Hello, here are few practical things you can do right away:
1. Call your embassy.
2. Ask to speak with a Legal Attache / Equivalent
3. Explain the case in your native language.
4. Ask for help. Most foreign embassies are setup to help.
Tell them you are helpless. Dont know where to go. Given them 100% facts. Dont feel shy about the 'gory' details.
Remember, this is in the legal system now. Bulletin board responses from here are not as good as solid legal advice and help.
Next, find a local Chinese / Asian community organization. Google for it. If you cant find one locally, search for ones in big cities like NY, Boston etc and ask them for a reference. These groups are setup to help immigrants in distress. You might find an Asian-friendly or Asian lawyer willing to take up your case, FOR FREE. Just ask.
Finally, stop talking to all your neighbors. You can always reserve the right to file a Civil Rights / Discrimination suit. The American Civil Liberties Union (ACLU) can help. Call them. After you call your embassy.
This can be resolved easily if you have the right people on your side. Got it?

well said :) ..months and years are passing by ..it seems more hopeless for EB3 - I. for those who have hopes ..nothing will happen for eb3 till june bulletin ..even then it is a big if. all the world needs to get their green cards then all of china, India eb2 applicants will get their GC's ..and then when US loses all its charm ..and EB3 (I) applicants are in their 50's / 60's - they will get their stupid cards

I am in a similar situation. I applied for my first LC based on Skilled employee (Category 3) because my first job financial analyst only required a bechelor degree even though I have a masters degree then I filed for the I-140 (priority date May 2005). then I got a promotion to a senior financial analyst which requires a masters degree. so I automatically could apply file a second LC to file under (category 2 which is current). however my cecond LC was denied because the DOL thinks that there is no difference between the 1 job (financial analyst) and the second job (senior financial analyst) with the same company. so I checked with my lawyer and he said that I can file for appeal so the DOL will review their decision and realize that it was wrong. I did file for appeal in Sep 2006 and I ve been waiting since then. does anybody know or have any idea how long the appeal normally takes so they can make a decision on my case?? please advise. Thank you

We all are working and in this economy everyone is worried about losing job if they don't go to work. I have two little kids and I work full time. I already used the vacation that I got for this year, it because of kids being sick one after the other and need to be off again next month for loss of pay for a kid's surgery. I know its just two more days and might result in something positive but I can't take a chance of losing my job and then don't have a job when it�s time for my 485 to be approved resulting in denial.
I will donate money but unfortunately, I can't come for the advocacy day. It is a sticky situation for many.

First of all, please be decent to each other. Now, to the PBEC issue - this is a major problem, and a huge issue for all of us. Currently, the debate in Senate/Congress is centered around Immigration reform and this is a definitely a good time to raise these issues.
There are a few things we should strive for:
1. Keep all provisions of Specter's bill related to EB.
2. Re-instate per country soft limit.
If both of these provisions are passed, Priority dates for all countries will be current in EB2 and will rapidly move in EB3. A lot of folks in PBEC might be able to use PERM to apply another labor and priority dates will loose their importance, so it is important that these provisions pass.
This is just the kind of disingenuous logic we do not want. To suggest that folks stuck at PBEC should just file PERM is (a) just like asking people to drink coke instead of tackling water scarcity (b) reflective of the ignorance of the situation faced by many stuck at PBEC.
Note that IV has a stated goal of solving the BEC issue (6th listed goal on the homepage). The goal is not to make light of the BEC problem by using apparently simple but false logic; the goal is to resolve the BEC mess.
Do not try to play down what is important to others and hijack the agenda to suit your problems. We have all come together behind each of the stated goals of IV. Let's keep it that way.

No vkkkk, I'm not playing. What some people are saying is logic and what i'm saying is the fact. You seems new in this form. But i think most of the people here are serious and try share their sufferings, free help from freinds (virtual).
Anyway, My lawyer used the PERM. right after i received my Labor (may 2006) I had to renew my H1b which took 6 months (regular processing). After i received my renewal I sent my I-140 application. I didn't even bother to use the premium processing for my i140 because the i485 was not current that time, instead it way way back as a EB3. anyway, you know the rest of the story.....

After you wait for 7-8 years in your category for your visa your thougths will change. I have MS from an american university + work experience. Our lawyer decided to file EB3 in 2001, they convinced the company that EB3 is easier to get approved. i am still waiting for my GC, in the mean time i have gained a lot of experience, i am still an EB3 for USCIS. There are many in a similar position.
People talk about unethical practices etc. i feel that they ones who jumped the queue and used agressive lawyer already have their green cards. Most of my friends are already thinking about citizenship (and ROI after USC..that is a different forum :)).
Its people working in multinational companies who follow the law by the book are the ones who get screwed, its just my observation and opinion ..good or bad, i dont know...
When there is a overflow, I strongly feel that it should flow to all the categories and that is called equality. Some inefficient people in Decision making authority at USCIS framed a rule on visa overflow and they are following it. If the rule is not much logical/ethical to most of the people, then anyone can voice their rights against it.
Just for example, a team consists of one project manager(EB1), two tech leads(EB2) and 6 Developers(EB3). The demand is based on no. of vacancies exists on the market, that means a lot of EB3, less EB2 and few EB1.
As per this rule, USCIS is not actually feeding the hungry.
Regarding the country quota, US is not favoring/helping the foreign countries by giving GC to those people from them. So, it makes no sense at all when it comes to immigrants but I can understand the bureaucracy behind it.
If they are implementing the country limit then it should be like 0.00001% of that country's population, I feel.

