Whenever an attempt to increase visa numbers is made a budget point of order can usually be made. So, you will need 60 votes to amend the law.

Not really. Senators voted against this because they opposed the underlying amendment. The Democratic opposition stems from the facts that the amendment proposed to re-capture from all categories and then re-distribute accordingly to a Republican preference. For instance EB-3, numbers re-captured didn't all go to EB-3. The amendment gave 61,000 to Schedule A and then re-distributed the rest equally.
A much fairer, simpler and permanent solution is to simply rollover the unused numbers to next years numbers.

Why don't you do this? Try to search just for your employer - and once you have a bunch of cases filed by your employer, go ahead and narrow yours down based on Priority Date.
I do have the Employer and Attorney details. I searched based on that. Reg, case number, which case number we have to use, the backlog center number or any other number? I do have a copy of the approval letter received from backlog center.
Let me know what else I can do?

After calling US born children of illegal immigrants as "anchor babies", and family immigration as "chain migration", our friends at the anti-immigrant NumbersUSA have a new term for skilled immigrants, you guessed it "anchor immigrant".
They are again using their scare tactics to influence congress to drop its support for HR 5882.
Calling all EB3 guys, Eb2 IND guys with PD after Aug 06, and others with PD retrogressed, its in your sef-interest to call your members of congress to seek their support for this legislation, and to contribute to IV. There will be no relief for a while if this fails.

As soon as we take a single skilled immigrant from a developing nation, around 17 different families may be put in line to follow because of our reckless Chain Migration policies.
Our immigration policies literally "take a village" every time a new Anchor Immigrant is admitted to this country.
Fortunately, our immigration policies do have a few boundaries and delays that keep the whole village from entering our U.S. communities immediately. But every one of the members of those 17 families begins to consider future immigration to the U.S. as an entitlement. And because of that, millions don't wait for their turn, instead settling in the U.S. illegally to wait for the greencard that they believe is rightfully theirs.
THE 'ANCHOR IMMIGRANT'
Our U.S. population is exploding -- consigning more and more of us to heavily congested, heavily regulated lives -- because of high immigration numbers, which have snowballed because Congress insists on continuing Chain Migration.
Because of Chain Migration, every immigrant we allow into the country because he/she brings a special skill, education or experience becomes an Anchor Immigrant.
That is, if officials determine that an employer can't find an American to fill a job and allow the importation of a foreign worker, that worker becomes an anchor in the U.S. for vast numbers of other people from his/her home country.
One problem for the United States is that only the Anchor Immigrant is supposed to be picked on the basis of serving the national interest.
All the other immigrants attached to that Anchor through Chain Migration get to come without any regard whatsoever to their education, skill or humanitarian need.
ONE ANCHOR CONNECTS TO 17 FAMILIES
My "17-Family Chain-Migration Village" example is not close to the worst possible scenario but it is a nightmare that is not uncommon.
Here's the scenario:
Consider a typical Anchor Immigrant who comes from a developing nation and has three adult siblings. All of them come from one family. As soon as the Anchor Immigrant is accepted, all those siblings know that the Anchor Immigrant can put them in line for immigration once he/she becomes a U.S. citizen. Mentally, that one whole family is now in line to come to America.
But there are many more families who mentally get in line, too. The Anchor's spouse, plus each of those three siblings' spouses will be eligible. That makes five families now in line (the original plus the families of the four spouses).
In every one of those families are their own siblings, minor children, parents, etc. This is getting to be quite a crowd of people who suddenly see their future as possibly being in the U.S. That makes five families involved now (the original and the four spouses' families).
Now, consider the siblings of those four spouses. That would be 3 siblings multiplied by the 4 spouses, equalling 12 more adults, all of whom potentially have their own spouses! Potentially, each of those 12 spouses of the siblings of the spouses of the Anchor's siblings is from a different family.
Now, you have those 12 families, plus the Anchor's family, plus the families of the four spouses of the three siblings of the Anchor. That potentially adds up to 17 families that immediately can know that they are in a chain that eventually can have a chance to immigrate to America. And all of that happens the minute our government decides to give a permanent work permit to a single foreign worker.
An Anchor Immigrant immediately creates chains of expectation into possibly 17 different families.
You can imagine how a village or urban neighborhood can quickly have most of its residents seeing that their future is in the United States. Not only does this build huge pressures for more migration and more population growth in the U.S. but it saps whole villages and neighborhoods of the will for self-improvement.
Why will people pour themselves into bettering their own communities when they believe their future lies living in America? And, of course, the chain migration does not end with those 17 families. Our rules are set up so that every Chain Immigrant also becomes an Anchor Immigrant, making it possible for every relative to get in line to come to the U.S.
The only solution is to end the Chain Migration categories entirely. (See our pages on the legislative solutions.) That means limiting each Anchor Immigrant to bringing a spouse and minor children. No adult children, siblings or parents.
The Anchor Immigrant can easily visit his/her relatives annually (or more often) and can be in constant communication by phone, internet and postal mail. Chain categories must be ended if we are to avoid the nightmare of 439 million U.S. population in 2050 as projected by the Census Bureau.
CONGRESS THREATENING TO ADD 550,000 MORE 'ANCHOR IMMIGRANTS' NEXT YEAR
Sen. Menendez of New Jersey is blocking the re-authorization of E-Verify (to keep illegal aliens out of jobs) until Congress agrees to add 550,000 additional Anchor Immigrants next year.
At the moment, the leadership of both Senate and House are seriously considering trying to pass the 550,000 increase in Anchor Immigrants.
Powerful media like the Los Angeles Times and New York Times are lobbying hard for more Anchor Immigrants.
Unless the American people themselves become fully aware of the dangers of Chain Migration and the concept of the "17-Family Chain-Migration Village," the Big Business and Big Media lobbyists are likely to multiply the chain migration nightmare many times again.
Make sure you have gone to your NumbersUSA Action Buffet and sent all your free faxes to push your Members of Congress to stop Sen. Menendez and to eliminate Chain Migration.

