My attorney told me that DA offer is not negotiable if just from my attorney side. I knew they have not good relationship, probably they have too much un-happy fight experience before. As before my pre-trial conference, he mentioned she (DA) does not like him. :(
So that day my attorney give me 2 choice, go Trial or accept offer, I select first one. We already set a trial date at July. We have problem on strategy I think.
Yesterday, I have conference with my attorney, he told me he could try to get that offer back. I don't know if trial already set, I can still change idea??? My attorney suggest my wife mail that DA directly and tell her the truth and see if that can help reduce or dismiss the charge. Now we prepared on this.
One more thing, my charge is level 1 misdemeanor, not felony. Is that same excuse for deportation right away? What BIA stands for?

This is a serious matter. Make sure that you have an attorney that understands both the immigration and criminal consequences of this charge. From your description it sounds like your attorney is just a criminal attorney.
NEVER NEVER plead guilty to this charge. Force your attorney to meet with the DA and try to get a Pre-trial diversion (in which you do not have to admit your guilt in any fashion, volunteer to do extra community service if the need be). The definition of "Aggravated Felony" is much more stricter than any state's version of Felony. On top of it all in the eyes of BIA judge this is a Domestic Battery (No matter what the state charge indicates), making you deportable right away.
I don't want to scare you but whatever happens you should not plead guilty to this charge. If nothing works out you are better of taking you chances with the trial (Especially since your wife can back you on your story).
I hope this helps... Get a competent lawyer who understands the gravity of the situation.

There are better chances for this bill to pass, since this is tied with the family immigration. We should put full energy to get this bill passed and start a funding campaign ASAP for this bill.

One simple suggestion which is less comlicated than all those above.
BTW you don't need rbi clearance.
You can send an overseas wire from india through your bank a/c where the cost would be minimal( only exchange rate diff and cost of wire($25-50).
Your parents can safely gift you $100,000 a year. Your bank only would need a letter from them saying its a gift.
I have tried this to repatriate my assets and it works all the time.
No need to open nre or nro a/c or anything.
ps. don;t entertain any solicitation on this site for reverse hawala or anyhthing as you don;t know who will cheat you!

I have nothing more to say guys. what some people are saying is logic and what i'm saying is the fact.
Anyway, My lawyer used the PERM. right after i received my Labor I had to renew my H1b which took 6 months (regular processing). After i received my renewal I sent my I-140 application. I didn't even bother to use the premium processing for my i140 because the i485 was not current that time, instead it way way back as a EB3. anyway, you know the rest of the story.....
Shimul999 may not be trying to play or may be doing so, only Shimul999 knows. But there are legitimate observations such as below (Assuming s/he provided all information for his/her case correctly) can lead any person like VKKKK to believe that.
1) He is claiming labor filed in Feb 06 and he got approval in May 06 (As per

Guys,
I keep hearing that "STEM will be exempt from the quota". What EXACTLY does that mean? Does it mean that:
1) STEM's can apply for 485 straight away if labor is approved regardless of PD?
2) STEM's still Cannot apply until PD is current, but after that no more waiting for the country quota

Just out of curiosity how many of those 60% were citizens? I know a lot of friends who have put in extra 5 years to get the citizenship.
I think aging parents is probably the biggest and valid concern a lot of ppl have.
I think there are plenty of people who always planned to go back .. the GC /USC was just a career advancement tool for these people. In fact, a survey of US returnees to India after 2000 shows that the majority (around 60%) were USCs/ GC holders, which is clearly an indication that the relocation was by choice rather than any immigration issues.
And finally, many of us have family issues like taking care of aged parents which either makes the re-location inevitable or in some cases may coincide with career goals.
I have seen that most ppl who have been here for over 5 years have almost fallen in love with the possibilities. They talk about going back to take advantage of the booming growth but very few actually do go back.
Or maybe some of us came here precisely for the reasons you mention, seeking greener pastures but fell in love with the openness, informality and the possibilities here .

IV currently has around 950 registered members. If every member were to contribute $100 each, we should have close to 100K today. We think that is a very realistic picture. In fact we were banking on that kind of support when we started this effort. We are not even close to that number.
Guys, the core team of IV have really slogged to reach a point where our voices are being heard. By not contributing, please don't do a dis-service to yourselves and all others involved.
This is an appeal to all the members that haven't contributed yet, PLEASE CONTRIBUTE AT LEAST $100. Most of EB workers have decent jobs and enjoy a decent lifestyle. $100 is not too much to ask, for what is at stake right now. Given the number of people affected, one would think acheiving the contribution target is a piece of cake. PLEASE STEP UP NOW!!
