I agree that the current political climate is so screwed up that, they are not doing anything except in a reactionary way. Part of it is a lack of visionary leadership, "W" has hardly been able to unite the country behind much legislation. The Congressmen have been too entrenched in political gamesmanship and more interested in political survival than the broader national interest. Nothing illustrated this more than the recent bailout legislation. Noone liked it but clearly there was no other option either. The lack of conviction in the way congress approached it however means, they spent 840 billion (instead of 700) and even that seems too little too late. And it might even end up being the first of many more bailouts. Sometimes you indeed can be too late to help out and drag it out more than necessary. Much is all about perception and confidence. Finally, vocal special interests who have selfishness and ideology at heart have no doubt contributed to this toxic mess, and elected officials seem less and less able to divorce themselves of their undue influence (it was not always that way in this country).
The one saving grace is that an election is in the offing. Honestly it will be a breath of fresh air, no matter who is elected. Someone can then project some leadership and actually get something done. This last 4 yr term has been especially useless in terms of getting anything at all done, not just on the immigration front but any front at all.

I'm also going to do a FOIA request for my I-140 that got approved in Jan 08. Employer is saying its their petition and they wont share it. I'm not going into argument because they revoke it now - The Legal Immigration system is too weak and too much lopsided to a "employer" rather than on the "individual employee"

No, I-140 must be active in order to extend H1-B beyond 6 years.

My point is if we check our credentials, how many of us are 'true' innovators? I know I am not, I am an expert in what I do and am an asset to my company but I haven't filed any patents or publications which would be the true requirement for this country. My skills are indeed readily available in domestic workers as well. Could that be the reason for the backlog in EB-3 and none in EB-1? So do we need to do a reality check here? Just wondering if this could be the reason why we're getting a raw deal. Could it be that 'highly skilled' is not enough but 'genius' and 'highly skilled' is what's required here? Just a thought.
I sit next to am all American worker who has 30 years of experience, has 3 master's degrees and claims some major achievements in his technical life. Facts: I had to set his browser's proxy multiple times so that he could connect to the internet. He does not have 1% of the skills he claims and the word is out that he will be laid off next week. Although I am sure he has a membership of Programmer's Guild and IEEE and all that (he wears soda glasses , and it really makes him look brilliant). The point is , cases such as these make our presence here viable.
I have more examples of such geniuses I have seen over past 10 years.
It is not a secret that all of us are not innovators.However one must accept that there is a shortage of people who can run these operations.In my professional life , I have not seen a skilled American unemployed. Financial reasons may force a business to lay off a good worker. However, if you are good , you get a job instantly.
I am lucky to be working at a place where your skills are more important than your nationality.

Everyone who changes jobs under the protection of AC21, must do so under the assumption that the sponsoring 140 will be revoked.
It is not a matter of our convenience. If you quit the sponsoring employer and he has no intention of hiring you again after your GC, then what is the sense in him retaining your 140 for no reason? It only adds complexity to some employers as dangling 140s are counted to evaluate their ability to pay. So even if it is not law, it makes sense for employers to revoke 140s of employees who quit them.
AC21 protects you from such a revoked 140. We have seen some cases where revoking the 140 - even after the 180 day mark - has resulted in 485 denial. This is a mistake from CIS and is easily fixed.
Expecting the previous employer to hold on to your 140 is not very different from expecting him to keep your you previous job open for you - just in case.

So they refused to acknowledge that it is pending more than 90 days?
They are technically right, the regulations say "within 90 days from the date of receipt of the application".
Talk about broken promises. Write to the USCIS ombudsman.
Emails to USCIS ombudsman just generate a standard response, nothing more, asking to submit form 7001. They should be swamped with 7001s by now, so they should create a processing-times for the form7001s.

I know few states have their own set of rules for license renewal or for first time license issue, but not sure whether entire US states are asking for more immigration related documents during the renewal and that too taking 9wks verification as you said, nt sure whether it is true...
may be IV core team should open a link, should ask everyone to post if they had similar experience recently in their states so that we can find out more fact abt this issue.

