What makes you to think that I am scared of talking to attorney? I have been in this struggle for last six years, you have no idea what people have been through.. It should show a lot of details about the employer and also as to who prepared the forms(attorney info if there is one)
As i said if the company itself has done the work themselves with a full time attorney...then the company is fully liable...if the company has hired outside attorney...the company is still liable...but the outside attorney would also be liable for building fake cases.
There is also a law that if the H1B employer has terminated your services before the estimated time your service was required then the employer has to pay you the transportation costs for your return home.

The mistaken notion "GC = freedom" seems so pervasive that I am also tempted to take a whack at this much maligned equation. Lot of anguish can be spared by keeping our expectation from this 3" X 2" plastic somewhat grounded in reality. There is no denying that having GC makes life easier than before, specifically by opening up more job/career opportunities. But these have nothing to do with the constitutional freedom that you presumably allude to with your Statue of Liberty analogy (I should say though, as a metaphor this quote of your colleague is pretty lame). Not only GC does not give us the right to vote, it cannot even protect us from deportation risk on relatively minor legal grounds (http://www.nytimes.com/2008/04/12/us/12naturalize.html?_r=1). We all can certainly do one thing, we can write emails, letters to editors and media talking about our personal situations, highlighting EB visa backlog and how that is hurting legal-tax paying aliens like us. We can raise awareness in the media and we can bring new members.
When something is asked of us, we should do that. Pappu asked everyone to write to the editors thanking them for the story about immigrant entreprenuers. Just yesterday, we had some people come forward and write to all these editors.
Myself and some other members even posted names and emails of all the editors that we should thank in the "news article thread". If all of us can go there and write emails and flood them with thank-you notes, we will get noticed. Remember the print media business is based on how many readers they have, we have to make them feel that this issue is very important and is getting them more readers and membership.

Why is the above important? Because it's a window into their mindset. Like any responsible corporate firm they wanted to sound a little empathetic but didn't want to give false hopes by saying a reversal was possible though they probably knew the outrage among potential filers who had been dealt a nasty blow below their belt. But VB disaster was one issue where there was not even the slightest doubt that what had happened was horribly wrong and cruel that even some cold-hearted anti-immigrants were confused for a day or two and didn't know what to say because they didn't want to pile on our heartache. The way CIS works had, like any bureacracy over time become a cold and heartless beast but since they deal mostly with non-citizens who have little rights and feel so unsecure and unwelcome in the first place to ever speak out, they were never going to know how their actions are wreaking havoc on their customers lives. So unless affected people come together and act they are never going to know how bad it sucks to be on this end of the divide. And ofcourse it's not all CIS - they are just an arm of the government carrying out the law. it's going to be next to impossible to do anything without congress stepping in. And while Fragomen is definitely not lying when they say they will work for some relief and probably are given that their partners often show up on congressional hearings, they won't lose sleep over it nor will their passion levels be anywhere near that of those who are directly at the receiving end of this current ugly messi.e iv and it's browsers. Since this discussion has been going on for 5 pages, i thought ill add my 2c.
Firstoff i haven't gone through all 5 pages so if someone already mentioned this, please don't jump on me. You can create an SBI account called SWIFT account. They will give you an account number and a SWIFT code for the bank.
You can then initiate a wire transfer from any bank in the US. They charge a flat rate of around 35-45$. The good part is, you can have the money sent in $ to your local account. They say it takes 3 days but it never takes more than one day for me.
The money is saved in FD as dollars and earns you interest if you leave it for 11 months. If you need to convert it any time, you have to forgo the interest (as with any FD) and you can get the closing exchange rate of the previous day.
This has many advantages
1) one simple fee of 35$
2) In case you want to bring back the money to the us, since it is kept as dollars, you can transfer it back without any hassle. (To keep it in dollars , you may have to provide this as a special instruction)
3) Folks back home have control on exchange rate, they can cash it any time it is high
4) Takes less than a day in most cases.
If you do the math, you will see that this is better than icici when you are sending 4000$ or more approx. icici does not take fees upfront but they always give you almost 50p less than exchange rate.
I have used this 4 times so far and its very reliable.

I'm not working in the IT industry and this is the first time I have some idea about what the desi companies are doing in US. Yes, I think these desi companies and people who conducted those fraudulent behaviors are partly responsible for our situation here. I believe most H1B holders are decent people while some like those mentioned in the article are nuts. Bad purges good. Now all H1b holders have to pay the price.
Besides, I think those who conducted these fraudulent behavior do not deserve to be called "high-skilled workers".

A desi consulting company brought him to the US. When they realized he wasn't going to get a project, they just didn't let go of him. Since he was a reliable guy (1. he can be trusted with monthly grocery payment 2. his labor can be sold later to others 3. he servres as an insider who can get information if other consultants are trying to be sneaky by getting their resumes marketed by another company, etc etc, basically he is an asset even thought he doesn't have a project), they just decided to keep him there. These companies don't have attorneys. They take care of all legal matters themselves. Now, how much is hte USCIS fee to file for labor? How much to file for I-140? Peanuts right? So they continue to keep his application active. How hard do you think it is to get fake references when you can make fake resumes. They have fake pay stubs. Fake experience. Fake this and fake that. Everything they do is fake.
So to others who have said that this thread has to be dropped, and have said that these desi companies are right in doing what they're doing, or who have blamed the system - I think that you are one of those people who are involved in such a racket. I know that I have touched your nerves by letting the whole world about this (not that some people didn't know this already). Why else would you want this thread dropped?
Actually I know a guy who lost his job and joined a restaurant as a cook or something and applied GC, then after 1 yr or so got job again and used the EAD to change to the Tech Field again and at a different location.....I hear he is indeed facing some problems now.

Did you keep new filing fee also? When I spoke to custumer service by 800 number call, she said you have to keep new check and original sealed medical along with duplicat filing.Wish you all the best!
Same as me :D but for the fact that I sent in mine without medical. What do you guys think the chances are of USCIS sending an RFE instead of rejecting the application outright?
Btw..I did "re-file" with completed medical yesterday. I am just hoping they accept my July 2 app. to avail, if any, advantages of RD.
