    Thanks manojp4, appreciate your help. Just to clarify my doubt, she would need to file a 485 anyhow, before the dates retrogress again, right. Would it matter if I included her name in my filing, along with the marriage certificate. I guess all I am trying to understand is I know 100% that I will be married before I file, would that help her in anyway, lets say if the dates retrogress in August and she cannot file till then.

    NEW YORK -- By now the shipping container carrying Jonathan Langan's material life in the United States has arrived in Ireland. The plush green furniture, his American flag and the construction tools of his trade are all gone from his Queens apartment.

    Langan, a lanky, red-haired Irishman, was bidding a final farewell to his adopted country. He didn't leave for want of work -- his fledgling construction company was booming. Success was his problem. The more prosperous his company became, the more Langan feared he would get snared by immigration agents.

    "You don't want to give off red flags because you're not supposed to be working," said Langan, 24, who lived illegally in the United States for three years. "It's too dangerous, what happens if you get caught."

    The green is draining out of the Irish immigration boom that revitalized neighborhoods across New York over the past two decades. Fear of getting caught in a post-Sept. 11 net coupled with the booming economy in Ireland is drawing thousands of Irish back to the Emerald Isle. Numbers vary on how many have left: The Irish government estimates that about 14,000 Irish returned from the United States since 2001, with more than half of them coming from New York. The Census Bureau reported that between 2000 and 2004, the Irish population throughout the United States shrank by 28,500 people, to 128,000.

    A more vivid picture of the exodus is the Gaelic downtown of the northern Bronx, on the border with Yonkers, where green signs and shamrocks decorate store windows.

    The Padded Wagon, a popular moving company among the Irish, shipped 30 containers to Ireland in the past three months, each containing the possessions of an Irish family. The Irish games -- Gaelic football and hurling -- have suffered losses. More than 200 players returned to Ireland in the past year, said Seamus Dooley, president of the Gaelic Athletic Association, which has its games at Gaelic Park in the Bronx.

    Last month, the Irish minister for social affairs visited New York, to unveil "Returning to Ireland," a guide for Irish preparing for a permanent return trip.

    "A travel agent was saying they had sold 1,700 one-way tickets to Ireland," said Geraldine McNabb, an Irish-born naturalized citizen, while she sipped a cranberry cocktail at a pub. "They're not coming back."

    Post-Sept. 11 security procedures have disrupted life for the city's undocumented Irish, who number about 20,000, according to estimates by Irish officials and activists. Few experience immigration raids in their homes and job sites. In 2005 just 43 Irish nationals were deported from the United States, none from the New York area, according to U.S. immigration officials.

    But federal and state policy changes, the fingerprinting of foreign nationals at airports and a crackdown on driver's licenses have made it much more difficult to hop a plane to visit relatives or drive a car. And tighter scrutiny of banking transactions to prevent the financing of terrorism has scared off families and made starting a business far more dicey.

    "What's more alarming to me is people who've been here for years and years are packing up. Families are moving," said Nollaig Cleary, president of the women's division of the New York Gaelic Athletic Association. "You've had the community people who set up business and their families, they're going."

    Brenda Flannagan, 31, immigrated illegally to the United States in her twenties, looking for adventure. Now she has a husband and a baby, and is looking to settle down. A trip back to Ireland to visit her parents could leave her open to discovery by immigration officials -- so she is going home for good.

    Raising a child will only compound her difficulties here. "You can't drive. It will get more difficult," said Flannagan, who expects to leave in the fall. "Things like play dates and after-school activities."

    With fewer immigrants pouring in, and so many Irish packing up, pub talk revolves around the question of the survival of the Irish spirit in New York. Irish immigrants poured in by the hundreds of thousands in the 19th century and again in the early 20th century.

    A third wave came in the 1980s when the Irish economy tanked, and it rejuvenated Irish culture in New York, as politically inspired Irish rock and hip-hop bands worked the club scene, and Irish theater and poetry spread throughout the city.

    "You have a great Irish neighborhood beginning to crumble," said Niall O'Dowd, publisher of the Irish Voice and chairman of the newly formed Irish Lobby for Immigration Reform. "Unfortunately Americans are mixing up terrorism and immigration."

