Any way, if you look at the statistics (page 52, http://www.dhs.gov/xlibrary/assets/CISOMB_Annual_Report_2007.pdf), USCIS has not fully utilized all available EB visas for 12 years out of the 15 years. Hence I said, USCIS is THE bottleneck. For the 3 years (out of the total of 15 years), unavailability of visa numbers is THE issue. But for the majority of the years, lack of visa numbers is NOT the issue.

Sorry about my ignorance. I had made an incorrect statement confusing 'Other worker' category with EB-3. I deleted that.
Anyways, this date will go back once the backlogs are eliminated. Just like they pulled 'Aug 03' out of their asses this month, they will pull another date in six more months.
Judging by the 1-year leap for RoW, the priority date for ROW should have being moving throughout the year. Maybe the same situation here - they just cannot count, and are going to waste some visas at the year-end.
Anyways, this date will go back once the backlogs are eliminated. Just like they pulled 'Aug 03' out of their asses this month, they will pull another date in six more months.

I know after we file the i-485 for 180 days, we can change our jobs. But rule is that the new job should be in the same field as the old one.

Does this mean that you cannot have 6-9 years extension of H1B for the new employer and you must use the EAD after six years if you are changing jobs?
There are more risks in using AC21 before 140 approval.
Read the Aytes memo of Dec 2005 regarding portability before 140 approval. There is all kinds of things that can go wrong if you port off to a new employer before 140 approval.
Other than employer withdrawing 140, the other issues are that if there is an RFE on your 140 and you have already used portability and ported off to new employer using EAD, then what would you do if that 140 doesnt get approved. Because if your H1 6 years have been used up, you are on EAD status, and your underlying 140 tied to 485 doesnt get approved, then it means you are out of status and you are out of luck. You cant even stay here to appeal the whole thing, you have to pack up and go back.

There is no such law that specifies any duration one has to be employed by GC (or AC-21) employer. Period.

That is exactly I was trying to tell people here. Each lawyer can interpret law and put on his website. But the fact is we have not seen a single case of citizenship denial or RFE where someone had changed the job immediately after getting a job. If there was any such case, send it across for us to see.

Lost in the big hoopla of 1 yr jump and hopes of similar advancement for others in May VB are the following facts.
1. USCIS is about to raise fees for all immigration related procedures beginning from June 1st
2. Visa quota ends in September and it takes on an average of 4-6 months to process I-485.
Let me detail 2nd step. If they move dates forward by say 1 yr and thousands become eligible for 485. They will accept those cases, get fees from those lucky souls and make the dates unavailable after 1-2 months. Remember last year they were moving dates by 6 months till they made it UNAVILABLE for August and September.

Even though the effect of retrogression is expected to reduce from the current 8+ years, it is still going to hover around 5 years in 2012 (assuming a weak economy and minimal filings).
This line isn't true anymore for EB3 India after correcting the typo in dates. I believe this can be deleted because even in 2012 the wait time is 8+ years. With huge CP numbers (~20K) for EB3I, the wait time will surely increase further which is not factored in the report.

Are any of these happening with you ? If so report to USCIS.
If not, why do you assume it happens with others.
Does it make you feel better ? Or are you a follower of Mahatma Gandhi/Mother Teresa that you earn justice to be done to others not you ?

1. Would you be happy if I say it is not legal for consulate to ask for such documentation?
2. Do you want me to call them names?
3. Would it be better for me to state that they are racially motivated and discriminating against Indians?
4. They should cancel all documentation requirements?
Anyways....I earn 64k per year and I want to take benefit of the mortagage crisis and buy a 900k home. I want the banks to continue with their past practice of providing cheap loans with no down-payment and not a lot of documentation. Would that be a valid demand?
Fellow legal immigrant..what do you think would be result of ICE raids which finds some fraud (I said some not to indicate that it happens in majority cases...it could be less than 1% of all the genuine cases). As software engineers what do we do when we find defects during testing or post production stage? Do we fix it or we try allow it continue?

All the folks who came here ..in early 19th century didnot have to deals to employment based and family based immgration...hell they just landed and assumed citizenship...but does it mean that we use that as an example as seek citizen ship today? No IV provision is in the bill.
For something to happen, each member needs to do their part by supporting this effort and taking part in action items. With so little support and initiative we cannot expect to match the kind of hard work DREAM act advocates have done.
If we need an amendment, we should be showing up for advocacy day or signing up for monthly contributions, volunteer our time, or doing any state chapter work by meeting local lawmaker offices regularly in groups. Dream Act folks have built a very strong network and advocacy effort that no politician can ignore. Go through the list of things they have been doing over the past few years and you can judge how much percentage we have as a community matched that effort. This is a reality and and ultimately it will be us that are responsible for no bill being passed in the last few years.
The community needs to do more than wasting time on the forums and trackers if they really want any bill to happen.
Definitely it is time to Unite. If they are doing illegal immigrants legal citizens, why should not legal applied immigrants as Green card holders.
Do you think we need to start some thing like flower campaign or sending letters to president like that....

What make you think BCOM or BBA or BSC is less than any other Bachelor degree EB3 own labor guys have. I am not here to defend or oppose LS. But before you talk about people who are not from same educational background as you, you should come out of bottom of Rock you have been living and breathe some fresh air. I for one, who has BCom and able to get my labor and GC cleared without using any of short cuts. :mad::mad::mad:

I think for few people this might be bad news. Some people changed their job without I-140 being approved. Sorry guys...i used AC21 but i have approved I-140.

Dude, You are looking at not getting a RFE based on the pics. Not that picture people or JCPenny takes great pics and make u look like Brad Pitt or Tom Cruise.

I got 2 RFE's for pictures only. Those are the only 2 RFE's till date for me.
I had real bad experience with digital pics. But there are many people who didnt have any issues. So it is all your luck.
If you have RFE, it sets u back by 2 months for the approval.

I initially went to FedEx/Kinkos new jersey, paid 50 bucks for myself and wife 6 copies each. Photos were horrible with yellow tinge, though they were of the correct specs. I refused to accept it, but they said if there are any issues they will be glad to help, but I had to pay for their crap.
Then I went to Sears, around 60$ for 6 copies each for myself and wife. The prints were excellent, waterproof and not retouched. They printed it out on immigration specified sheets. Only catch was I had to cut out the photos myself, they are not allowd to cut them.
My photos have a bright background and I do not see that yellowish tinge you are talking about. Again, one cannot brush all kinko's or all walgreens the same I guess. Ofcourse, what is bright is probably again left to the USCIS officer's judgement. Hopefully it will not be an issue. the only thing I noticed was that my photo was taken very close up to adhere to the USCIS requirements. He was zooming in a lot. Is that the same with everyone else too?
