    Scythe - that would mean that the three tied entries would get around $85 dollars (150+100 divided by 3), and that seems a bit unfair considering second place is $150 and third place is $100.

    I'll get the poll up right now. It took me a little longer than expected because Temp poked me in the eye with his poke.

    Technically this is a tie for third, not first. So all of the first, second and third prize money could've been combined and split between the three tied entries.

    But run-offs are better anywho.

    After eight years my husband is almost able to work (waiting for EAD) and my son has aged out for derivative benefits and is on an F1 with no realistic path to permanent residency and eventual citizenship.

    I agree, those who crossed a border illegally or overstayed are now looking at the American Dream being handed to them.

    The DREAM act, if it stays in the legislation will give the children of the illegals state tuition rates (I work for the university my son attends and found it hard to get in state tuition rates for him) and they will also get conditional residency and will be able to apply for their own green cards after five years.

    Amazing really, that we are seeing and hearing this in the land we chose to live in which claims to be a land where the rule of law is paramount.
    I am in the same boat. Waiting in GC line for 5 years. LC still pending. Two children - one aged out two years ago, other will age out in 3 months. We were hoping that DREAM Act will get them through. But no, that benefit will be reserved only for children of illegals. Only they will get in-state tuition, and can apply for GC till age 30. If you are child of legal alien, you age out at 21. What a cruel joke!

    Hi,
    I got my EAD today...Even i received my Wife EAD also...Mine is sent to NSC on july 2nd...I received EAD's from Texas Center...I think my application was transferred to Texas...I have approved I-140 from Texas...Are receipt numbers for EAD, 485, AP are in serial? I haven't received receipts yet...I filled G-28...my attorney did not receive my receipts...I don't know what is going on...

    please don't post information you are not sure of. unless employer withdraws H1 there is no way USCIS can know of this. (Employers are not legally bound to file for H1 withdrawal) Also I would like to know the source of your 'zero tolerance' policy in regards to H1. In fact they forgive upto 6 months of 'unauthorized' employment when processing I-485. (http://www.murthy.com/news/n_nscuna.html). If they wanted to have 'zero tolerance' they would have forced employers to withdraw H1 or atleast inform USCIS of layoff.
    Also you say "one should inform USCIS before I-485 is approved'. Again this is wrong information.
    Please do not start fear mongering based on incomplete information.

    I hope you "heard" it from others too and i read those things from some immigration sites . Don't have exact link. And GOD save folks from USCIS when people say they have N number of days of grace period for H1B status .

    My wife worked as a consultant for first half of 2008 with a desi employer as an employee (on W-2). After many calls and emails we received W-2 Thursday that has income and taxes of only first two months. Now he says that he showed remaining 4 months as his profit so he can only send 1099. Please advise if I can take any legal action against this employer.

    Just tell him you are going to inform about this to IRS and see his reaction. If nothing happening call IRS and report. You can amend your Tax written for extension. So you wll get time till Oct 15h.

    I want to start a new EB2 application but my manager is not willing. Actually, my labor is MS + 2 years but my attorney thought my I-140 will get rejected since I have included 1 month of internship in those 2 years of experience. I have masters + over 8 years of progressive experience. Working in the position over 6 years. Not blaming anyone just ranting because I don't want to change jobs now.

    You can do hero worship of your lawyer whoever it is. I will not.
    Ask him/her if he will do advocacy effort for you or sue USCIS since all his clients are struggling in the long wait and spending a lot of money on immigration consultations, fees etc.

    Ask him if he contribute to IV instead?

    Ask him to give you priority instead of your employer who gives him business every year.

    Ask him why AILA is not giving you regular updates through him. As clients of lawyers we should get regular updates and prompt responses. What are they doing about country caps removal, end of retrogression, recapture etc. I mean they are so powerful, so why can't they do it for us so that we no longer need lawyers and save a lot of money? Arn't we all spending thousands of $s on immigration attorneys ? and only few of us pay only $25 and many are free members and get such a good service from IV website. We all hate to pay a single dollar to IV and accuse IV core of asking contributions every time there is a drive but IV still helps us. They need to learn from us.

    Why none of us has the courage to do it, but we have the courage to trash talk IV and blame its core for not working hard enough for our $25.

    Whats your skillset, I can try to get you a project. No offense, but you do seem to have too much time to loose-comment on others and contribute nothing.

    Right now we don't have any savings, paid off the car as of Oct 30th. I was trying to figure about the money which we are going to save from here on...I will take all your advice, sounds so logical and keep the emergency fund for 6 months aside.
    Coming to the city we live, it's a small place in Florida and not many employment opputunities for techie people. Like I said I am working for state while my spouse is consulting and travels every week (can't find a job in his area). We never imagined a management change leading to a risky and frustrating job situation, making us to repent our buying a house. Because the moment I stop impressing this new boss, we are out. Huh...I don't want to imagine that, because we will be left with a house we can't sell or rent (don't know if some one would want to rent it) and have to move.

    Looks like if the LUD didn't happen on the day or the following day of the FP, it won't happen at all for FP.

    My FP was done on 20th Sep and no LUDs at all. My 140 is also not approved yet I first thought maybe that is the reason for no LUDs after FP. But I see so many of you not getting LUDs...

    No LUD Update (NSC) for the last 2 days after FP. But EAD card has been ordered. Its very difficult to predict how they operate.

    The only requirement is that both I-140 must have same beneficiary and all I-140 must belong to eb-1, eb-2, OR eb-3 preference categories.

    The Priority Date recapture applies ONLY for immigrant petitions (I-140) approved under EB-1, EB-2 or EB-3 classification.

    My H1b is going to expire on April 17th. I had found a new job and they had applied for my H transfer on March 27th. I would like to know

    1. How many days is required to get a H1b transfer receipt.

    2. What happens if my H1B expires before i get a receipt.

    3. Should i go on EAD or continue on H1B. My wife is a green card holder for last 3 years 6 months.

    The second bill (HR 5634) says that people with PhD from US universities are cap-exempt from EB. So it means some quota will be freed up from EB1 and also from Eb2-NIW.

    Read all the bills. I guess you are bummer !!!!
