10 years back (08/03/00) and was current for 2 months in 08 with no luck..... Please be patient... I know it is been frustating after a long wait and at times to see GC get approved for folks with later PD and all that after all we are humans and feel why someone was choosen today and not me ...... hang in there and I wish u all get that magic e-mail.....

two weeks for renewal of my wife's passport.
This was at Indian Consulate, Houston.
BTW, I added $20 to the fees for return overnite shipping. I didn't go there personally but sent it by overnite mail.
I guess you really were lucky to get away in 2 weeks...I have not heard any +ve stories for services at CGI Houston....Their customer service really sucks big time....Its unimaginably tough to speak to a person when you call, on top of that, if you get through, they are very rude to talk to....You are just helpless.....I did send my application via overnite fedex with a $20 fee for express mail and it reached them on Oct 26th.....Hopefully, will hear from them soon.....I will post an update if there is one.....

From what I heard when I was in a similar situation, the last approved H application would become her status. Meaning, if you apply for a H1B and a H4 later, if the H4 gets approved after her H1B, her status would automatically revert to a H4 because that was the last approved H application. If her H4 renewal is part of your H1B renewal, you could do yours as a permium processing application. That way, her H4 approval might come through well before her H1B approval.
To answer your last question, if you did not show a valid I-94 till Oct 2007 while applying for her H1B, her H1B approval would come through without a I-94 attached. If that happens, she will have to get her Visa stamped out of the country. Otherwise, she could potentially be without a valid I-94.

people this is such less amount, ready to pay so much money for renewing visas etc, but you can't sign up for 20 or 50 every month. This is really becoming like begging..I do understand everyone has family commitment and other financial need but $20/month is not too much !!

--> the cir menendez bill has all the border control provisions that the republicans want (in fact, it is entirely what they want) - so one issue is addressed.
--> illegal immigrants who are already in the country - record number of them have been deported in the 2 years under this administration (more than the republican presidents in the past!), trying to deport them all will take billions of dollars (which the govt does not have - or will it be charged on the legal immigrants?). Yes, one should not support lawbreakers, but just saying that does not solve the problems......what proposals are there that will address the illegal immigrants? nothing.
the talking points are:
border control, we are against amnesty. NOT GOOD ENOUGH. Provide solutions, if not a path towards legalization with due fines, what alternative do you suggest?

Frankly, I have not yet heard any noise being created regarding H4s converting to H1s and joining the workforce, legally.
If someone who came here on an H4/F2, upgrades their skillset via formal education (no issues in this case!) or via professional training and the ability to fake experience and sell it to land a "project" (no legal issues here, only moral issues and hats off to their guts.. How do they do that??) then they absolutely deserve to be in the workforce.
There is a lot of noise about H1Bs but most of it was focussed on Indian IT giants locking up the H1Bs by the 1000s and (in the anti-immigrant lobby's words) "bring in cheap labor from India". Another blemish brought about on H1B is "gross exploitation of systemic loopholes by IT consulting companies (mostly owned by Indians) ". These issues are being addressed by USCIS by increasing scruitny before issuing new H1B approvals.
If your company has played by the rules, your credentials are not flawed, there is very little to worry about.

I run my filters in the night and then in the morning for pre .
You can put in a conditional order and let it work...........but it is better if you moitor it .