My Wife's I-140 RD is May 9th 2007 and it was filed at Nebraska center.
Online Case status says that this case was transferred from Nebraska Center to Texas center in end of april 2008. So now this case will be processed using the original Reciept date or it will have a reciept date when this case was transferred? Current processing date is way past then her original RD.
We have to file for her H-1 B Extension and it is critical to get I-140 so that we can extend it for 3 years instead of one year.
Please let me know if someone has any info...

My understanding was that once the 485 is filed, you go by RD. It doesn't matter what your PD is...

It DOES matter what your PD is. USCIS apparently does process FIFO according to your Receipt date - BUT ONLY IF YOUR PRIORITY DATE IS CURRENT will you get a visa number assigned (i.e. approval of said greencard).
I say guestimate, because in reality - its all speculation, because not even USCIS knows how many current applications they have. I'd have to say it is more like 1 million pending applications.
Don't assume that your PD being "old" helping at all. Let's play a quick hypothetical game...
Picking some numbers (and I think I'm being REALLY conservative here). Say there are 40k EB applicants from India a year.
Let's even say that 10K of them are EB3 (inc dependents). EB3 India PD as of April this year was May 2001.
So... a PD of 05 means that there are 40k EB3 India applicants in front of you. That alone, and not including EB1 and EB2 that come before EB3 category, is about 4 years quota of greencards.
I'm ROW, EB3, PD 2004 and AOS was filed June 2007 (I got stuck at BEC for sometime) - my situation is comparatively ROSY compared to other nationalities with a similar PD - but I anticipate that I'LL be lucky to wait 3 more years. You can bet if ROW with early 04 will take about that time, India will take YEARS longer.
And that is why I'm here, telling everyone to stand up and go to DC.
Without significant change, it will be a LONG LONG wait still, despite the security of AOS being filed. Can you wait 3 years longer for a decent promotion, or change of career? How about 5, 7 or 10 years? I can't - so I'm flying 3000 miles to be in DC :)

I revisited this thread today and saw several heartwrenching stories of some of our IV members. One way for IV to help you is through letting your situation be known to others via media. We have a few opportunities and if you are interested please send an email to himanshu at immigrationvoice.org. Do not PM me since my PM box gets filled very often.
It will not only help all of us generate awareness about our plight to american public, lawmakers too will be influenced by the magnitude of problems we face while waiting patiently in line for several years. I feel media is a great tool and we can use it very effectively when we all can get our message across in the world outside of this forum. Once we get IV members ready to volunteer for such interviews and to talk about their plight, IV will try its best to get their voices heard.
It will not only help all of us generate awareness about our plight to american public, lawmakers too will be influenced by the magnitude of problems we face while waiting patiently in line for several years. I feel media is a great tool and we can use it very effectively when we all can get our message across in the world outside of this forum. This is like the banana joke in an old tamil movie, it is over 157 days and the USCIS now wants to go by processing times which mention july 3rd processing date, which is still late, but then they will say it is just one day over your receipt date.
If I were planning to use my EAD now or in the near future I would just cough up $380 and apply for a fresh EAD instead of chasing USCIS.
If it works, then it is money well spent compared to running back and forth to USCIS offices, calling them daily and all the painful aggravation involved.
I will gladly spend 380 instead of risking the possiblity of picking up Diabetes or Blood pressure due to stress.
If I were planning to use my EAD now or in the near future I would just cough up $380 and apply for a fresh EAD instead of chasing USCIS.
If it works, then it is money well spent compared to running back and forth to USCIS offices, calling them daily and all the painful aggravation involved.

Please check you investment account balance and find out how much actual money goes to your account, there are hefty financial charges for whole life, Prudential charged me $62 as finance charge and $16 as insurance cost out of $116 monthly premium rest $42 went investment account.
why would any one pay 70% as a financial charge?, I canceled policy....
