I will advice you to try to get H1 rather than get J1. No doubt J1 is easier to get but on long term basis, it is much harder to convert and takes more time and money. I have gone through this.

Relax guys. My online status still showing "Fingerprinting fee rejected and case is in suspense" despite having finger printing done at ASC a year back.
I cannot confirm or deny the following piece of gossip but...
A mistake has been made on the system for payments. Some bright spark for got to put a so called "where" statement into the billing system for USCIS after the pricing structure changes went into effect. I am told this is being dealt with, but some applicants may find incorrect fees on their accounts pop up. Each lawyer will have different way of dealing with this problem. If you are pre price increase and have a suspended case; this maybe the reason for it...

Employee is responsible for the accuracy of the time sheet submitted for payroll. If Nathuram-daulathram-desi-Company pays you and we did not get the money from the client, he/she are responsible to reimburse Nathuram-daulathram-desi-Company all the amount that is under dispute within 5 business days. Employee is responsible for all the legal and administrative costs (attorney, collections etc) for enforcing the above terms. All disputes will be settled according to the laws of the sate of NJ.
Are you serious you want to sign something with that wording. If the employer and client have their own agreements (like delay of payment for 60 days or so), then you will be always struck with your employer until the end of this project.

It is FBI that is responsible for namecheck ... not sure USCIS has any control over them. My understanding is I-485 premium processing would apply only to USCIS processing of the paperwork.

Why not? They have to send the receipt notice on time. They have to send AP / EAD within certain days. Immigrants plan certain events based on these laws. If anyone decides to prepare and file a lawsuit for not getting EAD, he/she could do it now as per the law. Some one said, there is a law that they should be giving EAD in 90 days.
Again EAD is valid for only one year. You have to file in advance and you will get one year from the date of filing or approval I am not sure. If you dont get EAD on time, then youare not supposed to work. PERIOD. If this happens a lot, then lawsuit is for sure from someone like me who have family with two kids and play by rules. I have strong backing of my company HR.

I applied my first H1B extension through my company in June 2008. On 11th Feb, I received REF. I am very much tense about it. Since I am out of project. I got cleared my I 140 with this company in July 2008.
I applied H1B transfer(Normal process) also in October 2008 to other company . This one is still pending.
I am very much tense about my status. Please suggest me what to do?
Is it better to answer to RFE for first company?
or
Can I do PP with second company? or else any better thing?

Due to a slowdown in their business, my employer is laying me off in Dec '07. I'm still short of 1 month to complete my 180 days of I-485 filling. However, they said they will not withdraw my I-140 and, to help me, will in fact keep me on their payroll until Jan '08, with my Jan '08 salary as my severance and my official status as on "paid leave". So far, so good.
I also have a job offer, and my new employer wants me to join them in Dec '07, on EAD. My question is: Can I be on officially on the payroll of two companies simultaneously on H-1B and/or EAD? If yes, do I need to inform the USCIS of my status (new employer; AC21)? My other option is to say No to the new (attractive) job offer (or to try to convince them to wait until Feb '08, which they'll likely not agree to), and and take up another job in Feb '08, on EAD / H-1B transfer, using AC21. Please advise whether I'm fine with using the first option!!
you can be on the payroll of 2 companies on H1 if the H1 petition says that its for concurrent employment. On EAD no such issues, you simply sign new I-9 forms with both employers.
If you are moving to EAD, you can start with second employer right now. If you are going to stick to H1 for some reason, then delay joining the new one by just a few weeks. By the time they file the H1 transfer and the approval comes through, your 180 days will be done or nearly done and you are all set. Its nice that your current employer is helping you out through the 180 days.

Today, I filed an official complaint with IRS about this employer. They told, they are going to send a notice asking the employer to reply to the tax bearer within 10 days from the receipt of the letter. I don't know how the employer is going to react and if they would still provide a corrected W2. Hoping, they would provide, otherwise I would have to call IRS again after another 2 weeks time. I had to be on the phone line for almost 30 mins to reach the IRS customer representative. It is a real pain.

If your eb2 gets denied, hope you have eb3 keep running as it is right?

The USCIS has not taken any official position on whether they would allow the after I-140 3-year extension to be transferred to another employer.
Using this loophole looks like many of us have actually sucessfully tranferred the H1B to a new employer after the 6 year limit..
As long as USCIS does not release any regulations...We can do this ....
If asked officialy some attorneys say that it cannot be done and some are fine with that...
Immigration laws are kind of applied sporadically and can be pushed to a certain extent

best is to find another job..and do a H1 transfer premium processing..since the RFE was with his company and not his credentials he should be safe..
My i94 expired on May 18th 2007,filed for extn around May 11th..then I filed for a H1 transfer on June 25th before the H1 extn was approved,we dint have the H1 reciept notice too as NSC was delaying issuing of reciept notices..
thankfully it was approved though the earlier H1 was not extended(this is called H1 bridging...)
but it may raise flags to the Immigration officer,cos the i94 expired in Dec..rfe was issued..better to consult attorney instead of taking wild chances..
trust me 1000$ speak/work a lot in these issues..

I got my FP apt on 12/14. There was no lud on my 485. I had opened SR for fp in october, but didnt help. Then I used the POJ method to get hold of IO at TSC on 12/7 and she created one for me, the notice date on FP says 12/7. Hope this helps.

nmdial I dont think the registrar will issue a birth certificate based on affidavit from the parents.
Usually for people who dont have birth registered at birth or hospital records we have to obtain a non-availibility certificate from the local authority. Along with this certificate we submit a notarized affidavit signed by one/both the parents. Now we have learnt that this affidavit has to be signed in the presence of the registrar. Hopefully that should be ok then.
My parents had submitted a notarized affidavit to the registrar (death and birth) of the local municipality and obtained my birth certificate. That was in 2006, the rules may have changed by now.
