6 months after GC is safer. The "6 months" is usually USCIS rough assumption for calculating "intent". Doest mean that you are absoulutely safe after 6 months. It doesnt mean that you are in danger before 6 months also.
You are supposed to have the "intent" to continue working for your GC employer AFTER getting your GC. The 6 months is to show that you HAD the intent, and after 6 months your intent changed.

These ppl are talking about giving amnesty to ILLEGALS...let me repeat it.. amnesty=award for being ILLEGAL. They have done that before and all of a sudden we F'KIN LEGAL TEMP WORKERS from India/China have to worry about the LEGAL aspect of filing a law-suit.
Something is seriously screwed up with this. This is no different than a pseudo-SLAVERY. Now all of a sudden most of you will say, no one put a gun on your head to work. Ofcourse not, but why hell do they create a dual intent H1FU?K Visa where they show you the carrot and create a indentured servant system and discriminate on the basis of the country of your birth. It is discrimination. Trust me when there was SLAVERY in the US , it was defined LEGAL.

Hi,
The notice doesn't say that I-485 was denied. for I-140, it says notice of Automatic revocation. For I-485 it says Acknowledgement of withdrawl. It looks to me that my previous desi employer actually withdrawn the I-485 application and thats the reason it says the I-140 is automatically revoked.. But how can they withdraw my I-485 application ?

CAdude , Your efforts greatly appreciated. But how come 100,000 Applicants are being applied again for New merit system ? Is it becoz they are looking for all current Labor petetions being not approved ? as current legislation says I140's pending or approved as of May 21 2007 continue in current system . Please advice.

I support this idea of a Silicon Valley rally. I also think that for our next rally we first need need some new concept or central idea that will make us heard loud and clear and get even more national attention. I guess we all agree that the next rally shouldn't be simply a repeat of DC in a different location, but in some way take things to the next level.
Our ranks are much smaller than the 12 million illegal immigrants, so we cannot get noticed based on sheer numbers alone. To get attention we need original & effective ideas. Like the flower campaign.
One idea that we could use in our next rally is to ask each participant to come with a sign that reads "Waiting since (year)" where the date is when you first came to the US as a student or H1 or J1. In my case that's 1999 and I'm not even able to get in line for a green card.

Thanks you all for the responses and help. We are searching for employers who can help me out in the situation. Most of them are thinking twice bcoz I am pregnant and have to take maternity leave within a 2- 3 weeks.

Even on H1B ,taking leave without pay during pregnancy does not cause you any status issue.

I am working on EAD and current one is expiring on Sep 26. I got an RFE for photos and it was received on Aug 7th.
I called last week Aug 15th and requested to expedite the process. I got an email two days back saying that my request was accepted and will get the decision within 14 days.
I been trying to get the infopass appoinment since past 2 weeks but so far I havn't been able to get any appointments.
I am keeping my fingers crossed and waiting.
Can I go to a different city to get an infopass appoinment ?.

Talk to a lawyer and get the answers. But if you're on travel and questioned by immigration upon entrance if you're still working for sponsoring employer, depending on the circumstances, they can take your GC away. So that's another scenario separate from an audit or citrizenship interview that GC jeopardy may arise.
If circumstances change, like you getting laid off or fired, that's a different story. If the sponsor's intent changes, and that does happen, then obviously, you're free to move on. But you should be able to prove that, with say a termination letter, for example.
Many of us will be facing this decision and it's good to know the risks and the answers. Imagine you got a GC and now you have a +20k offer from the other company. Staying with your current employer for 6 months will cost you 10k. The question is "does the risk cost 10k?".
This is how I see it, please correct me if I'm wrong. You can be questioned about leaving the company only in two cases: 1. citizenship interview, 2 - investigation/audit. In first case I don't see much problem, as many years will pass, and if you will not keep any documents, I don't see how USCIS will be going back and chasing these 4-5-6 months of your employment.
Investigation is a different story. You have to be ready. The law says that you/your employer had to have intent to work on that position with that job description forever at the moment of AOS. Technically you could change that intent the very next day.
