Wait for another 2 yrs before you pull the plug.... I also returned back after 9 yrs in May 2009 but came back again in Apr 2010 , trying to Port up from Eb3 to Eb2 by accepting a higher position - this is genuine. The new company will file my PERM anyday ( AD was going on) and I'll leverage my Eb3-I old priority date of Mar 2005 which is CURRENT in EB-2 sector. I'm hopeful.
There are lot of challenges in India after being here for 9-10 years ONLY good thing is they will pay you good money because they will treat you as a 'imported commodity' :)

I don't want to continue with this uncertainity any longer and my children are growing up and I want to move on in my life. Negotiating a good job offer for a good position. Its not that I am going to get my GC in 6 months or let alone in 2 years with a total of more than 8000 people ahead of me. So, I am looking at a minimum of 2 years wait and I do not think its worth waiting any longer. Getting a GC in 3-5 years seems tobe a OK wait, but more than 7 years, I want to use my time in something else more precious. Did not mean to hijack the purpose of this thread, just wrote it because you asked that question.

It was a memorable trip indeed! 3 weeks before, I thought Houston to DC was a long shot. I kept reading the IV forums and saw the energy built up. Then I decided, I should definitely do something from my part even if I don’t attend the Rally. I said to myself, enough, I am going to announce in the Texas thread that I am willing to volunteer for the publicity work in Houston during the long weekend. That’s when I got a chance to talk to Texanmom. We had a conversation for about 40 minutes and once I finishing talking to her over the phone my position changed from “‘No way” to let me try to convince my friends and if I have company, I will go. I can always talk to my Boss later about taking a day off. Once I decided that, I kept calling all my friends in Houston. Sadly, I could not motivate people to buy tickets and fly with me to DC. My wife, then told me, if you want to go, you should go, don’t wait for your friends.

Early in the morning, GSC999 gave us a quick announcement session telling us what we need to do as volunteers and what was the plan. GSC999 - you energy was contagious. I was all ready and excited once I heard you talking about our plan for the day.
On of my best moment of the trip was handing out water bottles to all the participants who were standing besides the road showing their banners. This happened just before the actual Rally began. It was a nice feeling making all the folks comfortable and giving them water while they were all standing there for more than an hour flaunting their signs to the cars on the road. I was helping another volunteer in this effort and later found that he is from Houston too and is part of IV Core (please PM me your id if you are reading this). It felt so good that all of us were helping each other for our common cause.

my lawyer told me that dates will definitely move ahead next month. He was confident about it after talking to his contacts at USCIS i guess.
except that the visa bulletin is published by the department of state, not USCIS...
anyway EB3-India and hopefully EB3-ROW would definately move soon, they seem to have been pushed too far back out...

We EB3 folks are not requesting for EB2 visas. We all will be happy to get 50% EB1 spill over visas. The other 50% can go to Eb2s.
right now 100% of EB1 spill over is going to EB2.
Eb2 category gets 28.6% Visa number. Any spillover from EEB2 will only go the EB2. Why would USCIS change the rule and allocate the visa numbers from EB2 to Eb3. This does not make sense. I agree that spillover from Eb1 can go to both EB2 and EB3. There is no way this argument will fly that EB2 numbers be allocated to EB3. This is a statue and USCIS cannot deviate from that. They will face a lawsuit if they do so. USCIS is using the correct spillover procedue and I dont think they will change it. The only argument EB3 should make it that spillover from EB1 should go to both EB2 and EB3.
It is not individual qualifications that matter but it is the job requirement. So if you are in EB3 try to port it to EB2. Nothing else will matter.

Big movement usually comes in June (last quarter of the fiscal year) because DOS is not good in statistics (they are hiring US citizens...just kidding, no offense meant) and only that time it realizes that there are more visas to give. And then suddenly some big VB movements (i think DOS should hire us instead as statistician....i can make accurate VB...lol).
But I believe for FY2008, big movement will come on April (DOS doesn't like a repeat of the July VB fiasco).

Accenture and other big firms will survive without H1b by recruiting GC holders ,Citizens, L1 and B1. So there will not be any long term impact because of this bill. Still most of the H1 cap will be filled as the companies will try to comply the regulations. I do not see any issue in proving that no USA workers available if it is really the case. Right now if H1b and US worker is available with same skills Indian companies are purposefully avoiding US workers for obivious reasons. We everyone aware of it. Because we are impacted personally we are opposing this bill. This attitude will not win. We should be ready for some compromise if deadlock

When an employer hire an employee on H1, the employer is paying filing fee, lawyer’s fee and 8-10% taxes for hiring each employee. I raised a SR yesterday and here is the email i go today

I would suggest taking an infopass appointment and also contact your congressman. No guarantees but those are two options so why not try both.

What i am trying to say here is firstly reaching congressman should not be on the first day itself which some of the folks are doing, atleast wait for a a couple of weeks. and then regarding opening SR i would say atleast wait for around a week or 10 days at the minimum if you are scared of dates moving back. And yes i am not pointing fingers at any individual so don't take it personally "gc_on_demand"

The packet was just asking me to confirm my address, and my soliciters address and details. They sent a copy to me, my soliciter, and my employer.
was mailed to me on the 18th of april.
on the cover letter, it said i had been sent these because my PD was about to become current, and or a visa number would be available for me within the next 3- 6 months.
My take on the Mumbi consulate, VB, is just wait and see. It says most other countries, not ROW...and to be honest, i am not guna belive anything untill i see it on the state dept web site. in the full VB which should be out next week.
Im consular processing, im not even on the USA yet, i have had my job held open for the last 2 years.
i carnt see row moving forward that much but i think it will move a little. i dont think it will move back.

Well I really think this is reasonable suggestion to factor Priority Date to determine eligibility for citizenship. It could be 5 or 10 years past your priority and only after approval of green card. Currently many people wait for 8 to 10 years for green card and another 5 years to be eligible for citizenship and some lucky ones get green card in 2 to 3 years and citizenship in another 5 years. System should somehow be balanced to have close to uniform wait times towards citizenship for all.

how has our respective motherlands harmed us that despite being pushed around by US for years on end -we are desperately seeking US citizenship?? after all - in many cases - its the basic and advanced education received at our respective countries that has made us qualify as "highly skilled" immigrants here.....
