    Newt said Nothing is going to happen on this Specter or any other immigration bills in Senate. The conference with House will not agree to anything.

    I also sincerely believe that Nothing is going to happen I say, these senators are doing CYAs; they will bitch it to media, their constituents, hey look, we did attempt these immigration reforms.

    I am talking from my long experience and wisdom and take it from me. The only force that can improve the pitiable conditions of Indian and Chinese due to retrogression and lack of visa numbers is the big corporate employers . Each one whose LC is approved, whose I-140 is approved, who is waiting to file for adjustment of status AND who are indispensable to the employer / work at this stage should write to the HR/ Immigration/ Attorney.

    I am in such a position. I am a technical lead in my IT department. PD Nov 2001. I write about these issues and the difficulties once in a month my team manager, or project manager or Immigration department.

    I am in similar situation, I have already changed my job after 180 days of filing my 485 (140 approved) and working with a small consulting company. Currently where I am working client willing to hire me as a fulltime employee with the same titile and giving me the supporting letter with the same job duties mentioned in my LC (I have added few more technologies it).

    Even my attorney says the same, no need to inform CIS - when we get the RFE we will see.

    Can you kindly let me know all the documents I need to gather and what I need to request from new employer in order to submit AC21 bunch to CIS.

    Here are job discriptions with titles.

    Old Employer.

    Thats a good analysis. As you noted EB-2 India got only 14K visas as opposed to other predictions of 30-32K visas. I have long said that the variable here is how EB1 and EB-2 ROW demand numbers. A lot of folks assumed that all the spill over will end up in the EB-2 I/C lap. It does not as long as there is no retrogression across the entire EB-2 category severely, making the old PD golden (this is not going to happen) or there is very less demand for EB1 and EB2-ROW numbers.

    While I agree with your analysis, I feel that the number of employers/applicants filing for Labor/140/485 has started a downward spiral in 2008. This means lesser demand for EB1 and EB-2 ROW numbers making the numbers available to EB-2 I & C. Again, it is very well possible that there are just enough number of people from both Eb1 & EB-2 ROW categories left & entering in the system to deny the numbers to EB-2 I & C. Unless the state of the economy continues like this, shedding 600K jobs in one month, equal to number jobs in the state of Maine, we can't say that EB-2 I & C can become close to current or leap into 2007 and beyond. Then we might be current and have a GC but the economic situation would be so worse that people don't care for GC. God Forbid we have to see that and lets hope and pray that the Stimulus will resuscitate the economy

    They are just pointing to one side of story. Yes H1B program has been massively misused by corporations and LLC's ( This includes L1 visa). Yes they have injected huge foreigh labor into US markets (till 2004 it was 120K I beleive and now it is at 80K with L1 extra).

    But then there is other side of the story. Look at the competativeness of US companies due to these workers. Look at the massive amount of e-commerece, B2C and B2B commerce that was possible because of the work that these workers have done. Yes it reduced labor cost's and increased the pool of talent that employer could chose from. But then labor cost's were always conforming to DOL laws & prewailing wages for each occassion for most cases ( except few bad eggs, which I beleive was very small percentage of this program). So wages argument is not as valid as it looks if anti' s feel wages have been less they need to ask DOL to increase prevailing wages to what they feel is right but then that will make all these innovations extremely expensive and companies will face budget constraints and feel less inclined to try new things. That will make US less competative globally.

    After I heard from the Infopass IO that my case is all set and it is sitting in the NSC examination room, I have been trying my best to get my file to the attention of an IO at NSC. This is what I have done till now. Don't know if this would work. If not, what the heck?

    1. Wrote to my state's senators
    2. Wrote to Ombudsman
    3. Wrote to my Congressman
    4. Wrote to the President
    5. Have opened a SR
    6. My attorney is taking an Infopass appointment to see why it is stuck.

    We 2004 guys are really out of luck. First BEC, then all these LC substitutions, July 2nd fiasco, and now this. Can't believe we got screwed in all the steps.

    I also think the same way. Life is so much unjust. (USCIS adds to this injustice)

    hi. sorry to hear that you are going through this harrassment.

    i would recommend the following strategy:

    1. file a case of harrassment with the state DOL / agency.
    2. contact an immig attorney and have them 'on your side'
    3. contact the IRS via registered mail and document your case, with FACTS, not OPINIONS or EMOTIONS. send a copy of the IRS letter to the State DOL.
    4. further, file a complaint with the DOJ (if applicable). check out their Website.
    5. finally, send a 30 day demand note (if applicable in your state) stating YOUR demands against the former employer, asking for immediate cessation of all activities which can be considered as coercive, amounting to emotional stress and harrassment. if possible, get a Doctor's medical advice and keep that on record.
    6. eventually, think about getting a lawyer to do this case 'pro bono' . some might do if you can get good local press about thsi case and effectively 'market the lawyers costlessly'. of course, all privacy goes out of the window.

    My labor was filed on July 2004 and I have not received an approval yet.
    I got an RFE last week stating that Employeer has to again prove the RIR status of the application.
    So Lawyer has started the advertisement process again.

    One important issue is over looked here. Small employers will have a tough time in proving I-140 "ability to pay" for employees with older PD�s, whose labor got cleared after Aug 17 from BEC. Cuz the company has to prove its "ability to pay" the proffered wage starting from the date PD is established continuing until the adjudication of I-140.

    Suppose the PD for an employee is Oct 2001 and the proffered wage is 80K per annum, then the company should prove that its assets, net income or salary payments were >=80K starting from Oct2001 continuing until the adjudication of I-140.

    This is indeed an acid test for small employers.
