Few years ago, USCIS did approved EB2 with 3 year degrees.
But now they are very strict. They are refering into EDGE (Electronic Database for Global Education) database, created by American Association of Collegiate Registars and Admissions Officers (AACRAO) which didn't equate 3 year Indian degree with US equivalent bachelors.
Check thier website AACRAO - American Association of Collegiate Registrars & Admissions Officers (http://www.aacrao.org)
Would 3 yrs bachelors and 3 yrs masters (MCA) with 10 + yrs of experience qualify for EB2? Is there anyway we can check in that EDGE database?

I did not invoke AC21 because of the very same reason. My decision had influence of attorney advise.

With all due respect.. members (including senior members) have just made the entire e-filing discussion (EAD / AP) just bit complected..
Here is the link to USCIS website, which specifically talks about e-filing forms (Top right side of the page).

I have some good news and some bad news!
The bad news is that. You will get your green card in 5 years and after other five years you will get your citizenship. So in 10 years will be in position to get married.

I have been feeling sad that I have not been able to make it to the rally and after hearing about the energy, the camaraderie and the excitement you all shared I know for sure I missed out on a once in a life time oppurtunity, there will always be that sadness in me, the only comfort I have is that I tried to contribute in ways other than attending the rally.

A friend told me about the E category visa for Australian nationals. Is this true?
According to him, if you become an Australian national, you can use the E-visa.
Has anyone migrated to Australia and returned to US successfully on a E-visa?
Has anyone also applied successfully for a green card on a E-visa?

I think you can apply as Australina national but your priority date is dependent upon your birth country not the country of acquired citizenship. I have a friend who is an Australian citizen (born in India) and is stuck in retrogression.

There's no catch at all.....according to my lawyer. He said even if you come back on AP, you can still work on your H-1B so long as it's valid.

As far as I know, Until your apply for a H1 extension or H1 transfer on "Parolee" status, your status continues to be "Parolee". Lets consider this.
You have 3 years remaining on your H1.
You go out and come back on "AP".
Your status changes to "Parolee".
You do H1 transfer (or) your employer files for H1 extension at the end of the 3rd year.
Now your status changes back to "H1".
Here is the catch. You are a "Parolee" until your "H1" transfer or extension. In case your I-485 gets rejected during your "Parolee" status, you gotta leave the country (or) file for an appeal and proceed with H1 transfer (or) H1 extension to retain your H1 status.
Seniors, Please correct me if i am wrong.

In our case, the primary applicant has received FP but the dependent has not yet received, has this happened to anyone?
I called Customer Service and now they ask that we wait 180 days from the time the case is transferred to NSC before enquiring about it !

I have similar situation - I applied for 140 in July 2006. My daughter will turn 21 in July 2007. As I have applied for 140 before she turns 21, she is safe for GC, but will loose H4 status when she turns 21. As per my lawyer's advice I have applied for her F1 so that she can stay and continue her studies in US. When I become eligible to apply for 485, she can be included in the application - but, not as a dependent of H1B holder.I urge you to ask for second opinion. From my understanding it depends how long your I-140 was pending.

this will take you to the IO at the office where your case is pending, so it will transfer you to an IO at either TSC/NSC. if there are no IOs available, then it will transfer you back to the national service center which is useless in this case. keep trying until you get hold of an IO at TSC/NSC only. the wait may be 15-30 mins sometimes, please be patient. this method is effective than the SR route.

I don't think they will accept matriculation certificate as primary evidence. Since the birth certificate is initial evidence, you should contact your lawyer ASAP.
well..lawyer told me its a birth evidence and we can send BC later...seems like he may be looking for employers benefits..anyone knows if its OK..otherwise I may have to redo the medicals

I applied for my EAD renewal during last week of Nov 2010, it took only 42 days to receive my renewed card. It got 2 years validity, validity starts from the next day of current EAD expiration date. Even though current card is valid for another 2 months, pleasantly surprised to receive the new card in USPS priority mail. Overall, job well done by USCIS as for as this EAD renewal in concerned.
My priority date is Jan 2007, not sure whether by extending it for 2 years USCIS is not expecting me to be current in the near future. Personally I am expecting to be current during this July - Sep time frame. Worst case at least it should be a touch and go scenario, fingers crossed.
