The first thing to do in call your attorney and ask him to be with you when any uscis or ice guy shows up. Right to an attorney is a basic right. Do not think that u will offend ice officer if u have u'r attorney present. Do not think that u'r charming personality will put u in the good books of ice. If I were u, I would not do anything, without consulting my attorney in such a matter.
Also, keep bank stmts and all recent paystubs handy, along with past exp. Letters and degree/certificates. Copiew of h1 + gc petition/approval would be good to have.

I have one week from now for his visit. He gave me his desk number too. So I guess he is still an ICE employee. I did not call him at that number though.

My lawyer is asking 350 for EAD and 500 for AP for each person excluding filing fees.Is it normal.or Can I go to another lawyer for EAD and AP who is cheaper than my company lawyer.
In general they are inclusive ie 485 + EAD + AP for primary is $1000 and for additional is $500 which is a standard.

Very sad to see this coming from the Core Member...Are we losing hope here, is that the game plan are we looking after putting tremondous effort for all these years?
Here is what you do if the bill passes without amendments:
Get some sun-tan. Wear a baseball cap. Put in jeans with oil stains and bad quality collarless t-shirt. Grow an untrimmed mustache. Lose the dress shoes and wear cheap jogging shoes.
Go to the nearest USCIS office (after this bill passes) and say that you have been working off-books illegally at a nearby restaurant since 5 years and now you would like to apply for Z visa.
They will give you a probationary that will work like an EAD card (maybe better quality than EAD with it being tamper proof and wear proof). In the meantime, once the borders are closed and certain benchmarks are met, you will get Z visa with Advanced parole to replace your probationary card. With that advanced parole you can travel outside and come back in guaranteed (Guaranteed return due to AP). When outside you can file for GC, visit your parents and relatives, spend a few days in vacation and come back with full freedom to work anywhere without LCA restrictions and enjoy the Z visa that you can renew on your own (no need for employer sponsor).
They will give GC to all Z visa applicants within 5 years thru supplemental increase in GC (based on survey done by DHS). The annual cap will be total Z visa holders divided by 20%. If there are 11 million illegals who end up getting Z visa, the annual cap will be 2.2 million.
That 2.2 million beats the hell out of the 140,000 we have today for legal skilled immigrants or the 90,000 we will have with this new bill.
Advantages:
1. No need to comply to speciality occupation. Work in any line of work.
2. No need to get labor cert for GC.
3. No need to depend on employer for temp visas like H1B and GC sponsorship.
4. More travel flexibility due to advanced parole that comes with Z visa.

I have 14 years of education in india and 20 years of experience in IT - if my job requirement says bachelors equivalent + 10 years experience will it qualify me and job as EB2 ?
AS long as the requirements are standard across the board(industry) other wise DOL will request to prove the business necessity through audit. :o

You have said you have 3 yrs diploma + 1 yr bachelors, I assume your total years of education is 14 yrs(10 yrs school + 3 years diploma + 1 yr bachelors/coll/Univ). This not even equivalent of Indian bachelors, you can substitute your job experience towards educational years .
Ummm.. I did not know that one can do a diploma after 10th grade in India and after that, a year to get bachelors? You are right... its not very clear from the original post.. and can easily be misinterpreted as (10+2+3+1) which is 16 years of education.

many other states including mine has this requirement after 9/11. They require latest(within 1 month) employer letter saying what my name and address is and I work for them.

We have been calling and talking to ppl all over new england area.
But we have hardly been able to get a convincing number of ppl to attend the rally.
Have you watched the bus thread for New England Area. 26 votes, can you believe that.
We definitely need to get more innovative. I dont know what ppl want, so they can be motivated.
Sometimes i think being educated is a curse, as ppl become more scared and are fine adapting to the system.
Look at the ILLEGALS at least they came out openly. They dared to come forward and i am sure they will be rewarded sooner.
LEGAL ppl who have nothing to fear are then also they are more scared to do anything. So this is the right time for me to express my opinion LEGALS ARE FOOLS.
Please dont be mad at me, i am just frustuated with ppl responses, but one thing for sure, i will keep on motivating ppl in whichever way i can do.

I 100% agree with you about visa capture...there is no way any of us will get GC without "spill over" from ROW category and that will happen if visa capture happens...
Without the spill over from ROW it will be 20+ yrs (many people have posted the calculations...).
However, The one thing that just does not make any sense (It is also there in Mr. Oppenheim's statement):
They have 120k preadjudicated applications and if they have quota of 140k next fiscal year, are they goint to give GC to those 120k.....??????

For example: if EB2 ROW is "current" in Jan 2010, and say someone from EB2ROW files 485 (his PD may be in mid 2008), they will have to give him GC first eventhough they may have a "preadjudicated" EB2 India case with PD of 2005. (if it is not current then).
Additionally, they can "spill over" only in the last quarter...
So all in all, I do not see much of GC approval till the last quarter of next fiscal year; those 120k preadjudicated cases will sit in show case....

For those in the Bay Area: Have you contacted the new Indian Community Center in http://indiacc.org/Default.aspx (they have locations in Milpitas and Sunnyvale)? I don't live in the South Bay, but it seems like this is a pretty active space. Wonder if they would let us give a talk, and/or post flyers etc. If no one has been in touch with them, I could try.

There is a lot of bad rap that we the legal immigrants have to face because of the rampant illegal immigrant problem, most of the folks here gets peeved off if an act has a bias towards that.

Its not only for illegals but its also for kids of legals that aged out due to retrogression or backlogs in visas...plz don't be selfish with view points like "it doesnt help us so im gonna oppose it"....instead help the children who aged out due to the visa backlogs!!! Thats true..everybody are bothered about EAD and FP. I am here for more than 8 years in this country. IV should emphasise this and USICS should allow affected candidates like us to file I-485 and atleast get EAD. we have priority date earlier compared to others.
I missed the date by just a week:( .Not sure what to do here . People on the forum seems to be concerned about Fingerprinting and getting EAD's only .
Same situation here too. My husband came to this country in 1999. Filed for greencard in 2004. Labor was sent to philly BEC and it got cleared in September 2007 so we too missed the window too. Not sure what to do

On a separate note, how can you start a thread demanding something from "IV" when you and few other people on this thread, stuck in backlog after 17th August, say that they don't want to volunteer for IV. Please explain why do you expect us to do all the work for you? If you aren't serious then please stop lamenting about your plight.
Join your state chapter and get involved, your active participation is what will strengthen IV and enable us to fix this issue.

I am planning to file AC-21 memo with USCIS.
I hope the my new employer will help with paperwork. and I have to find a lawyer who can do that and be prepare for RFE and Interviews.
My last question to you:
1. Do you know for AC-21 I have to work in the same state where my labor was filed?
my labor was at IL and now working in TX but same type of job.
2. Is there a deadline or recommened time to file Ac-21 memo with CIS?
