Since they will be a party to this along with you it is better you talk to them and make sure they assist you properly. Also was your insurance at that time conforming to state minimum requirements if that is the case then you can breathe easy since you had done everything that law asked you to do so hopefully there is no criminal case against you. Worst if court ask's you to pay financially you can declare bankruptcy and minimize the impact. I am sure that does not affect GC. But rather than forum you need a good attorney to talk to. Make sure who ever you select to talk to about this accident case you arrange a meeting between this lawyer and your immigration lawyer so that both are well aware of situation.

I have seen many of my friends doing H1 for their spouses..... while their spouces have no experience what so ever..... employers help them cook their resumes..... in these cases employee has something to hide.... so they pay
H1 fees, stay on bench for few months......and never complain...
Now a days many companies send people on L1 visa. On L1 you have no choice. If you can't get H1 in April you are slave to the employer.... also with L1 there is no stipulated salary like H1.... so employers pay whatever they feel like and not market rate.....but since many employees have desire to stick around in US and save some Green... pay of their debts in home country.... they stay with same employer without complaining......

So,
who do I blame? US govt? Or these Desi companies who have exploited H1B system to the core, abusing the system and making our lives miserable each day. Well I am about to join an organization, which will report these Desi companies straight to Department of Commerce, there are a group of students from other Universities who are planning to be a part of the organization.

USCIS is not dumb...They have interpreted the law in the way they think is appropriate....They are applying the over all 7% country cap to China/India EB2 and sending the overflow to EB3 ROW..... It is not fair but it is not exactly illegal...The law is open to interpretation and USCIS has chose to select this interpretation......You can take a crack at suing the USCIS.....I doubt that you would get anywhere......The EB2 India/China might benefit from the lawsuit....But as you know not all members would agree on IV spending resources on this lawsuit because this serves only a small section of member population.... At a personal level you can gather a few EB2 China India guys and have a crack at suing USCIS....

bringing bk the discussion to more serious point. We can all agree that on the surface immigration system here is seems unfair towards Indian, Chinese and Mexicans. Whats the reason behind it? why only three countries which suffers from long waits. Its demand and supply. If there were no country caps, all the visa's will be absorbed by these three countries. Even though it has cost me time and money, i think its the right policy. for a moment imagine there was no country limit, can you imagine for few years to come immigration will be from only these three countries. i think its only fair to limit how many people can come from one specific country.
and one more point, we are never going to get treated with respect and equality, just get used to it. every American knows we left our country to come to his. he is always gonna look down upon us. Immigrants are never treated with love, respect and dignity, no matter which country they go to. Case in point, Bangladeshi and Nepali migrant workers in India. We treat them like dirt back home, so discrimination against immigrants is part of immigration process. hopefully our ABCD offspring's will face less of it :)

Niether many has tried this option (entering on AP and filing H1B transfer to different employer other than GC sponsers) nor USCIS has strong history of approving/dealing with these type of cases. After entering in AP, though one can very well contine the H1B with the same employer to whom any one work on H1B before leaving US. There is a memo for this type of situation. However, there is no specific memo to address this situation (Transfer). It is all depends on the individual adjucidator's logic. If they see your latest I-94 with parolee stamp, then they may deny (or issue a RFE )the H1B transfer, by the applying the the logic of one must be in the smae status to seek extension. If the deny/issue RFE, you can not counter act as there is no secific memo or policy by USCIS in this case.
Can you please provide a link to this memo ? My attorney said, if I want to continue on H1 after reentry, I must get H1 stamped and enter in H status. If I use AP for reentry, I should change to EAD at work. This memo will help.

Why dont you call VFS and find out what's happening and if they can help you to resolve this?
The VFS website says the consulate is still holding the passport. My wife also applied for H1B on the sameday/sametime and she got her passport within 3 days. I doubt i am stuck because of this new PIMS rule. Should i send an e-mail to the consulate to confirm it?

In any system if you club large group of applicants based on a dichotomy, and say you will get lesser share than the rest, isn't that how you describe preferential treatment ? Is there any other way to describe the current country-quota system?

That is, there is no perceivable difference between you and I, at least in terms of employability, that this diversity concept can make a meaningful benefit out of.
In fact it probably makes much more economical sense to have quotas based on the subject's political or scientific inclination rather than national origin! In today's connected world, nationality has no meaning.

It is not fair to expect a member to contribute the moment he joins. It takes some time to understand the impact of GC problems and get a good feeling about IV activities. IV can not post its activities on forums. You will be surprised to know that anti-immigration organizations are well organized.
However, we have numerous members with 50+ posts and 3+ month of membership with no intension to contribute $20 (you will not get 2 Indian Buffet's in Washington DC for $20; it takes $4 (metro up) + $4 (metro down) + $4 (parking) everyday to DC).
I (and other members) have literally begged some of these members. One particular member says (s)he is going back to his/her country but starts posting abnoxious messages after a few weeks.

What is the exact rule? Can someone please guide me thru proper thread.

IV should work hard on defeating this bill. It will send a clear message to anti-immigrants even if the bill does not pass.

I think USCIS must meet the EB convertors somewhere mid-way to maintain fairness.
About gctest, what has pissed me off so consistently is his trash-talk, calling EB3 third grade workers, his utterly self-centered attitude and inability to see other side of the story. Over and above that he is a lying, cheating bastard who changes his story all the time.
angelfire, before you go and make such a determination, please do understand the root cause of the issue.
EB3-I processing is stalled, especially after USCIS opened the floodgates and let everyone inside one time.
Folks who were waiting patiently had their clocks turned backwards and pushed at the end? Classic case of starvation.
Upshot - some with older EB3 PDs have ported their dates, after qualifying for senior positions based on their academic credentials and job experience and getting jobs under EB2.
Which is why see an odd 2002 EB2 PD suddenly appearing from nowhere and getting ahead of you.
How many are actually converting?

That EB3 people should not be made to start from scratch all over again, however they should also not be given the advantage of a loophole in the system. We all knew the evil of LC sub and this is something similar to it.

There will always be condescending comments made by people on the other side of the tracks.
