Bloggers always go overboard on this stuff. It is clear that Apple is trying to protect their "iPod" brand, not attack "podcast" per se...

Wow, I was going to go by after my meeting at work (approx. noon)...I hope there will be some left. I guess I will stop by the Apple store in Green Hills first, if they are out, then it is off to the Cool Springs store.

I had a problem here in Arizona where there is no daylight savings time. I have the my AT&T iPhone set to auto set date and time and it was a hour ahead.

According to US law, a trademark holder MUST defend their trademarks, or they risk losing them. Google is struggling with this, as they're trying to encourage people not to use it as a generic verb.

Absolutely. Having received a couple of cease-and-desist letters myself (from Microsoft, actually), I think Apple's letter to Podcast Ready is extremely polite and accomodating for letters of this type. Also, note it was carefully crafted just for Podcast Ready, undoubtedly at significant expense. If Apple had a larger agenda of controlling the term "podcast" in all its uses, I suspected this note would have been a bit more boiler-plate and re-usable.
My take on this is not that Apple is trying to own all uses of the term pod or podcast, but to establish the legal boundaries between the reach of their trademarks and common usage. In order to do this, Apple has to take a somewhat aggressive stance. The actual boundary will be adjudicated by negotiation, and at some point, probably the courts.

I do wish people in this forum stop referring to 'the military' as though they were some sort of alien life-forms. 'The military' are people, and even if you happen to be in the oh-so-unique moral high ground of opposing war and violence from your comfortable desk, soldiers deserve the best kit we can afford to give them. Nobody said they had no right to sue. And, unlike Wiid, I don't think it's ridiculous for anyone to defend their patent rights; some parties have more merit to their cases than others but you don't know until you go through the process. Don't know who wins here, but my guess is minor cash and cross-licensing is in the future.

The kid didn't "do it". He is just reselling what was rejected by Apple. Apple has higher standards for the color matching, durability and such. They've rejected the units he's selling because there are problems such that the units don't meet their quality control.

I was playing with it and what you are putting the team number where you put your user number. In that same field you need to enter: 140721 this is your number. If you enter that number it should come up with your score. :)

Exactly - enlighten us. How do you know why its marketshare has increased as of late? Neither me nor freeny claim that its SOLELY because of the ads - but how can you prove that the ads haven't convinced 1 single switcher...?
I'm not claiming to say that these ads have hurt or helped boost the market shares...I'm only saying that I have only heard negative things about them.
I feel embarrassed watching them.
I personally believe that the market share has risen because of the intel switch. The ads happened to come out at the same time so it's impossible to know how they've affected the market share, but either way I really don't like them. It's not the actors either... definitely the elitist script.
I like that Shaun White ad where he narrates what he does with his computer and this stunt guy (you can only see his torso) is reaching and grabbing at nothing that was edited later to appear as if what he was grabbing at were his folders/documents/songs/etc... Pretty clever. And no snobbishness (yeah that word rocks) either.
Did I mention I like Ellen Feiss?

Did you notice the new smaller power brick actually has a fan now? That's what's making most of the sound :/

From what I understand, there are smart and creative people at MS but the company is bloated and unorganized so it is unable to really utilize its people effectively.My friend's son is a senior MS exec, and from what I know (third-hand, mind you), Microsoft has a history of hiring lots and lots of top-tier grads. From about 1990-2000, they pretty much had pick of the litter.
Since then, Apple and Google among others have become magnets in their own right, and IBM and Oracle have also picked up their share - to name a few of the big boys.
You're right about the bloated part too, tho' "overorganized," i.e., bureaucratic, rather than unorganized may be a better description. MS is a collection of jealous baronies where the Win, Server and Office groups can pretty much quash anything else that doesn't fit their grand schema.
Which has resulted, e.g., in their seriously flawed efforts in the phone and "slate"/tablet markets. Including the recent "Pink"/Kin disaster.
So a lot of the talent begins to feel misused, abused and undervalued. But there are interesting things going on with the X-Box, Sync and Surface teams, and a lot of talent and resources are being thrown into the growing (if hard to understand and manage) stable of Live (read: "cloud" and "SaaS) offerings.
One semi-independent team is that developing Office for Mac. I've been in their advisory panel for a year or too now, and they really go out of their way to solicit feedback, suggestions, not just about Office (in some depth), but about how I use my Macs, and my attitudes about things like Office Apps on iOS devices. You get the impression they really care about their product and enjoy what they're doing.
Yeah, yeah, they probably feed it back on ways to make Win more Mac-like, but in the long run, for all users and Apple itself, I don't necessarily see that as a bad thing.
Both companies are going to be around for a long time, and while they overlap, they also have different missions that occupy different aspects of the whole computing "ecosystem." And both now have a common interest in not letting Google overrun key products.
PS: If you're looking for new companies for Apple to wary about, also keep your eyes on Amazon, and yes, facebook. Both have "ideas."

It is what I've been saying here for the last year. MR readers are not the target audience for the iPad, and that is why they have been so consistently wrong on the iPad's prospects until market data proves them wrong. We are NOT normal -- we like to hang out on a tech rumor site :)

I disagree with the luxury vs cheap car analogy. I built a core i7 that exceeds what apple provides and its much more "luxury" then a junker car. It looks great because the case I chose, it performs awesome and the cost was 1,500 less the comparable mac pro. I opted to turn the computer into a hackintosh because I do prefer OSX over windows.
You can throw a crate engine and a body kit on a Civic. It's still not a BMW, even if it's faster, more customizable and cheaper.

Do these companies really want people to pay for the same content twice? Surely they can't realistically expect to a get premium for viewing in the same location but just through a different medium?
