Looks like it is the photos. I got the RFE after opening a Service Request and they have asked for photos. Morons. They could have made it clear in the instructions to send photos.
It doesn't happen to everyone. A couple of my friends got the ead without sending the photos. It all depends on who processes your application. If he is an ass, you are in trouble.
So, better send the pictures if you are planning to e-file.
I have sent the photos and now have to wait for another 45 days. Hopefully a smart guy who knows what he is doing will process it this time.

Dont buy air tickets that fly thru UK. Be a dignified India and question why they need a transit visa, when you are not going to set even 1 inch outside the airport.

The people with Master's in STEM are expempt from the cap.

Get an employment verification letter from your HR, if it says Business Development Dude, and gives your new role as a guy who sells rather and codes, then you have a problem -- that is if USCIS gives you an RFE.

Winner, Could you or somebody please inform the blog owner of the issue (I am not visting that site again :eek: :mad:). I lost a day due to the virus, don't want anyone else to experience that... this was a pretty nasty virus. Be warned & very careful out there guys!!

Please do not mix social issues with immigration, this is not a forum about one particular country or its social manifestations (like how do I marry?, should I stay single forever? How am I going to find a girl?). These questions are absurd from American / immigration standpoint. If you already have a spouse and have immigration issues related to those situations then yes that is valid to ask here but otherwise (But how do I get the spouse then???) is purely a social / cultural issue. Please stick to immigration issues.

assuming 60% of those are for EB2 and EB3 (EB3 other workers are also included in the total 83151 count) = 49,890 ~ 50,000

Your employer cannot revoke approved I-140 after 180 days of filing of I-485. AC21 portability law clearly says that. Your employer is playing with the lifes of employees. He cannot win any case in this situation. You better look for another employer and move ASAP. Also, you cannot keep PD as it is somebody else's PD. Eventhough you/your can try appealing with no chances of winning, but you/your employer is trying to spoil the life another person who got GC.

- what is the possibility that they don't depend on Gov from the day they get their Citizenship?
- Illegals are here from more than 10 years....do the average age is around 40'.... they may work for 10 more years and then depend on Gov.
It is a know truth the advantage of giving GC to Legal EB's then Illegals but as you said we need clear message posted....

I do not have knowledge of that you can convert your H1-B application to PP after you get a RFE. But as far as I know that if your application is pending you are safe, in the mean time why don't you find a new employer and transfer your H1-B to the new Enployer.

I only have something to say, everyone is looking for its own turf, and if you really want diversity in the forum, the hard count will not attract anyone else other than Indians and Chinese. I am few months from working due to EB2- Worlwide category (current), so any change on the hard count is not on my benefit, same for anyone who is not from India or China, the EB3 is not current worlwide but the line of all the other countries is still shorter, if you really want to reach more than Indians and Chinese the goal has to be good for everyone, and the hard count is not. What the hard cap does is that say for example in the EB2 category the Indians and Chinese use up their quota. On the other hand the rest of the world uses only 50% of their quota (about 10K EB2 visas leftover, just a guesstimate).
1) With the soft quota, this leftover is given to the over subscribed countries in the SAME CATEGORY (Eb2). As a result, other EB2 candidates from India/China benefit
2) With the hard quota, this 10K now goes to UNSKILLED immigrants.
This amendment DOES NOT TAKE AWAY anything from the rest of the world at all! All it does is benefit SKILLED workers. Isn't IV about skilled workers? Why are some folks whose quota will NOT be CANNIBALIZED against this and consider this an issue of Indians/Chinese Vs Rest is beyond me. It is a matter of EB1 vs unskilled, EB2 vs unskilled and EB3 vs unskilled!