    The Irish, however, retain considerable political clout. Fifteen years ago, they successfully lobbied Congress to direct tens of thousands of green cards into the hands of undocumented Irish.

    O'Dowd and other activists recently rallied the fighting Irish spirits at Rory Dolan's pub in Yonkers, as they begin lobbying for an immigration reform that includes a path to citizenship.

    The Irish government contributed 30,000 euros, ($40,000 at today's rate) to the effort. Tim O'Connor, Ireland's consul general in New York, stresses that the United States played a vital role in helping to stimulate Ireland's economic boom with investments.
    "It's in the interest of both countries that we have people who have the ability to go back and forth between both countries," said O'Connor, noting that 15 percent of new businesses in Ireland were built by returning Irish.

    Some Irish take their leave with optimism, looking to the jobs and construction boom in their homeland.

    "Everything is so good in Ireland," said Flannagan, while her husband, John, a carpenter, was at the pub enjoying "a few sociables." "There's a lot of construction work for the guys."

    Flannagan held her baby girl, a U.S. citizen and last link to the United States. "Maybe she can sponsor us when she's 21," she said. Then, she added, "I think the notion of coming back, by then, will be gone."

    Has any of you guys heard of "Follow to Join". I believe that if you are "legaly married" before filing I-485 then you should be able to bring your spouse in whenever your GC is approved. If your GC is not approved by the time you get married i think she should be able to come in under H4.

    Not before filing I-485 but before your I-485 approval. You are safe even if you marry 1 day before approval.

    I'm in a similar situation but more complex. My fiancee was in the US on J-1 visa and had to go back because of 2 year Home residency requirement. I have e-mailed my attorney but she's on vacation until next week. I have my 140 approved and am not sure what next step is as my fiancee's j1 2 year HRR is not up until Jan 2008.

    For me the frustrating aspect is that my first son is in college. Arizona State University is forcing me to pay out-of-state fees and have stated that I could only pay in-state tuition after filing I-485! So the money I could have invested in business is going to college tuition. Another son is in senior class in high school and will be going to college next year. Yet another son will be going to college in 2008.

    I have thought of going back to Nigeria but I'll like my sons to finish college here. So, I have decided to stay until I get GC. My wife and I are both studying for Masters (another big expense for us!).

    We spend most of our time between studies, volunteering and other community activities.

    Could others on this forum who have college-age kids tell me how they and their families are coping with expense of college tuition?


    I believe that it depends on the state. I don't have any kids but my wife is going to school here in Virginia. The rule here is you don't need a PR to qualify for instate tuition. If you are on H4, you qualify for instate. But dependants on F1 visa don't qualify.

    The only downside is H-dependants cannot work in on-campus jobs and they won't get CPT/OPT. I believe that a good work-around in such states is to be on H4 for first three years and then change to F1.

    I have contributed $200 to the Omnibus fund drive and intend to contribute a lot more in the coming months. However, I would not have been a member of IV if this were a paid site.

    I prefer that the contributions are voluntary and I am an example of someone who joined IV as a member and then CHOOSE to contribute to the cause. If IV had asked me to become a member by paying $200, I certainly would not have joined.

    I vote to keep the site free and allow free flow of information. By making this a paid site we hurt the cause that IV is fighting for and we hurt potential members who would contribute.

    I want to ask members who have contributed $500 - $1000, if this site asked that much for you to join would you have joined? If so would you continue to contribute after paying this much money? After paying money to a pay site there is a sense of entitlement that people feel. They feel that they have already paid their due and they will not contribute additional funds thinking that they have already paid once when choosing to be a member.

    I urge the administrators and core member to please keep this site voluntary and free.

    My lawyer put in a SR on Sept 1. On Sept 11 i recd. the email saying that i was approved. My situation was similar to yours. Same company for 8 years, no RFE - infact no updates on my online status since Sept 2007 when it was first updated to reflect the fact that the application was recd at NSC. So i am assuming that SR triggered review of the application but with USCIS who knows.