A question to the people who used AC21 and on EAD:
I am on EAD and changed job (six months after the I-485 is submitted). The new employer - a well know tech company - insisted on sending the AC21 letter to USCIS, and I sent it. After sending the letters there were LUD's on I485 applications for me and wife and I assumed the letter reached the files. There was no activity after wards. Recently my wife went out of country and while coming back she went thru the AP parol process. The immigration officer asked her a few questions, one of them is where I am working. She mentioned my current company which made the officer to have a question mark on his face (the file he is looking at has my previous employer name). We were expecting this to happen and my wife quickly explained to him that my application was sponsored by so-and-so company (my previous employer) but later I changed jobs as per AC21. She even had a copy of AC21 rules with her. There was no problem but she was kept in waiting for another 30+ minutes until the immigration officer talked to 2 other officers. She got the impression that most of immigration people there are not really aware of AC21 and this made us think this could be a potential issue for those who used AC21.
Did anyone had any issues like this. We were lucky not having too much of a hassle but was thinking on how to handle these port of entry interviews if someone used AC21.

First of all, the letter is not a requirement when you switch jobs. It is a matter of personal preference on whether you want to send the letter. So there may not be any record in your file about the change.
I have travelled using AP. I was not specifically asked this question.
Now, all Immigration officers may not be aware of the AC21 law. It may be good to mention the law and wait for them to verify. From your example, looks like it is good for all the family members to know the AC21 law and maybe carry a document stating the law.
Its a good heads-up for some of us who have switched jobs to carry AC21 document.

I have sent another email to the editor. Although they have provided an "Amplification" section under this article that says that the item wasn’t intended to imply high-skilled workers are illegal immigrants, the paragraph in which they report the poll result on illegal immigration went under the bold heading "High-Tech Employers". They should either correct this paragraph to exclude any mention of illegal immigration or change the bold heading to a more appropriate general heading on immigration issues.

For instance EB-3, numbers re-captured didn't all go to EB-3. The amendment gave 61,000 to Schedule A and then re-distributed the rest equally.
A much fairer, simpler and permanent solution is to simply rollover the unused numbers to next years numbers.

Many people that buy term insurance are not paying more premium so that the savings between term and whole can be invested in equities. This is the norm in the US. In India it is true that ALL your assets "could" end up in real estate. So for a person that intends to live here until old age will have cash and or equities. Financial planners reccommend term because one would need the coverage until a major mile stone in life is reached - paying off home mortgage, children completing college education, etc.
I have done some research and MOST financial planners suggest to get term insurance. They say not to mix insurance with investment. Statistically, if you buy whole life, the rate of return is negligible because so much is eaten away in fee and admin charges.
The only issue here is that Term will cover you till the age of 60-65 if you get 20-30 year fixed rate policy. But if you still have immovable assets at age 65, which you surely will, that you need protected for your dependents then you will not have any coverage at all because Term will last only its stated duration. If saving/investing during young age is the objective then Term is good, no doubt, because it's cheap and covers you from risk during young working years. But I guess no company gives Whole Life on H1 so there's not any other option.

I do not believe original employer was involved in any Fraud but he did have financial trouble ( paying salary after 2 months , check bounce etc - that is the main reason I left) .
That company is MSU software based in Iowa ( just in case if anyone knows about it ) .

I had switched attorney as soon as I joined company B and they AC21 and I have copy of the all the docs including the letter requesting to remove the old company A attorney . Also last my company B changed the attorney firm to a different one and they did sent a new G28 for that .
I am kind of stressed until I see the letter which is going to be delayed because of the snow Storm :( .

I know what you're going through. My own case got denied by someone who'd only been in the job for 2 weeks and she denied it because she said I didn't provide a document which was not only provided, but they had two copies! AND I saw it while she was fiddling with my file at the interview. Sometimes, it's just sheer back luck. So if you know you have everything you should have in your file, just chill. It's another bump in the road and it'll mean more waiting for you, but it's not the end of the world.

I know what you're going through. My own case got denied by someone who'd only been in the job for 2 weeks and she denied it because she said I didn't provide a document which was not only provided, but they had two copies! AND I saw it while she was fiddling with my file at the interview. Sometimes, it's just sheer back luck. So if you know you have everything you should have in your file, just chill. It's another bump in the road and it'll mean more waiting for you, but it's not the end of the world.
