you probably think you are the best and most skilled since you are from Dominican republic, and perhaps will not have to wait for a GC or even citizenship all that long. Look around, open your eyes, there are people from India/China who have been on this rollercoaster since 2001, and deserve a citizenship.

How much clout does this congresswoman have? She seems to understand the entire scenario better than any american soul out there! It also seems like she has spent a lot of time on this and understands the system very well.
I guess it remains to be seen what kind of impact her letter will have on USCIS. Obviously, USCIS did something unlawful.

I am confused about CSPA
My child will turn 21 march 2009, currently on EAD from the I485 filling in July 07, I140 approved in July 07, PD is Feb 07. I have not received any letter from USCIS about the immigration age of child being locked in at filling. Where does my child stand now?.

feels like the last day of the annual exam at school. All the hard work for the whole year..going through a lot and finally writing exams..You just want to get over that "last day" of the academic year. ...But hey..we all went through it and went past that day....Our such day is around the corner and we can hardly wait ....

you should definately not get a ear/headache . That is not good. We should talk about this. Are you walking at a moderate pace?. Did you start out too fast?. you should always start out slow. you can start at the same pace you walk from your car to your office. That was what I did 7 years ago. See if you can walk for 30 mins at the same pace you normally walk from your car to your office or even try for just 20 mins. Do not worry about speed at this time. We will gradually build you up from walking 20 mins to walking 45 minutes at a Moderate pace. I can work with you personally on this if it is ok with you. I have helped a few people with their health and wellness goals over the past 5 years. That is my favorite hobby actually
guys.. 30 minutes is a LOT.. I think I walked a little more than a mile. Feels good, but I think I'm getting a ear/head ache because of all that blood pounding in there.

Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

You have to take things in your stride man. We all know this whole process is broken, but lets cheer for our fellowmen who are lucky to apply for I-485. Your time will come around soon. Cheer up!;)

For 485, proof of valid status in US is required - Valid status in the US is determined by i94. u need not have a valid visa stamp. Note that I485 can only be filed if u are in the US.

Can I file for I-485 while I am waiting for I-140 approval. My PD is current under eb2 and my I-140 was filed on Jan-2007. I am going to upgrade to PP for I-140 but since lots of people will start going to file for PP, it is very much likely that NSC will issue RFE to reduce there workload. So my question is while I wait for I-140 approval, can I file I-485?

I have renewed my passport and my wife's a couple of times in through Houston (That tell you how long I have been in the US without a GC). It typically takes them 3-4 weeks (Rush service is also offered). You can opt to pick up the passport in person as well. If you have been waiting very long for your new passport, call them up and speak with them. I have noticed that it help greatly if you speak with them in Hindi instead of English. Goodluck.

1. GC is a permanent visa. One has very limited rights. For example, GC holder must be inspected and admitted into US after a foreign travel like any other non-immigrant visa holders. Therefore, the admission into USA after a foreign trip is not guarentted always for GC holders, if IO/CBP officers flex their muscules at POE.
2. If you have US passport, you don't need visa for most of the countries in the globe. Your passport will be always fresh and most of the pages will be empty.

I did noticed in above 485 document requirement it states Copies of Form 1-94 and H-lB visa stamp , do we need to have H1 visa stamp on passport ? Will it not work with H1 Approval Notice ?

Look at your H1 notice carefully. In the bottom left portion it says I-94. If your Visa Stamp has expired along with the I-94 that was issued to you when you last entered the US, then the I-94 on your current H1 approval is what they expect to see to make sure that you are currently in status within the US.
