Does anyone know if there is a time frame (say 60 or 90 days) within which they have to approve your EAD, AP & 485 after issuing the receipt notice?

Was there any audit for the perm (regular/random audits or otherwise?)?
Was the 140 done under premium processing?

I wonder the reasons for Switzerland to be #1. Its a small country with minimal immigration and not much resources. Key revenue might be from Tourism. They are not known for scientific work etc.
... Maybe swiss bank accounts are key to it ! ;)

actually they do a lot more than tourism........

Yes, I guess there's something FISHY. I really feel the PLOT is to rip of all the $$$ first by making dates current and bring in some crap legislation that'll throw everyone out. What a brilliant scam! Even Harshad Mehta will be impressed :-)

1. Read this pdf. http://www.uscis.gov/files/article/E1eng.pdf This should answer your questions on H-1B
2. Documents are needed to demonstrate that offered job is of specialty occupation and the beneficiary meets job qualification. It also has checks for employer who is offering H-1B job.
3. Pay stubs are needed so as to prove that beneficiary is maintaining valid H-1B status when another H-1B petition is filed.
4. Client Letter is needed so that Employer (petitioner) can demonstrate that the proffered position qualifies as a specialty occupation, or that the petitioner has complied with the terms and conditions of the LCA.
H-1B is not for any job. The job must meet requirements for H-1B. Read the pdf mentioned above.
I am sorry that you feel like sl***, but you do have option of changing the job if you don't like current job and you feel like s****.
Thanks for sharing your "sad" story!

Looks like you got angry.Everybody knows H1 requirements as much as you do.Do you think are the only one who is smart in this world.I don't think so.
You haven't answer me the question"What if your H1 is denied once you started working with out its approval" which I replied in your first post.
Also you have replied me that H1B is not for speculative job.If it is true then what is the need of H1 Change of employer. Can you inform USCIS to remove this option.
When your H1 got approved first time the same USCIS verified your Educational certificates. Why they want to do the same verification again and again?
I advice you to read murthy.com articles which sometimes point out that USCIS document were not clear

Pappu,
I am assuming that you are looking for someone who was "layed" off; not necessarily just the end of their contract??
May be you ought to expand the criteria to also include anyone who has changed their full time job will-fully?

They ask for entire requested period. Send everything you have + my lawyer wrote a letter specifying that this client is where I will be for next 3 yrs. and contract is always extended every 6 months. (This part was not specifically mentioend anywhere.)
We also had 3 other offers from local fortune 500 co. One of them even had open ended contract with no end-date so
that may have helped
If you are working for past 3 yrs. that is a VERY sTRONG case. send all the contracts for past 3 yrs.
They want to make sure it's a genuine high-tech employment.
Zcool,
I applied for my H-1B extension and got an RFE asking for contracts and client letters for the requested period i.e., for the next 3 years.
I see that they asked for client letters from you ... but did they ask for the next 3 years? and if so, did you guys reply the RFE with a client for 3 years?
I have been working at the same client for the last 3 years, through a vendor. Mine is a small consulting company. The client has been extending the contract in 6 month increments and I could get a client letter for the next 6 months only.
Same is the case with the contract.
I could not file for 140/485 in july, 07.. so do not have the EAD safety net.
Please advise.
Thank you.

My 485 was apporved in July 2010 and have not recieved the card yet. I have contacted with couple of Service Request for non-delivery of permanent cards. First reply from USCIS was that my case was waiting for finger printing information from my local USICS was backlogged for appointments. So, I have told to wait for 60 days for either FP notice or physical green card. After 60 days, I have called them and another service request was created and the reply was completely irrelavant as they says my address was updated for my query about non-delivery of GC.
Is there any other escalation request that I can made for deliveriy the GC or the FP notice? whenever I called the USICS are creating the SR and have to wait for answers like above.
I have recieved the 485 approval notices (for both of us) on July itself but waiting for cards now. Are anyone with the same boat ? Or Is the unusual case?
Thanks
Rama
Contact your Congressman and Senator. Mine was also approved in July but the card came in November. Went for a couple of Info-pass, opened SR, called & e-mailed USCIS but nothing happened. USCIS is backed up on card production too.

Question...see below in bold
The issue is that my company lawyer said that there will be a need for a visa stamping done for the extension because of the Last action rule. The murthy forum reference is something I dug up via google.
Because the extension will be for a future date (March 1).
-- Question: Is this extension based on I-140 is different than the extension you get for the second 3 year out of 6 year? If not, then why I-94 can not be given date adding the extension of 3 year ?
Current visa stamp is till Feb 28, 2007. So if the officer gives a new I-94 with Feb 28, 2007 as the validity date, the attorneys claim that it will invalidate the approved extension due to a "Last Action Rule".
It is hard to trust these corporate lawyers.

