Reverse brain drain will not happen with warning. But it is happening. I know 4 of my friends (Great guys) left US just because of the current immigration issues.
People might not take decission now, but when time comes, that happens all of a sudden, they will not protest or even inform any one, they just catch the plane. No one knows that it has happend.
But can you bring them back if you want. IMPOSSIBLE.
Also Imagin, US is in good situation (not really but OK.), so they are ignoring immigrants, imagin what happens if they want people tomorrow for their survival. With this background, I am sure that they are going to get only JUNK.

I have taken my Ex - employer to DOL and USCIS and I was successful getting my money back.
If you go with lawsuit then it becomes partially a Civil case rather than criminal offense.

As I said in the preface of the list, the bigger objective here is to take certain steps, including proper documentation (e.g. points 2, 3, 4 and 5), in order to maintain PR status. Besides, you never know what documents you would be asked to produce, given that the citizenship process involves more extensive background checks than the GC process. Also, having a log of exit/entry details (point #5) should help quickly fill out Part 7 of the citizenship form (http://www.uscis.gov/files/form/N-400.pdf).

Currently before the Senate, the measure would allow undocumented immigrants to remain in the United States and earn a chance to apply for permanent residency. An alternative bill that already passed the House of Representatives would turn the country�s 11 million undocumented immigrants into criminals, subject to arrest by local authorities. �If you are an undocumented immigrant in the United States, at the moment you have two choices: You can either stay put and hide, or you can lose everything you have,� said Kelly Fincham, executive directors of the newly formed Irish Lobby for Immigration Reform, which organized the meeting at St. Mary�s Help of Christians Catholic Church. Fincham urged those in attendance, even ones who cannot vote, to call or e-mail their U.S. senators and representatives and ask them to vote for the Kennedy-McCain bill. �Do you really want your future to be decided behind closed doors in Washington, or do you want to have a voice?� she asked. An early indicator of the success of her group, formed in December, was the attendance of U.S. Sen. Congress is expected to pass sweeping immigration reform legislation later this year affecting America�s estimated 11 million undocumented immigrants, of whom around 40,000 are Irish. One version, which already passed the House of Representatives, is an �enforcement only� bill sponsored by Representatives James Sensenbrenner (R-Wis.) and Peter King (R-N.Y.). Known as the Border Protection, Antiterrorism, and Illegal Immigration Control Act, the measure makes it harder for legal permanent residents to become U.S. citizens by allowing government officials to deny naturalization applications based on subjective information or secret evidence. The measure intensifies sanctions against employers who hire undocumented immigrants and requires them to confirm the authenticity of their workers� Social Security numbers. It gives local police the power to enforce immigration laws and penalizes states and cities that protect confidentiality of immigrant crime victims and witnesses. Other provisions would make drunken driving a deportable offense and mandate the construction of five double-layer border fences at a cost of $3.2 million per mile. The Kennedy-McCain bill, known as the Secure America and Orderly Immigration Act, was introduced before the Senate last year by Senators Edward Kennedy (D-Mass.) and John McCain (R-Ariz.). The measure would permit undocumented or �illegal� immigrants currently living in America to obtain work visas for up to six years. They could apply for permanent residency after paying fines, passing a background check and completing a period under a temporary visa. I am already financially/emotionally drained out due to my accident. I guess its going to be deja-vu for me again.
Now I have hardly any money in my bank accounts(around 14K to be precise), and no house , which seems to be a good news and they cannot rip off much.
Only questions I have now are:
1. Any idea generally how long these things can go on?
2. During the trial will there be any restrictions on leaving the country (In genuine emergency situations)?
3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?
One more suggestion:
1. Start withdrawing cash from bank accounts and leave the cash with someone whom you trust.
2. US can put pressure Indian counterpart to freeze your Indian bank accounts, hence don't tranfer monies in any of your or your wife's accounts.
3. Keep liquid cash on hand (not even in bank's safe deposit box)
Just thinking out loud.
Hang in there.

Forum Gurus - I got a denial letter on my 485. I am a July 2007 filer and applied for AOS in July 2007. My 140 was revoked by ex employer in August 2008 and immediately I got a NOID from USCIS and responded to it in a timely manner and my case processing resumed.
But now, I got a denial stating that my 140 has been revoked in August 2008 and thats why my 485 is denied. My Attorney is filing for MTR and says it is a mistake on their side and will be resolved through MTR.
It just baffles me that the person who sent the denial letter never looked into the system to see my case trail and blindly issued the denial notice. My Attorney says, it is very much possible that they do not look at RFEs or responses - they just issue denials when they browse through the 140s.
I am EB2 India with a priority date of March 2006. I think some kind of pre assessment is going on. There are no LUDs and mine is at the TSC.
Is there anyone else in the same boat? How long does it take for MTR to get processed?

We filed for Motion to reopen on which were receipted on March 27th, 2009. I wrote to Congressman, Senators and also Ombudsman. Today my congressman's office got an update that our MTRs were approved on April 30th and our 485s got reopened and they have sent letters to that effect.
What a relief. It was a stressful 6 week ordeal. Thanks to IV and its members for the help and support.

My dad, had to use the insurane, unfortunately. All the hospitals, docs offices billed the insurance company directly. I had to pay only for the prescription medicine after he was discharged, as pharmacies bill online, and they do not have online setup with indian companies's adjusters here.
Icici lombard paid as per the coverage, it took a while, but was was mostly due to my dad's doctor back in india took long time to respond to their questions. I am not sure on the 70+ factor, as my dad was 61 that time.

