    Labor Certification: March 2006
    I-140: Approval April 2006
    I-485 -May 2006
    Finger Printing: June 2006

    It took almost 4 1/2 years to get the labor certification and now its almost 17 months since my I-485 is pending approval. Took the path of writing to the FL, State Senator, Local Congressman and was fortunate to receive their response suggesting that its stuck in the namecheck stage and will have to wait for it to be completed. It has become a nightmare.... The only update in my case used to be whenever I initiate a service request. Now what is that which I can do to come out of this riddle....

    Any suggestion in this regard is highly appreciated !!!!

    At least for the consultation phase hire a good lawyer, there are scores of lawsuits filed each year but as long there was no life threatening injuries in an accident you can get out of it. This should not be a criminal conviction and should not hurt your gc process. Again I am just assuming the back up ended in some dent to the other persons vehicle or were they walking and you hit them there were injuries involved.

    My H1B going to expire Jan 2008. I am not planning to renew it. My PD is current (india-eb2 2004 jan). I am planning to travel in March 2008. Do I can travel with AP, without valid H1B papers. ? Do I need to renew my H1B ?

    You should have AP approved to travel in / out of USA, and valid EAD to work after your H1B expires (though you continue to work for the same employer). It is recommended to keep H1 status as long as you can, just in case anything happens to AOS - Again, it is a personal choice to renew H1B. I dont forsee any exit/reentry problem due to not renewing H1B. Good luck!

    With total contributions < 20% (may be lower) then Payton Boggs fees (http://immigrationvoice.org/forum/showpost.php?p=50347&postcount=4) and repeated requests to focus on financial contributions, $0 contributing members continue (with utter dis-regard to financial contributions) to post in IV forums.

    There is a member with $0 contributions but 241 posts (often non-english) containing utter nonsense. My dog can post 100 posts and become a senior member. However, my dog will be less shameless so as to avoid misusing someone's scarse resources.

    We have 97% (of 9,000) members who can not pay $20. This is when Aman has spent 30-40K and core members have spent in K's.

    The Skilled tag of IV members is only for Labor Certification. Shame on all financially non-contributing members and non-members who continue to hang here.

    How dare you find IV only when you have a question?
    How dare you get depressed and frustated on IV forums?

    I sincerely believe NASSCOM should not ask Bush to raise H1B cap while he is there. It will create unnenecessary rukus in the U.S. media, and critics may contend that foreign institutions are trying to influence US immigraton policy.
    Anyone with contacts in the Sofware Industry/NASSCOM please contact them (and Karnik) to let them know this will be counter-productive at this time. I'm not sure what these guys are thinking, sitting in their offices in Bangalore:(

    The National Association of Software and Service Companies (Nasscom) will take up the issue of enhancing the H1-B visa cap for Indian IT professionals during US President George W Bush's upcoming visit to India.

    The present annual cap of 65,000 H1-B visas for Indian professionals was far too low and needed to be raised substantially to meet the growing industry demand, Nasscom president Kiran Karnik told reporters in Bangalore on Tuesday.

    "Though there are no great issues with the US, we are concerned with the existing cap on H1-B visas, which continues to trouble us," Karnik said.

    He added, "This is something even the US corporations are concerned about and share with us."

    "We intend to take up the issue with President Bush during his forthcoming visit to India (March 1). Since the US administration too understands our needs, we hope they address it."

    "Indications are some moves are afoot in this direction," Karnik said on the sidelines of the second Sino-India software industry cooperation summit.

    Recalling how the number of H1-B visas for Indian professionals touched a peak of 195,000 annually not long ago, Karnik said the Indian IT industry would be comfortable if the cap was more than doubled from the present level.

    "We are looking at a cap substantially high enough to bridge the demand-supply gap. We want market forces to be the deciding factor as the Indian IT industry is the major user of the H1-B visa," Karnik pointed out.

    The other major issue worrying Nasscom is the social security system or totalization agreement for Indian professionals working in the US under H1-B visa.

    "Even the high fee structure for H1-B visas is concern for us because Indian professionals are made to pay up taxes for social security without any benefit. Since the H1-B visas are only for three-to-six years and social security benefits flow only after 10 years, Indians stand to lose out on them," Karnik lamented.