I am 19 yrs old and on H4 visa since Sept 2002. Will this act be of any help for students on H4 who will get be aging out shortly at 21 yrs.
Your valuable input will be of great help. Please share your views.
Or is the act only for students of Illegal parents.
Thanks
My son and you are in the same boat. He came here 9 years ago went to middle/high school here. Now, he is in college and will turn 21. He will not get his greencard because he is here on H4 legally.
Isn't that a shame?

For Press Distribution:
Highly Skilled Professionals Call on Congress to Pass Green Card Reforms
Immigration Voice Organizes Congressional Advocacy Days for Highly Skilled Legal Professionals
Washington, D.C. – From April 4-5 2011, over 175 members of Immigration Voice from around the nation will descend onto the nation's capital to ask their congressmen and senators for reforms to the broken Green-Card process.
“While K-Street, the Hi-Tech industry and Congress is distracted once again by H-1B visas, recycling the same old talking points one more time, Immigration Voice’s laser-like focus remains on the nearly 500,000 highly skilled immigrants who remain backlogged for 10-15 years waiting for their Green Cards,” said Aman Kapoor, president of Immigration Voice. “These highly-skilled professionals believe that the H-1B visa controversy sucks-up all the oxygen in the room whenever employment-based immigration policy is discussed. However, the real problem lies in the fact that there is a huge pool of talent untapped by American employers in the form of highly skilled legal professionals who have been living here on temporary visas as they patiently wait for their Green Cards. These law abiding, tax-paying, highly skilled future Americans, cannot start their own companies and immediately create jobs in America, change employers or accept promotions during the Green Card application process, which now spans 10-15 years. This creates serious quality of life issues and ultimately hurts the U.S. economy.
“Immigration Voice aims to create awareness with members of Congress, congressional staff and policy makers about the Green Card backlog, which inhibits job creation, entrepreneurship and wealth creation for all Americans. These immigrants are waiting to showcase their innovation leadership with their U.S. work experience American education. Immigration Voice will insist that Congress focus on the Green Card backlog rather than on H-1B visas,” concluded Kapoor.
Immigration Voice has arranged nearly 350 visits to congressional offices April 4-5 in both the House and Senate. You are invited to meet these activists at their Capitol Hill reception:
What: Immigration Voice Congressional Reception
When: 5:30 p.m. - 8:00 p.m., Tuesday, April 5th, 2011
Where: B-340 Rayburn House Office Building
To learn more and to arrange an interview with Immigration Voice on the dates listed above, Contact: Immigration Voice (202) 386-6250 or Press@ImmigrationVoice.org
Founded in December 2005, Immigration Voice is a rapidly growing, national grassroots, non-profit 501 (c)(4) organization with 57,000 highly-skilled legal immigrants as members. Immigration Voice is committed to commonsense reforms to the employment-based immigration and Green Card process.

I agree with you 200%. This new change will severely cause further retrogression.
The only thing that can disturb the trend for March VB is the new rule about NC>180 day pending.
It can cause further retrogression.

"This is truly landmark legislation produced by a big-league team," said Sen. Arlen Specter, R-Pa., chairman of the Senate Judiciary Committee that wrote the legislation.
"The next step is going to be the conference (with the House) and I believe we can do it," Specter said. "We're going to work as hard to get a bill to the president's desk as we did to get a bill passed today. And I predict success."

Hello Zen,
Good question...I don't know, but it seems like the FP are valid for about 1.5 years....no idea about medical records validity.
Hello bsbawa10,
I think the process is designed for 'non-backlogged' processing which normally does not extend beyond a few months...you are right, maybe, we should have a different validity in the current situation with long backlogs.

same story for me, i just moved to different unit in the same apartment. everything remains the same. Same city, same zip code, same employer.. Somehow i believe address change triggered the RFE. Probably the change in the file pushed my file in FIFO and someone looked into it and gave a RFE. Will have to wait till i get the actual letter.

Some key points I heard -
Looks like US Chamber of Commerce supports tougher security and more immigration
The spokesman thinks that immigration bill passing this year is a longshot but a lot has been built for it to pass in 2007.
Kinda support Hutchison Pence but they are not comfy letting people leave and then come back. They think people will be stranded (workability issue)
Believe that Prez Bush is doing all he can but House reps are doing all they can just to ensure they win elections.
