My PD is April 2002 which has become current as per the june bulletin. My I-140 was approved in April 2007 and the NVC created the case on May 15th 2007.
I have opted for consular proceesing.
My questions is at what stage of the further processing do i get a visa number allocated ?
Is it when NVC sends the fee receipt to my attorney or is it when the case is transferred to the consulate ?
I just want to know at what stage now i become insulated from any possible retrogression in the coming months.
Any help much appreciated

This is not 100% relevant to this thread but since we are discussing APs here, I thought I will ask the question.
Do we need AP to go to / come back from US Virgin Islands? I know that these islands are U.S. territories and should be nothing more than going from one U.S. state to another. The reason for my question is that the DOS website states that for travelling to USVI, the U.S. citizens should carry a Photo Id AND Birth Certificate to establish the U.S. citizenship. Many websites state the same thing and some sites mention that this is because of nearby British Virgin Islands. As you can just take a ferry and come from British islands to U.S. Islands, the Immigration authorities on Mainland need to check your immigration status. This is not the case for travel to Hawaii or Puerto Rico.

Guys,
I think we are getting sidetracked here. I think the question for most people who have spend over 6 years in US is that:
1. Education is very different in US/canada compared to India/Asia. Its geared towards creativity as opposed to rote learning. It will take a lot of time to adpat to that system.
2. The competition is definitely way tougher in India/Asia.
3. An average kid has better chances at a financially successful life in canada than in India/Asia.
Coming to the question of ourselves as adults finding jobs in canada ...
I think its definitely going to be easier to find jobs in Bangalore than in Toronto. Offcourse, comparing canadian market to US is pointless. We know US market is way better. Then again we are just talking software jobs. If you keep your mind open to any type of management position or business opportunity I think you will have better opportunity in Canada than elsewhere in India.
Does anyone know of any discussion forums of software guys who have moved from US to canada?

I am sorry but I disagree with the "best among the best" comment. To equate success in the IIT entrance exam to being the best is a mistake. Nothing significant is expected from this speech. Most politicians repeat the same 3 things- Secure our borders, provide path to citizenship to millions and welcome best and the brightest. The real question is when they will do the real work on immigration. There have been some discussions on administrative fixes on immigration. However some of these fixes would politically harm democrats in the upcoming elections.

I am filling out the form G-639 to obtain a copy of the I-140 approval notice. I am little confused about section 6 and 8.
In section 1, I indicated that I want the information under the FOIA. It is indicated in section 1 that I have to complete all sections except section 6 which is the "Verification of subject's Identity". So if I don't have to complete the section 6 then I also shouldn't have to do any notary in section 8, right?
It appears that section 8 is related to section 6 and I should be able to skip both. Any ideas guys. Thanks.

I checked with some folks who have got GCs in the past and they mentioned that FP (2nd time ) is not needed.....unlike the minds of USCIS one's FP doesn't change over his lifetime...that said..if you apply renew EAD u can get FP notice....

I do agree an aggressive lawyer who knows the system would've put me in a much better situation.
After you wait for 7-8 years in your category for your visa your thougths will change. I have MS from an american university + work experience. Our lawyer decided to file EB3 in 2001, they convinced the company that EB3 is easier to get approved. i am still waiting for my GC, in the mean time i have gained a lot of experience, i am still an EB3 for USCIS. There are many in a similar position.
People talk about unethical practices etc. i feel that they ones who jumped the queue and used agressive lawyer already have their green cards. Most of my friends are already thinking about citizenship (and ROI after USC..that is a different forum :)).
Its people working in multinational companies who follow the law by the book are the ones who get screwed, its just my observation and opinion ..good or bad, i dont know...

Just talked to my lawyer..he said even if we win the case...eligibility is based on the court order...court order may allow every one or only limited people who are in the class action...and in murthy.com they clearly mentioned that, USCIS MAY look at the apllications very closely who are in the class action....who wants that..