    To overcome the problem, Nasscom has suggested the US government could refund the tax deducted under the social security system at the end of the work permit on the lines of some European countries.

    "We are not against the deduction per se. Collect the social security tax, but refund the amount when the person leaves for home, as is being done by some Scandanavian countries like Finland and Sweden," Karnik affirmed.

    In fact, Nasscom is in talks with more countries to introduce a similar tax system for the benefit of Indian IT professionals going abroad on work permit visas for onsite work or executing projects over a long period.
    Nasscom also plans to bring to Bush's notice the urgent need to hasten the process of issuing H1-B and L1 visas.

    "We are not against safeguards for L1 visas, but new restrictions should not be adverse. We agree L1 visas should not be misused. But the process should not take too long," Karnik said.

    While H1-B visas allow companies incorporated in the US to employ professionals from overseas, L1 visas is more temporary in nature and is issued for transfer of an employee from overseas to the US.

    In this context, Nasscom hoped the opening up of a US consulate in Hyderabad soon would benefit the Indian IT firms in reducing the time taken to process their visa applications.

    I second everything logic has said,

    Also it is really funny and I use to think it's just me, but I am glad someone else is also experinced the same,

    Myself, I was able to file I-485 and renewed EAD 3 times, which means my wife is working from past three years, I have changed job using AC-21 twice and my salary is increased and have better job, which means I am not too much worried about getting GC, but I still contribute to IV and call lawmakers many times.

    The FEAR I see among many people is really pathatic, I know couple of friends does not even want to talk to me on phone about this matter thinking that some one might be listening,

    Ok, so here are some more thoughts ... obviously we are all stuck in our current positions and we are worried about the future. Unless, we do something to be prepared we won't be better off when we get our GC's? Given where most of us are I think we have two options:
    1. Advance your education (MBA/PM/certifications etc.)
    2. Start a business.

    I would like to hear from everyone who has or wants to start a business.
    1. Have you thought of starting a business?
    2. What does it take to start a business while on H1B
    3. Is it worth the effort not knowing if/when you will get the green card. Remember starting a business is not a short-term goal.
    4. Are there businesses that cross borders i.e. we can continue to run the business even if we have to leave the US?

    If there is a software designed by us, totally the system may collapse ;)i seriously doubt if the folks out there in uscis analyse the way we do here in these forums. think for a minute... if they work so sincerely and intelligently, they wouldnt be working for 20$/hr. wish there were performance based payment schemes for these folks.

    What if they start screening EAD or GC guys and decide applications on the fact that at one point of time one has not maintained this rule and start denying.
    I dont think one would get any lead time to figure this out. if they(USCIS) decide to do so, Example is where the H1's were turned back at newark airport(Did they get any lead time. i dont think so)
    So the better thing is to understand first what the exact implications of this memo are and act now peace fully. atleast call ,send emails or some thing similar .

    As I see it, the only persons benefited are the ones having the priority dates in ancient times. I think we really should not mind letting them have their GC's, being our seniors.
    Yes, later year porters might end up having to wait. It's all in the game, fortunately or unfortunately. One thing is for sure, we as a whole, have an uphill battle
    If it really comes to matter, I think it should be easy for an EB2 to port to EB3 if the dates are current for him in the different category. So if I were EB2 today, I wouldn't be so apprehensive :)

    I have neither become apprehensive nor have got any ill feeling ... just showing where the problem is .

    You have to be aggressive and presistent to get a new job where you get better pay that is above the prevailing wage.

    Secondly, if you are being paid lower than prevailing wage right now in H1B, your company is breaking the law and you could be in trouble too.

    You need to get out before this thing turns into a nightmare and put your resumes out there on monster, dice etc...and GET THE HELL OUT. The job market is good right now and this is the best time to look for jobs that you can

    1. Stay there for 5-6 years while you GC is processed.
    2. Has decent pay, well above the prevailing wages.

    Do IT NOW before the housing led recession slows the economy down again and job switch becomes difficult. What are you waiting for?