Guys,
Please refrain from fighting on EB3 and EB2 issue. We all know how difficult retrogression has been to every one here. As some one has already said, If interfiling was so easy and every one was fortunate enough to file another Labor/140, EB-2 would have been in 2002 or along with EB-3. AFAIK, Interfiling is some thing the law allows and as long as one does what the system allows and is not gaming the system, its perfectly fine. Don't rub salt on others wounds. Do what you can to improve the system. IMO, the backward movement was a knee jerk reaction to the false demand, shown by USCIS with a huge movement in PD. As you may know, this is purely demand and supply based DOS will move dates forward as soon as they realize that there is not much demand. DOS keeps track of all visa number requests and approvals based on PD's. The problem is DOS just does not know how many applications are pending per country per category to stop the back and forth movement of dates and make the date movement strictly forward. DOS clearly made this a requirement in OCT 08 bulletin and lets see what happens in the next few months. 2nd Q will be key as the over flow will start to trickle based on demand in EB-1+EB-4+EB-5

It took me around 4 years. EB2 India, started as a scientist later physician and endless headaches ...... but its over now. Got my card yesterday. Its an amazing stress relief and confidence booster.
I could have tried EB1 too but wasnt sure how it would turn out hence stuck to EB2.

For some odd reason I got a red on this forum. I dont know who did that and why. But I dont care.....
For those who are waiting: Keep pushing and thinking of new ways of making this work. if you are EB3 try to become EB2 and even EB1. In the end all that matters is getting the card.

Ok Logiclife, i did not intend to start a war or anything of the sort. I was just giving suggestions in light of the fact that inspite of IV working VERY hard, nothing is happening on the GC front. That is the ONLY reason I put up this post.
One more thing. You mentioned that a lot of people are not contributing, maybe the reason is that not everyone wants a GC that desperately. Some people are fine with working here temporarily and then going back after making some money. Besides some members who have contributed in the past may be wondering if it even makes sense to contribute again, being that there has been no real progress on the GC front since Dec 2005 (the birth of IV). Now do not get me wrong I KNOW how hard the IV team has worked and how many time we came SO SO SO close to getting our dreams realized in the Senate only to be crushed in the house again.
My point was, maybe it is time to face the facts. The government has changed but the basic attitude towards the "immigrant" is the same. This is because the average American, views immigrants as a threat. Now we can argue all we want on that statement, but in our hearts we know that the "AVERAGE American" would rather Not have immigrants come to the US (legal or illegal). In light of these events does it not make sense to ask for simpler goals? Goals like 485 filing or H4 Eads etc. Sure it makes us look weak in front of the anti-immigrants, but then are we here to solve our problems or to prove the anti-immigrants wrong?
Lastly this was NOT a threat nor was it intended to be a Threat that "take my advice or i will leave". Just a simple suggestion in light of things to come.

Almost all Hyderabad house hold has one or more members live in US, who save atleast 15l/year and invest a lot in homeloand which would translate into sustainable stability in AP,India.
Unless US govt. declares bankruptcy, AP real estate would not burst so it would be safe to invest in AP.....
I feel you guys are barking the wrong tree altogether. I agree that there will be a slow down in the real estate market. No question about it. But not the segment you guys are arguing abt. Only 10% of the NRIs can afford a house worth more than 50 Lakhs. I am being conservative here. So the upscale realestate market is not fueled by NRI money. Its the black money in india.
There is a lot of black money in India. Real estate bubble in india is definitely because of that money. It will not correct as much as US for sure!

I feel you guys are barking the wrong tree altogether. I agree that there will be a slow down in the real estate market. No question about it. But not the segment you guys are arguing abt. Only 10% of the NRIs can afford a house worth more than 50 Lakhs. I am being conservative here. So the upscale realestate market is not fueled by NRI money. Its the black money in india.
There is a lot of black money in India. Real estate bubble in india is definitely because of that money. It will not correct as much as US for sure!

There is no leadership problem in core : not a single thing, nada, zitto, zapata. Core has much better info for decision making then any non-core; the decision may be interim relief (I-485 filing, unused visa recapture, ...) or any thing else. My conclusion is based on my readings about immigration issues, our issue, current political situation and core posts. Core has correctly predicted Ag Jobs and Schedule A this month. We are wasting our time by debating this issue. Please educate yourself.
Core has not misused any contribution money; it is not easy to misuse contributions made to non-profit organization. Once again please educate yourself. Besides, how much contribution money is there? However, I have very serious problems with members when Aman says that he has spent 30-40K of his own money and logiclife says that he has spent his own money on travel : shame on all members who are still sitting on their $20 and debating all other issues.
I do have some issues with core. Some members are curious about finances and progress reports. It is much better to post such info (decided by core) rather then wasting time when someone asks about. At present, such info has been posted and is the best info available at this time.
I also have some issues with deleting posts. Based on the contents of deleted posts, I don't think the core has much to hide. Hence, it is better to let these posts exist rather then delete them. Members who agree with these posts should be free to debate. They will not hurt IV. Deleting posts has undermined the credibilty of core.
IV was founded by some some core and exists only because of their efforts. They have earned the right to make some decisions. Please understand that, everyone makes some mistakes and has some bad days. I request non-core to give then benefit of doubt on side shows and freak shows. We are wasting our time on these issues.

After speaking to a few people who did an MBA and a couple of MBA consultants I think that most important parts of an MBA are the in-class experiance of working with other folks in the class and the opportunity to build a network. I seriously doubt if online MBAs can provide them.
