Here is my situation:
I-140 approved - PD: May '06
I-485 filed - July 30 '07 (India)
EAD cards - Received
APs - Received
Due to a slowdown in their business, my employer is laying me off in Dec '07. I'm still short of 1 month to complete my 180 days of I-485 filling. However, they said they will not withdraw my I-140 and, to help me, will in fact keep me on their payroll until Jan '08, with my Jan '08 salary as my severance and my official status as on "paid leave". So far, so good.
I also have a job offer, and my new employer wants me to join them in Dec '07, on EAD. My question is: Can I be on officially on the payroll of two companies simultaneously on H-1B and/or EAD? If yes, do I need to inform the USCIS of my status (new employer; AC21)? My other option is to say No to the new (attractive) job offer (or to try to convince them to wait until Feb '08, which they'll likely not agree to), and and take up another job in Feb '08, on EAD / H-1B transfer, using AC21. Please advise whether I'm fine with using the first option!!
you can be on the payroll of 2 companies on H1 if the H1 petition says that its for concurrent employment. On EAD no such issues, you simply sign new I-9 forms with both employers.
If you are moving to EAD, you can start with second employer right now. If you are going to stick to H1 for some reason, then delay joining the new one by just a few weeks. By the time they file the H1 transfer and the approval comes through, your 180 days will be done or nearly done and you are all set. Its nice that your current employer is helping you out through the 180 days.

Some online tax return websites have capabilities of pulling your W2 information from IRS site. I know turbotax does. Print out all those copies and your pay stubs. Send it to IRS with letter stating your problem. Before you do please apply for extension as april 15th is last date for tax return filing.
My wife worked as a consultant for first half of 2008 with a desi employer as an employee (on W-2). After many calls and emails we received W-2 Thursday that has income and taxes of only first two months. Now he says that he showed remaining 4 months as his profit so he can only send 1099. Please advise if I can take any legal action against this employer.

I agree. even if we dont change the names. Have multiple domain names which reflect more of high-tech, skilled, or other keywords related to high-tech immigration... just a thought.

My wife changed her job after getting H1B transfer receipt. Her previous H1B is not expired or revoked. After one month with new employer, her H1B is denied. We didn't appeal, but immediately filed new H1B with another employer and give paystub of the denied employer with all details. She got her H1B approved with the latest employer. This happened 4 years back.
So, if H1B denied, you can file appeal or find a new job and file new petition ASAP.
Looks like you got angry.Everybody knows H1 requirements as much as you do.Do you think are the only one who is smart in this world.I don't think so.

But again as I mentioned before, if US has shortage of skilled workers, they can fulfill the shortage within few months. If we all go, another batch of temporary workers can be brought in without any loses, that too in few months (On some different VISA if H1 B is abolished), so I don�t see any economic impact on the country like people say �US Economy will go down if there is no H1 B visa�

Remember the Swift meat packing plant raids. They cost Swift $45-50M they claim. That is greater than the wages of the workers rounded up. Probably around double. If IBM started feeling that hurt, they'd be summoning their representatives to their offices.

I filed my 485 at Nebraska Service Center. Recently I changed jobs and I moved to Connecticut. According to my address I must file my EAD application to TSC. But, when I did the efile, I received a LIN number as my confirmation. And the confirmation message asked to send the supporting documents to Nebraska Service Center.
I don't know if this is ok.

Its risky to change job (other than same or similar) using AC21 Rule:
Here's an extracts from Shusterman.
"To determine whether the new job is the same or similar to the old job, the USCIS consults the Labor Department Dictionary of Occupational Titles (DOT) or the online O*NET Classification System (one of the two), or similar publications. The memo prohibits INS officers from denying I-485 based on failure to demonstrate that the new job is in the same or a similar occupation as the initial job unless they have consulted, on a case-by-case basis with USCIS headquarters."

She should have tried through the emergency quota/appoinment to get her stamping.. Death in immediate family is a accepted for this and I know a colleague you had to go for India for the very same reason, death in the family and returned back after getting his stamping. Got his appointment through EQ. If you fear to get stamped in India, then you can blame the appointment to be 4 months away, etc.. etc...
The article posted is touching, but out lives are not that bad .. We are far more better and we do have a good life.
I do not think one would not go to India just because he/she is scared to get a stamp in India. The loss of someone dear to you can overcome any such fears one might have (for me atleast thats applicable).
In any case, I did not know (neither did my collegaue) of the emergency quota. Thanks for sharing that with us and thanks to forums like these, every day is a learning experience.

Can anyone please help me with the EFile of EAD. I am applying for my first renewal.
1. Question: Have u ever applied for EAD? if Yes, Date for application:
Which date should we fill in here. Should it be First EAD Received Date or Notice Date or approved Date?
2. While Efiling we have a field (With dropdowns) Current Immigration status(Visitor, Student etc..) which drop down value should we fill if we are on 485 Pending (AOS) as my H1B expired already?
3. If you pick C9 for Eligibility Status Question, we have a Text box for the question, please provide information concerning your eligibility status.. what should we fill in this box?

This is absurd, IV only helps when you pay, is it a law firm or what?
Like if you are are a donor then you can see certain posts other wise you can not see them, it is like luring peopled and earn money?
Don't take my criticism in a wrong manner, donations should be volunteer can not be forced. Blocking posts for certain people is logical, but if a particular the post is not met for non donors then please do not show the link for them at all, showing the link and when you click them to see the responses then you are not allowed as you are not a donor, is not a proper way, which gives a wrong impression to IV.
I hope IV will take this in a positive way..

I too got RFE. I agree "Address Change" triggers for some reason.

Funds are really needed but another important thing is to leverage the momentum obtained due to CIR and more recently July Visa fiasco.
I think iV should aggressively focus on recapture of visas, 1 visa per family(Hillary Clinton already supports us on this and we can rope in Zoe loe****
who supported us now) and also removing country based limit.
Momentum is very important and now is the time to restart and I m sure funds ll flow. Removing country based quota is the easiest one to target first.

I am in a similar situation. My current H1B and my wife's H4 expire on June 20th, 2007. I have filed for my 7th year extension as well as my wife's H4 extension in Dec 2006. I got receipt notices for both the application with a notice date of Dec 21st, 2006.
I am planning to apply for my wife's H4-H1 in April this year under premium processing and I was wondering what would happen to her H4 application if her H1 petition gets approved first. Will she be out-of-status between June 21 and Sept 30, as her H1 would start on Oct 1st. Also, what happens to her H1 if her H4 is approved after H1.
Any thoughts.

I think the process is designed for 'non-backlogged' processing which normally does not extend beyond a few months...you are right, maybe, we should have a different validity in the current situation with long backlogs.

Anyone who had good knowledge of AC21 same/similar, please reply.
My original labor has an annual salary of 50,000. My current salary is 95,000. I got an RFE to provide EVL. My job duties are mostly similar to that of the original labor. However job title is different.
is this a problem? My attorney is saying the salary differenence will cause an issue. He is asking me to convince my HR to add a range 50,000 - 95,000 as my salary, which i am sure my HR would be against doing that as it is a big company. I don't even want to ask them since they might think i am trying to do some kind of fraud and raise a red flag.
is there anyone in the IV community who had successfully used AC21 with a considerable difference in salary?. Please respond with your comments.