NK2006 thanks for the post my family and I recently entered US using AP and fortunately we were not questioned at POE. I am in similar situation waiting for 485 and filed AC21 when I changed jobs after six months.
That is not to say that we will not have problem in future. You mention your wife showed them a copy of rules pertaining to AC21. Can you post a link or post them here.
My lawyer never advised me to carry any such documents.

What do you mean by working? Is this just your idea or you have some information on the effects of this campaign?
I am not saying that it is working on the USCIS. We dont know yet coz the flowers start reaching there tommorow. If it is working on USCIS, we would know by the end of the week. Not now.
But it is working on the media.
What I am saying is we are getting a good amount of attention from a lot of newspapers - which is important to create more awareness on the plight of half a million law abiding immigrants and the backlogs they are facing.

What is the benefit of applying for an OCI card for the kids and how long does this process take?
the kid does not need a visa to enter India. Also, if you go on a visitor visa, then your stay is limited to 180 days at the max. On an PIO you can stay how ever long you wish to, but after 180 days, you need to register with the district police station to get a certificate of extension. this is usually valid for about 2 years. you can renew that every 2 years.
If you are on an OCI, then the above restriction on PIO does not apply. You have all the prvileges of an India citizen, except that you cannot vote and hold agricultural land.
I am not sure about sutdying at Indian citizen rate. You might have to pay the fees in USD, if i am not mistaken.

This is def not right...I checked out the 'News' section (see link below) on the website which published the bulletin...how come they have published only the Sept bulletin and NOT any other month's bulletin....

As you all know, they ask me to sign their contract in which its mention that if i leave their company before 1 year then i need to pay them 15k. Thy also charge me 3k for my H1-B which i am still paying everymonth from my paycheck and we have 70/30. In just six months i am so much fed up with them. These people are so rude...always show their arrogance over phone. I have no libarity to find job by myself. They always looking for higher pay rate sp that their big money tummy get filled up.and i also feel that they didnt told me the right pay rate for the project i am working on right now.
I really want to leave them, Even before 12 months. Is there any importance of that contract letter i signed with them?. Can they Sue me? What are my options? Please suggest me.....i am in stress.

ya that explains.... so u'r some 20 yr old who need to grow up..... have to learn that sometimes there is a lot more to what just what you know......
and why would you prefer maths.... dummy, didn't you know, we have calculators & computers to do simple and complex calculations.....
btw, for starters, what've you achieved? if the answer is nothing.... then learn to appreciate others.... maybe that might help to be humbled at the effort and genius of 10 yr old.....
going for a competition with international participants, then being in finals of a competition & then winning the a competition at this level .... wow.... and you are not impressed..... and not that u'r not impressed, you have nothing better to do on a friday... other that demeaning the effort of some kids, who for sure are a lot more dedicated than what you be in u'r entire life..... what a low life r u....
how @ u share the last time you were went to compete with other competitors at international level at any age group.... even if it were competition to down play what other's have achieved...... i don't think you can point to a national press covering you for even participating, if not winning, any competition.....

Those 80% who bought homes, a whole lot of them have been able to survive because of the July 2007 fiasco. Without EAD it would have been a totally different ballgame.
Also a lot bought home in pre-credit crisis era when 5% down etc was available. But now 10% or if not more is the norm. So you will have a lot to lose if you default or leave country.
A friend of mine who got GC in end-2006 was discussing with me in 2008 whether to buy or not (he did not buy at that time...I don't know now in 2009 whether he has bought or not). The reason is that just because one has GC does not mean one has to commit stupidity when prices were plunging.
One needs to weigh all options. I see no GC in the horizon for EB2/3-India for non-EAD people. The political equation is stacked against EB2/.
House prices wont recover for many many years. The early 90s correction took a decade to recover.
If you are not on EAD and your pd is in 2006 or later, then it makes no sense to buy a house financially (though it is a ok time if you have EAD/GC but can wait more).

I am in CP and I am writing to them to allow CP filers who are already working here in the US to file for AOS (even if the PD is not current) anticipating a very long delay for EB3 I. That way we could get atleast the minimal benefits like EAD, AP.
If any CP filers from EB3 I wanna join me, more than welcome!