Sameer, I am true Indian and has been waiting on this loop for more than 10 years.
It was such a shock for me on friday when I received the email so anything I typed was in a panic. so don't worry about the spell check.
Myself or attorney has not received the original letter so until then I do not have more info and I came to this forum to see if anyone had similar experience and any feedback.
I normally use murthy forum and friday when I was talking to a friend he suggested some folks here had already gone through similar situation.

I can say with confidence that dates for October WILL NOT move forward 3 years for ANY category compared to August Bulletin.
We will be lucky to see 1+ year movement for EB-2/3 India/China. My 2 cents..

It would make more sense to compare and brainstorm if you can post the skillset you have in mind and the rate you wish for?
I agree that being on EAD or having a GC puts a person in a better situation compared to H1B but the bottom line is the skillset in context, demand for that skillset and expertise that one has in that skillset.
it depends on the skill set and your experience. I accept the fact being on EAD or GC will give advantages. But I dont think GC only make the wonders. you might get 10-20% extra.

Are you serious lawyers suggesting to return GC?
I think there was one case that I saw at Murthy web site where the guy went backhome and got married. Came back and found that his green card was approved while he was in his home country and before the wedding took place. Interesting part was that his PD was not current at that time. Because of the situation, he couldn't bring in his wife in H4 anymore.
The lawyer recommended him to return his GC as it was mistakenly issued by USCIS. Lawyer had to deal with USCIS and returned the GC.

With me having a pd even prior to of Mar 2002-EB3I, I thought I will join hands with IV to make something happen. To the extent I went and joined the IV chapter too.
Unfortunately, starting with the forum to most of the news that is being discussed seems to be not related to immigration at all. Example, accidents, investments, real estate. I feel the admin should be able to control and strictly adhere to what ImmigrationVoice stands for and delete any other unrelated threads.
Anyway, long story short, I feel IV has lost its focus and feels like for people who are looking at a proper approach to resolving problems, the web site does not give any reason or confidence, to follow or join hands for IV activities.
Just my opinion. Feel free to agree to disagree whoever would like to.
Not trying to blame anybody here, but sharing a viewpoint. In my opinion IV was great sometime back, but feel now there is a lack of direction.
I understand there could be lot of negative & positive comments about my reply here or me joining activities etc or not joining IV initiatives etc. I will explain my stance on those later.

