A Person needs a Valid US Visa or AP to enter back into US.
I went with a valid US Visa. I dropped my old I-94 while leaving US and received a new I-94 while entering US port (in Cruise).

I�m bachelor. I�m planning to get married in another 6 months. Should I apply for I-485? If I should, can I add my spouse later to the I-485 application before I-485 is approved and priority date is not current. :confused:
You will be able to file her 485 after marriage and before your approval only if your priority date is current. I am in the same situation and confused too.

You have three options
1) Talk to your employer and see if he is willing to support your I-140 while you are away on leave of absence, if he agrees then great!
2) Talk to your school and check if they will differ your admission by an year.
3) Go anyway...forget about US, you can do great in Europe or Asia too

You work for Govt on H1b. Payment would not be an issue. The only issue could be experince certificate. They might ask you to provide experience certificates.
NSC is really crazy about RFE. They complan about resource and they have time to issue RFE. 99% RFE's are cleared on first response.

Its the courtesy of USCIS and highlighting of our problems by IV made USCIS to issue cards for 2 years... there is no requirement that it should be as such... in general any EAD unless its L* is generally issued for 1 year with exception of C09-employment category where they are issued in looking at Priority date [ofcourse there are other exceptions like asylum... etc] if they dont get biometrics from their repository at the time of printing , they waive some of the features like fingerprint, signature etc.

In reality my wife got only 11 months validity, as the from date started a month before we actually received it in the mail. It is a big pain and expense to renew every 11 months, if this is the case. Another gripe is that my validity started 2 months before the current one expired, effectively reducing the 2yr to 1yr and 10 months. It still better than 1yr, but I don't understand why they get simple things like this wrong.
It is funny that I used to wait until the last minute to renew my car registration when I first arrived in the US, thinking I would loose time, but when I learned that that is not the case, I started registering at my convenience. Since EAD renewal is not as simple, we tend to apply early, and that results in getting some time lost. How early do you normally apply?

That is the point. It was not of your own volition.
Also, there is no rule that says citizenship is not available to people who do not work for the sponsoring employer for a certai nperiod of time after GC approval. It is just good practice to stick around for a few months after approval, but it is not law.
You will have no trouble. Change your status from bittersweet to sweet and have fun. Also, good luck finding a new job.

I think you might have missed soem field in Application like Eligibility Criteria or made mistake in selecting the proper answer.
I heard that some people are getting EAD for 1 year only, which is sad and again have to go back and pay $360 (Taxed money) in a year.

I have two passports one with H4 Visa stamped and another Surname changed. While entering US, I have used my name as in the Visa (new surname) in the I-94 card.
I have applied for H1B with new surname in this May and change of Status with that I-94.
During H1 processing, I have travelled out of US and while entering back I have used old surname( as sometime back DMV ppl told that the name on I-94 should match with H4 Visa)
Now I got H1 approval and COS approval with my middle name taken as first name and new surname.

The proposed rule is scheduled to be published in March 2007 with 60-day comment period. Once the concurrent filing is terminated, the immigrants may experience a terrible pain as related to maintenance of nonimmigrant status pending I-140 petition, eligibility for 245K benefit, plus unavailability of EAD and AP pending I-140 petition, AC-21 180-day portability, etc. etc. Should the I-140 petition processing be dragged, the pain will be extremely unbearable!

As a Primary Applicant my GC was approved (EB-1) but for my wife's application I got an RFE. RFE - USCIS is asking for a VALID wedding certificate showing proof of a hindu wedding under hindu act (dont ask what I was doing or what my lawyer was doing while submitting 485)
Now I have about 28 days (total is 30) to respond to it. I have not rcvd. my GC but it has been approved and has been sent to production. My lawyer told me that as my GC has been approved my VISA is not good anymore. My wife was on dependent visa and so is my kid.
Now as my GC got approved.......my visa got cancelled...........my wife's & kids visa is invalid.............and we did not file for Advance Parole so we cant travel. On top of all this we dont have a wedding certificate.
Any suggestion to address this situation? I cant get a certificate without going back to India and I cant leave the country as If I do so I wont get to enter the country again. Even if somehow (on some legal basis) I can re enter I dont think my wife and kid will be able to re enter US.
If I dont produce evidence then my wife's application will be rejected putting her out of status.............gosh what a mess.....
ANY SUGGESTIONS FROM ANYONE WILL BE HIGHLY APPRECIATED. Murali please respond with any possibility which I can explore upon.

However I don't understand how your wife and kids got depedendant visa. I don' think one can get a H4 or L2 visas with out marriage certificate first place, unless your wife came here on F1 visa here.
Anyway, You can apply marriage certificate with Indian Consulate. You may want to visit there with wedding pictures and passport there to get your certificate