    Hopefully you will get your approval soon if my case is any indicator (admitted the sample size = 1)

    WASHINGTON � U.S. Senator Pete Domenici today introduced legislation to reform U.S. immigration laws, recommending a strategy for dealing with millions of illegal workers in the United States and improving guest worker guidelines.

    Domenici today offered the Welcoming Immigrants to a Secure Homeland (WISH) Act of 2006. The comprehensive measure is the second major border/immigration bill offered by Domenici, who believes in a two-step reform approach�secure America�s borders and reform immigration issues. In November, he introduced the Border Security and Modernization Act (S.2049) to address border security issues.

    �As a border state Senator and the son of immigrants, I have a unique perspective on immigration. I understand the need to provide a secure homeland for my constituents who see the problems caused by illegal entries into our country every day. I also understand the need to welcome immigrants to our country, so that America remains a country where hard-working, entrepreneurial, and intelligent immigrants can prosper,� Domenici said.

    The WISH Act would authorize a series of reforms to U.S. immigration laws including:

    � Improving immigration law enforcement

    � Creating a new guest worker visa

    � Establishing a process for illegal immigrants in the U.S. to gain legal guest worker status

    � Improving foreign student, highly-skilled worker and visitor regulations

    �The time is right to fix our immigration laws, which are not working properly,� Domenici said. �My bill strikes a sensible and realistic balance between cracking down on illegal immigration while encouraging legal immigration. Slamming the door on immigration or unilaterally deporting millions of illegals already in the country is just unrealistic.�

    Domenici said he will encourage the Senate Judiciary Committee to carefully consider his WISH Act and S.2049 as it readies comprehensive border security and immigration legislation for consideration in early March.

    Domenici�s bill would increase the number of Department of Homeland Security personnel to investigate human smuggling, employment of illegal immigrants, and immigration fraud. The bill would also increases penalties for violations, as well as provides a system for verifying worker employment eligibility.

    The bill would create a guest worker visa for up to three 3-year periods (9 years total) for immigrants to gain legal entry into the Unites States, and potentially apply for permanent resident status. The bill would allow 500,000 such visas the first year, with subsequent visas increased based on market need.

    The measure establishes a program to allow illegal immigrants now in the United States�estimated at up to 12 million people�to apply for legal guest worker status. This proposal entails paying a fine and obtaining a legal guest worker visa.

    The bill would clarify the limitations and restrictions placed on student visas after 9/11 in order to allow high-tech foreign workers and full-time foreign college students to study, work and travel in the United States. It would also establish a means for foreign students who graduate with honors to be allowed to work in the United States.

    The following is a summary of the major provisions of the WISH Act:

    >>> IMPROVE ENFORCEMENT

    ? Requires DHS to add new investigators and enforcement agents to curb human smuggling, hiring illegal aliens and immigration fraud, and add more personnel to process student visa applications.

    ? Increases penalties for aliens working illegally and employers who hire illegal aliens.

    ? Requires social security cards to be machine-readable and tamper resistant.

    ? Provides for employer participation in a system to verify the employment eligibility of aliens and to track aliens� employment.

    >>> PROVIDE A NEW GUEST WORKER VISA

    ? Creates a guest worker visa for aliens to legally come to the United States with their immediate family, work, and travel for up to three 3-year periods. The alien must undergo a medical exam and background check to qualify, and must remain employed to stay in the United States. These guest workers would be allowed to begin paperwork for a change of status to permanent resident after they have been in the United States for 6 years under this visa; if they do not apply for a change of status, they must return to their home country upon expiration of the visa for at least 3 years. Failure to depart upon visa expiration would mean that the alien would be ineligible for any immigration benefit except asylum for 10 years. There would be 500,000 visas that could be issued in the first year under this section; this number could be increased in later years based on market need.