We feel we have more experience now than before and more members to take part in action items.
However we have felt that it has not been enough to bring the relief we need. For that we need more active members and more resources. I disagree that IV has lost focus. Few unrelated threads do not mean that is the opinion of IV. We would rather spend time doing IV work in this important year than policing the forums and banning people.
Infact through new features and upgrade of the site we are trying to provide what our members need on this site so that there is more participation on the effort when it is time. Our past experiences have told us that we need more numbers when it comes to letter writing, calling or rally. This is the reason we are trying to add new features on the site and look into the needs of the community. This is going to be our strategy this year and we seek member's help to get everyone outside of IV on IV platform. If someone wants to seek answers on immigration questions, they can join IV forums, if someone wants to track they can use IV tracker, If someone wants to blog, we have blogs etc etc

My current H1 is expiring soon. My 3 year H1 extension is pending. I had receipt notice but NJ DMV at Wayne refused to accept that. My current License is valid only till the middle of the next month.

A growing number of states now refuse to issue driver's license beyond the validity of I-94. that means that until your H1 extension is approved, you wont get it, because the new I-94 with new dates will come only after your extension is approved.
Now, in Arizona, they accept receipt of H1. In Nevada they dont. Other states have other rules. I know only about these 2.
You can upgrade your H1 to premium filling out a form and it will get approved in 7-10 days. Your employer should bear the expense of premium filing because the employer procrastinate and delay filing of extensions even though its possible to file extension 6 months ahead of expiration date. That procrastination should cost the employer or the lawyer, whoever caused the delay.
You cant blame DMVs for asking for latest I-94. That is the only way they can make sure they are not issuing driver's license to those who overstayed their visas and became illegals. As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.40 While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. There are now 93,358 more cases pending the name check than last year. Perhaps most disturbing, there are 31,144 FBI name check cases pending more than 33 months as compared to 21,570 last year � over a 44 percent increase in the number of cases pending more than 33 months.4
And it is only 1 year of filing I-485 ( can i take comfort that many others have been stuck 2 year, 3 year etc ). ANother reason why visa numbers got wasted is that many fellas got stuck in namecheck ( Ask many of the Indian/Chinese/Russian folks ).

And it is only 1 year of filing I-485 ( can i take comfort that many others have been stuck 2 year, 3 year etc ). ANother reason why visa numbers got wasted is that many fellas got stuck in namecheck ( Ask many of the Indian/Chinese/Russian folks ).

Section 11 has been created for you to tell them abt last EAD APPLICATION.
Keyword here is "application".
So in the Date I wrote the EAD application date and not the recept date.
This can be found on the last EAD receipt notice.
You are already sending them a copy of front and back of current EAD, where they can find on which date the EAD was approved etc.
Most cases Ideally current immigration status is "I-485 ADJUSTMENT OF STATUS PENDING".
I entered on an L1 5-6 years back. so I wrote manner of last entry as "TEMPORARY WORKER (L1)". Yes I have not reentered USA since then. Ha Ha.
My office mate reentered recently using AP and he wrote, also as per our lawyer, to use the word "PAROLEE"

It is very unfortunate that people equate job opportunities to the population of the country. If that were the case then India and China would have the most job opportunities in the world because they account for one third of the world population but that's not really the case otherwise we all wouldn't be here in the first place.
Opportunities are defined and provided by the economy. When you compare Canada to US, you might say that it's a smaller economy but remember Canada is a G8 country with such a strong economy that most other countries in the world can only dream of. US is the richest country in the world with the strongest economy so obviously other countries don't offer quite the same opportunities but Canada offers things that has become a dream for many of us... to be a citizen of the country where to permanently reside. Canada offers stability, certainty, hope for the future, and and an opportunity for everyone in your family to realilze their dreams as opposed to sitting at home for years doing nothing hoping that one day that EAD will come. Canada respects immigrants and welcomes them with an open arm quite contrary to policies in US where you are allowed to work but your family is not and even you are kept on the state of limbo for years and years wondering what your future holds in years to come. And better yet, you abide by the laws, pay taxes, do everything by the book yet the guy who just walked across the border has much better chances of becoming a permanent resident than you. Where is the respect and fairness for law abiding folks? That my friend is what is different with Canada. You get treated with respect and dignity and you get to decide what your future holds and not the US government.

Why don't you start a similar forum for "going back to India" ? I hate to burst your "bubble of hope" but Canadian population and job market is limited and the opportunities for professionals like us are limited. Why not consider going back to India and taking up some of the lucrative opportunities in middle management in the IT industry.
