    This is not EB3 vs EB2, this is about filthy, demeaning language being used on public forums to put a class of skilled workers down.


    You call consultants "sleazy and body-shopped".
    You call EB3 third class.
    You call EB3 dumb.

    If EB3 were to leave today, you EB2s will have no jobs left. EB3s will take away all the jobs with them overseas and take your too! After that you can preach this swinging philosophy of yours!

    You say EB3 is only a notch above "illegals"?
    How can legals even be compared with illegals?

    This is a baseless post and ironically you are quoting a post that does NOT say a single of the statements above.

    Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.

    i personally vote for "one step at a time approach", which is been thoughtfully discussed and hand-picked , especially after thinking all the limitations we have in terms of $$, political support, member support, contribution support, etc etc

    remember:
    on every bill and every single effort we try to make after all these pains, every single mistake we make will cost us 6 months or more before we re-group educate memebers and others about what we can ask for in the next and satisfy IV members.

    filling up bills with each and every single problem has taught us some lessons. so we decided to go small to see how it works. every single retro prob has dependancy on others. so as logiclife mentioned solving one will ease the other one or indirectly solve other issues. im not that good in explaining all those, but i can try one.

    EG: see the scenario where H1B is not happy seeing H4 not being able to work. If our I-485 filing provision gets through, he/she can apply EAD for his/her dependant and all are happy.

    dont always think "H4's cant work" "H4's cant work" "Compare with L1's".
    im sure core team might have thought thru about a million times what needs to be done, when and how with all our limitations.

    its a matter of just 15 days wait to see what we get. why throw in more and confuse people. dont we have even a little patience?

    remember, one thing for sure - every single mistake we do from now on - the waiting punishment may be in years. and its for sure the retrogession will be solved in the future sometime, but no guarantee- in our living time in usa.

    In ac21 law; it doesn't say anything about the scenario if 140 is revoked by employer. It is totally silent to it.
    AFAIK:

    AC21 is not a law, just a guidance. Assume an immigration case goes to court hearing, the judge would completely ignore AC21 guidelines. Any employment per AC21 will be considered unlawful in this case. The probability of a case going to court is not very common though.

    The above is just FYI.. You can google for more info.

    AC21 is a law. AC21 Memos issued are guidelines that IOs are supposed to follow. E.g. If one IO issues NOID if I-140 is revoked and another denies I-485 directly then the latter needs to explain why he/she chose to not follow the memo. In any case, there should be consistency across board to follow AC21 regulations.

    Yes, that is right, I said �plight of EB2-India�.

    I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...

    Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.

    Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.

    There are complaints all over the forum which have the stink of pretentiousness such as �oh..i am a poor EB3 waiting for n number of years� etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).

    All these posts that refer to �my career is over because my gc is delayed� are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.

    For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven�t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!
    To all the guys bashing chankaya...

    I know there are some EB3 folks who could have qualified as ED 2 and some EB 2's who could have qualified as EB 1 ..like myself. I am EB2 but if would have taken the initiative could have made it to EB 1

    Also there are folks like my friend who is EB3 with US masters who should be EB 2. His employer sold his EB 2 labour and just substituted his labor.

    Yes there are folks like that. Also many have the opportunity to port but they don't. Overall the majority of EB 3 are EB 3 because their qualification doesnot meet EB 2 or they didnot take the initiative to go to a higher level.

    BY far most people are in the category they should be IN !

    I can also crib about why I did not try EB 1 till the CIWS come home with no avail..No pun intended for anyone

Many people with legit US education (not TVU kind that many not so educated people on this forum are taking shelter under the umbra of) who have been in the US for more than 10 years are still lawfully waiting in the line. And this idiot with a BCOM and MCA ( correspondence course from IGNOU) is dreaming of porting into EB2 and screw us up. Shame on USCIS and Shame on DOL. I am really concerned that if legit EB2 applicants don't talk to lawmakers and send emails to USCIS, we will be stuck here for years due to these fradulent porting.

    If you have secure permanent job with a solid Company,it is better to buy a home. I have a well secured job and I bought the house back in 2002. Home prices were less in 2002 compare to 2006.

    But, if you are optimistic and ready to take some risk,you may be making some Good amount of profit in the future ! I was very optimistic and took some risk in 2002 and now I am in a Safer Side ! Think about it

    I will repeat again, buying a house now is a bad idea, don't be swayed by on-paper profit making stories of other people. va_labor, you were lucky to buy a house in 2002.
    On paper you do have 100K notional profit but things are different now. It would be interesting to see if you can make a 100K profit again by buying a house "now" and say selling it in 2010.

    The houses are highly overpriced. Only people making suggestions for buying house "now" are realtors and please excuse me, va_labor, people who want to make 100K profit now on other suckers. Wait one to one & a half years more and you will get these same houses for cheap. va_labor ;) , If you want to make your 100K profit, you better sell you house now, or it might be too late in one or two years :)

    Took Atlas America due to their "acute onset of pre-existing clause". Mom got pneumonia 3 weeks after coming to US in April last year. They declined to cover hospital bills saying it is a pre-existing condition. Doctor's opinion was she acquired it due to cold weather and highly improbable for someone to have it not get sick for 3-4weeks. Insurance did not care. Still paying the bills.

    1 week after getting approved, I got the card in mail today.

    All the work that I put in the last 2 month to get my file picked finally comes to an end here. It's good to see that people are proactively calling USCIS and following up on their cases.

    Malpractices are criminal (if law is violated) but a corporation cannot be tried criminally because it cannot go to jail.:)

    I think it is a good think to respond to the people who offended you, but it is naive to think something will be done just by CNN getting a letter with thousands of signatures.
    If you feel you are offended or prejudiced, why not pursue a lawsuit for defamation/moral damages? I think this is perfectly fit for a judge to decide. Only this way the small can affect the big.
    Or, why not try to appear on the show and talk against the lies Tancredo said? I bet Lou Dobbs would love that, as it would increase audience.

    A petition like this, directly to CNN, is, in my point of view, a waste of time and effort. It's not going to be read and will be thrown into the trash can as soon as it is opened there.

    Its not a waste of time. If you complain 1000 times it will get noticed atleast once.

    well said... and key point is we are bashing (if that's what you want to call it) the system (we are part of the system) not Americans...

    Lot of people fail or choose not to see that.

    We do have a right to request prompt, fair service.
    We do have a right to expect to be treated by the system as we treat the system: with respect.
    If we do not actively seek to change the system for the better, then who will?

    There is no injustice that some justify with "well, he's illegal!" or "He's not American!" It is not acceptable. Not just because it is unfair to us, but because there are no bounds to it.

    If early Americans just accepted how the British treated them, there would be no United States. Not arguing for revolution, but I am saying that any efficiency that exists today exists because of the demand for it. Regardless of citizenship.