    >>> ALLOW ILLEGAL WORKERS TO BECOME LEGAL WORKERS

    ? Creates a program to allow aliens who are illegally in the United States to obtain the above-referenced visa without leaving the United States. The alien would have to pay a fine for being in the United States illegally and go thru the same application process as aliens applying for the visa legally. These aliens would have to apply for this visa within three years of enactment of the WISH Act. If an illegal alien fails to apply for the visa and remains in the United States illegally, he would be removed and not allowed to apply for any immigration benefit except asylum. After being in the United States 5 years under this visa, any alien who had been in the United States for 5 years prior to the date of enactment of the WISH Act would be eligible to apply for a different visa (but not permanent resident status), but such a visa would not be issued until the alien left the country and reentered thru legal channels. If no new visa is acquired for such aliens, and for all undocumented aliens who have been in the United States less that 5 years before enactment of the WISH Act, when the initial visa expires (after up to 9 years, assuming the alien renews the visa and remains employed), the alien would be required to leave the United States for at least 3 years. Failure to depart when the visa expires would make the alien ineligible for any immigration benefit except asylum for 10 years.

    >>> CREATE A MORE WELCOMING ENVIRONMENT FOR STUDENTS AND TRAVELERS

    ? Removes the cap for H-1B visas for college and non-profit professionals and the world-wide numerical limits for visas issued to aliens who have earned an advanced degree in science, technology, engineering, or math in the United States.

    ? Allows full-time foreign college and graduate students to work part-time while studying in the United States.

    ? Allows foreign students who graduate from a U.S. college with honors and who have a job offer in the United States to transition from a student visa to a work visa without leaving the country.

    ? Allows foreign students to travel outside of the United States to attend a seminar that is related to the student�s chosen field of study.

    ? Allows guests who are in the United States temporarily on a B-1 (business) or B-2 (traveler) visa to travel no less than 100 miles from the international border during their trip.

    I have posted the exact same question on Rajiv Khanna's website.
    He did answered this question. According to him this is possible and also asked
    him if i need to go out of US to get the H1B stamping, he replied this is NOT requried and
    the new H1B Transfer will be approved with I-94 attached to it.

    I have had v.bad experience with them ..don't open a account there ..they will harass you like anything to send this documents and that ..for me they did the same and kept my money for 9 months without paying any interest. I will post the email that I had recd from them . they even misplaced the draft which had my principal

    I took visitors health insurance from ICICI Lombard.
    There was some typo in the date of birth ( my mistake actually)..so I wanted to correct it..The callcenter ppl told me that once policy is issued you cannot make any changes to it..they advised me to cancel the policy online and buy another one..they will return the money for cancelled one.

    So I cancelled the policy and took another one.
    They sent the cheque to my parents house after couple of weeks for the cancelled policy and they deposited it to ICICI Bank account.

    Now the fun starts..the money never came into my account.

    For the next 8 months, I was BBQ'd, did a sheek-kebab of myself without any use.

    Finally, I got every email ID that ends with @icicibank.com and whereever there is @icicixxx.com and sent out an email blasting everyone..then also sent an email to icici bank manager from my online service manager.

    Finally I got a response saying they deposited the amount already 8 months ago..I was so pissed off..I took a screen shot (.bmp) of my account for that period asking them why cant I see the transaction here..

    then after a week, they emailed me saying, the amount was deposited to wrong account..means someone elses account..LOL..

    Look. There are 2 sides to a coin. I was a victim by my previous employer, who is a global corporation (120 k emp), who couldn't succeed in US market.

    I know many small and medium companies ( and I refuse lable them in any other way) who are good employers and who truely furthered and moved the GC applications.

    This talk is not correct. The situation is due to a visa regime (regime=tight control on every aspect), neo-conservatives dictating and bulldozing policies, bums and incompetent lawmakers (some of whom get thrown out each 2 years), lack of budget and personnel (and yes, Iraq is sucking everything out) and importantly lack of organization or godfather to look after our genuine needs.
    IV stepped in and is doing a yeomen service and we should be proud of it. Results will come.

    All Indian owned desi companies are cheaters.

    Took an infopass to find out why my spouse's case was not approved. A rude IO told that the background check was not completed yet, and it would take 30-60 days. Asked us to wait for 30-60 days. She looked and talked rude, so I did not ask her "if the background check was started or not". So, the question is how to expedite the background process, so that it will be cleared.
